Government Regulation
of 1 March 1946
amending the Government Order of 22 May 1935, No. 111 Coll., implementing Section 34, paragraph 2 of the Military Code of the Civil Code.
The Government of the Czechoslovak Republic hereby orders, pursuant to Paragraph 34, paragraph 2 of the Act of 4 July 1923, No 154 Coll., on Military Disciplinary and Curative Law, as well as on the withdrawal of military rank and transfer to service by administrative management, as amended by the Act of 4 April 1935, No 64 Coll.:
Paragraph 2, paragraph 1 and paragraph 3 of Decree-Law No 111 / 1935 Coll., which implements § 34, paragraph 2 of the Law of War, is amended and read as follows:
"(1) The Commission referred to in Section 1 (the next Commission) consists of:
(a) from the Chief of Staff;
(b) from the Chief of Staff;
(c) President of the Supreme Military Court;
(d) from the First Division of the Ministry of National Defence, and
(e) where the personal matters of the gayist concerned do not fall within the scope of one of the members referred to in (a) to (d), also from the priority of the Department of National Defence (Department of General Defence) or from the commander of the arms at the Ministry of National Defence - the main staff of which they belong.
(3) The Commission is chaired by the Chief of Staff and, in his absence, by the Chief of Staff; If not even the Chief of Staff is present, the member shall preside over the highest or seniority. ';
This Regulation shall enter into force on the day of its publication; they shall be carried out by the Minister for National Defence.
