Ministers of Internal Trade and Finance and Chief Arbiter of the Czechoslovak Socialist Republic
of 5 May 1962
on the purchase of goods in state and cooperative trade by socialist organisations
The Ministers of Internal Trade and Finance and the Chief Arbiter of the Czechoslovak Socialist Republic shall, in agreement with the Deputy Prime Minister and the Chairman of the State Planning Commission pursuant to Article 1 of Act No. 160 / 1949 Coll., on Internal Trade, pursuant to § 11 (2) of Act No. 83 / 1958 Coll., on Financial Planning and Financial Management of National Enterprises and other Economic Organisations of the State Socialist Sector, pursuant to § 20 (1) (b) and § 2 of Act No. 8 / 1959 Coll., laying down basic rules on the State Budget and the Management of Budgetary Funds, and under § 190 of Act No. 69 / 1958 Coll., on Economic Relations between Socialist Organisations:
Preliminary provisions
Socialistic organisations (hereinafter referred to as "organisations') shall meet their needs within the framework of material technical supplies directly to the production and, where appropriate, to its sales organisations. The goods sold in the public and cooperative trade are mainly intended to satisfy the needs of the population and can therefore be purchased by organisations for their own use only in accordance with the principles of strict economy in terms of the quantities normally sold in retail trade, in accordance with other provisions of this decree.
Small purchases
(1) Organisations may purchase goods in retail trade for a maximum amount of KÈs 500 per month (hereinafter referred to as the "monthly limit"), unless their superior authority determines a lower amount. The monthly limit shall be for each establishment (component) which maintains the treasury or which has a settlement advance on small and urgent operating expenses, and, where applicable, the standard of cash expenditure directly from sales. *)
(2) If the monthly limit is not exhausted in the current month, the remainder shall not be transferred to the next month.
(3) The monthly limits of each establishment (s) of the organisation must not be merged.
Purchases not included in the monthly limit
(1) In addition to purchases within the monthly limit, organisations may purchase all types of food and industrial goods listed in Annex 1 to this Decree without counting to the monthly limit.
(2) In addition to the goods referred to in paragraph 1, they may purchase other types of goods without counting to the monthly limit:
(a) single agricultural cooperatives of the goods listed in Annex 2 to this Decree, for their own use only.
(b) schools of all kinds of school supplies provided free of charge to pupils;
(c) basic nine-year-olds, secondary education schools and pioneer and youth homes, goods needed for polytechnical teaching of pupils;
(d) vocational training, apprenticeship, vocational, secondary vocational and higher education, goods necessary for the direct and immediate execution of teaching and scientific work;
(e) research institutes and development centres of goods necessary for the direct and immediate implementation of research, development and scientific work;
(f) the budgetary organisation (s) of the local national committees on paid services to the population, small establishments of local national committees and community service undertakings of up to 50 employees, to which the local (urban) national committee has granted the character of small enterprises, in all cases the goods needed for complementary supplies for the performance of paid services to the population,
(g) national committees of goods for the provision of supplementary social assistance in kind and for the provision of assistance to spouses of border residents;
(h) essential elements (organisations, divergences, unity, groups, etc.) of social organisations needed to ensure their own tasks and the Central Committee of Swaziland on Radio Special Training Requirements;

(i) children's and youth 'homes, footwear and clothing components or their making-up materials for young people;
(j) organisation in the purchase of foreign contact items, only by means of means of representation, *) higher components of social organisations, then only by means assigned to it;
(k) organisation of purchases from collections or donations from the population.
Radionisation of sales
(1) Goods may be purchased by organisations and their establishments (ingredients) only in the shops of the region in which they have their registered office.
(2) In shops designated by the Ministry of Internal Trade, it is also possible to purchase outside the border of the region.
(3) Organisations based in the Central Bohemian Region can also buy in Prague.
(4) The provisions on the zoning of sales shall not apply to armed forces.
Purchase restrictions
(1) Organisations may not purchase refrigerators, transistor radios, cloaks and souls for motor cars and motorcycles, tyres and bantam souls, in the national and cooperative trade, and, with the exception of single agricultural cooperatives, professional and protective clothing, footwear and protective equipment provided to employees and temporary staff from state resources, as well as products for equipping social facilities * *), in all cases or within the monthly limit referred to in Section 2.
(2) Organisations (with the exception of schools of all kinds for the purchase of school supplies, provided free of charge by pupils) may purchase printed and typed paper and paperboard, duplicating paper and equipment in the state and cooperative shops, paper and paperboard, paper and paperboard, paper and paperboard, paper and paperboard, paper and paperboard, paper and paperboard, paper and paperboard, paper and paperboard, paper and paperboard, paper, paper and paperboard, paper and paperboard, all ruler, drawing and geodetic equipment only within the monthly limit referred to in Article 2.
Method of payment
(1) All purchases in the retail market are subject to an organization into the Kčs 500, - only cash, above the Kčs 500, - cashless on the invoice.
(2) In the case of repeated purchases of food goods by organisations operating regular cooking and catering, such purchases may be paid at the same time cashless by mutual agreement between the seller and the purchasing organisation, but no longer than a decade.
(3) When buying without cash, organisations are required to submit a written order indicating the bank connections and refer to the relevant provision of this decree under which they purchase. The economic contract for the delivery of the products is also concluded when the supplier fulfills the delivery within the time limit for receipt of the order.
Purchase records
(1) Seller organisations are required to register all purchases of non-cash-based organisations and to list them on a quarterly basis in the accounting statements.
(2) Buyer organisations are required to register all purchases in the store for cash separately in the cash books or on the forms for booking advances *) and to list them on a quarterly basis in the accounting statements.
(3) The provisions of paragraph 2 shall not apply to single agricultural cooperatives, backed-up organisations of national committees, local national committees and their awareness-raising bodies, building housing cooperatives and essential elements (organisations, divergences, groups, unity, etc.) of social organisations. The survey of purchases for the completion of these organisations shall be carried out by a sample survey.
Final provisions
The Ministry of Internal Trade, the other central offices and authorities superior to the components of the selling population and the Regional National Committees may restrict or prohibit the sale of certain goods to organisations within the limits of their competence.
(1) Compliance with the provisions of this decree is subject to random checks by the financial system authorities, in particular the Czechoslovak State Bank, in addition to the competent control bodies.
(2) In case of detected defects, it shall be followed according to the relevant regulations. * *)
The provisions of this decree do not apply to purchases of foodstuffs from wholesale trade when they are carried out according to the plan of material technical supply to purchasing organisations.
Decree No. 188 / 1960 Coll., on the purchase of goods in state and cooperative trade by socialist organisations, is hereby repealed.
This decree shall take effect on the day of its publication.
