of 23 September 1952
on a special contribution to pension pensions in 1952.
The Government of the Czechoslovak Republic orders pursuant to § 6 paragraph 3 of Act No. 102 / 1951 Coll., on the Rebuilding of National Insurance:
§ 1.
(1) A special allowance equal to family allowances shall be granted in respect of the education or child benefits paid to pensions (Section 6 of Act No. 102 / 1951 Coll.) to which beneficiaries are entitled in December 1952.
(2) In addition, a special contribution shall be granted to pension pensions to which the beneficiaries are entitled in December 1952, provided that the pension or the total pension of the beneficiary does not exceed the amount of CZK 1,500 per month. If there are several pensions in one person to which a special allowance would apply, only the highest of them shall be paid.
(3) Pension is the amount of pension without education, child benefit, nursing or blind allowance and without increase for helplessness, but together with any increase in pension improvements of any kind.
(4) The special contribution to pensions is as follows:
a) k sirotčím důchodům a k sociálnímu důchodu sirotků 190 Kčs;
b) k důchodům rodičů a jiných pozůstalých kromě vdov a družek 300 Kčs;
c) k ostatním důchodům včetně důchodů vdov a družek 500 Kčs.
§ 2.
(1) Special allowances do not include:
(a) the retirement of the wife;
(b) an accident pension if the accident is not reduced by at least 50%; to the invalidity pension under Act No. 164 / 1946 Coll., on the care of military and war victims and victims of war and fascist persecution, and to the child supplements paid to that pension, unless the gainful capacity is reduced by at least 45%;
(c) the pensions of orphans, provided that a family allowance is paid for the child entitled;
(d) persons who receive pensions abroad.
(2) The special allowance provided for in Article 1 (2) does not apply to pensioners who are employed since 1 September 1952.
(3) If there are more pensions in the common household for several members of the family, the special allowance is granted only if the sum of all pensions does not exceed the amount of CZK 2,500 per month. The allowance shall then be paid only to the member of the household to whom the highest allowance belongs. In determining the limit of 2,500 CZK per month, the pension of orphans shall not be taken into account.
§ 3.
Special allowances received unjustly may be deducted by their payer from other benefits to which the beneficiary is entitled.
§ 4.
The provisions of this Regulation shall apply mutatis mutandis to gifts and salaries provided under free consideration by pension funds.
§ 5.
This Regulation shall enter into force on 1 December 1952; by the Prime Minister.
