Ordinance of the Ministry of Agriculture, Forestry and Water on the granting of refunds and aid in respect of certain damage caused by measures against diseases and other public animal diseases

Ministry of Agriculture, Forestry and Water Management
of 3 July 1963
on the granting of refunds and aid in respect of certain damage caused by measures against diseases and other mass diseases in livestock
The Ministry of Agriculture, Forestry and Water Management, in agreement with the Ministry of Health, the Ministry of Finance and other participating central authorities, provides pursuant to Section 17 of Act No. 66 / 1961 Coll., on Veterinary Care:
§ 1
Granting of aid
(1) Single agricultural cooperatives, funerary workers, small livestock farmers and individual farmers may be granted aid from State resources and under the conditions laid down in this Decree for the payment or reduction of damage and, where appropriate, for the costs caused by:
(a) the slaughter or, where appropriate, the slaughter of livestock has been ordered;
(b) protection and control measures against diseases and other mass diseases of livestock have been ordered.
(2) The aid shall not be granted for livestock the killing of which has been ordered to breach the closure order.
(3) The aid provided for in paragraph 1 may also be granted in cases of the death of livestock in the case of diseases or other mass diseases.
(4) According to this decree, farm animals are: cattle, pigs, sheep, goats, hoarders and aquatic poultry, monungulates, bees and fish.
§ 2
Amount of aid
(1) The granting of the aid provided for in Article 1 shall be decided upon in respect of the application of the injured party and, after prior observations by the veterinarian of the county veterinary establishment and the local national committee, by the district national committee, in whose area the measures referred to in Article 1 (1) have been ordered or, where appropriate, in whose area the animal has died. Where a single agricultural cooperative is requested to be supported, the regional national committee shall, before the decision is taken, provide itself with the expression of the agricultural production administration. When deciding to grant aid, the district national committee - if it is a single agricultural cooperative operating with the agricultural production administration - shall take the necessary measures to ensure that the aid is used to remedy the damage suffered.
(2) The amount of aid may be:
(a) cattle, pigs, sheep, goats, poultry and unungulates - up to 100% of their purchase price;
(b) fish - up to 100% of the purchase price of table fish,
(c) bees - up to the specified prices. *)
In all cases, the district national committee shall deduct from the planned amount of aid any proceeds resulting from the purchase of the animal, the compensation received by the injured party by reason of the insurance of the animals, as well as any other compensation. * *)
(3) The aid in the event of damage or, where appropriate, reimbursement of costs incurred as a result of protective and protective measures pursuant to Article 1 (1) (b) may be granted up to the amount of the damage or costs incurred. Paragraph 2 of the last sentence shall apply mutatis mutandis.
(4) According to the previous paragraphs, the Regional National Committee shall grant aid only if all prescribed preventive measures have been implemented and suspected in the development of diseases and other mass diseases of livestock and, where appropriate, the measures ordered by the District National Committee or by the veterinarian of the District Veterinary Facility in preventive inspections or control of livestock diseases.
§ 3
Provision of compensation
(1) Persons residing in a municipality or, where appropriate, premises in which a closure or isolation has been ordered in accordance with the animal health rules, who are in a proper employment relationship and who have been prevented from working as a result of the closure or isolation, are entitled, in accordance with the other provisions of this Decree, to compensation for lost earnings, unless they are entitled to compensation from the employer.
(2) Persons who, as a result of the measures referred to in paragraph 1, have been forced to stay outside their place of residence for the duration of the closure or isolation shall be entitled to reimbursement of the costs incurred by them for temporary accommodation and meals.
(3) The compensation referred to in paragraphs 1 and 2 shall be granted by a national committee in the district of which the municipality or object concerned by the measures referred to in paragraph 1 is located on the request of the injured district.
(4) The compensation referred to in paragraph 1 shall be determined by multiplying the average daily earnings of the worker (without overtime remuneration) over the last 3 months by the number of days during which he was unable to carry out his work as a result of the closure or isolation.
(5) The provisions on reimbursement of travel, removal and other expenses shall apply mutatis mutandis to the granting of compensation for intermediate accommodation and meals referred to in paragraph 2. †)
§ 4
Deadline for submission of applications
An application for aid (Sections 1 and 2) shall be submitted to the district national committee no later than 3 months after the occurrence of the damage and a request for compensation (Sections 3) no longer than 3 months after the cancellation of the closure or isolation.
Final provisions
§ 5
They shall be deleted:
(a) Directive No 393 / 1952 Coll. for KNV (No 490 / 1952 Zb. ob. pre KNV), to grant aid for the payment or reduction of damage caused by the loss of an animal caused by a dangerous disease or by the killing of an animal on official order,
(b) Directive No 192 / 1953 Coll. for KNV (No 235 / 1953 Zb. ob. pre KNV), on the compensation of lost earnings or expenses resulting from accommodation or meals of workers outside their permanent residence as a result of isolation imposed on enhanced measures against animal diseases;
(c) Directive No 91 / 1956 of the Ministry of Agriculture Bulletin on the provision of a contribution for the control of infectious waste.
§ 6
This decree shall take effect on the day of its publication.
