Government Regulation
of 25 August 1945
on the first elections to the Regional and Regional National Committees.
The Government of the Czechoslovak Republic hereby orders the President of the Republic, pursuant to Article 3 of the Constitutional Decree of 4 December 1944, No 18 of the OJ (Annex to Decree No. 43 / 1945 Coll.), on National Committees and Provisional National Assembly.
General provisions.
(1) As long as it is not possible to hold elections to the national committees of the counties of the counties of the counties of the counties of the Czech Republic and the Moravian-Silesian and the county national committees of the counties of the Czech and Moravian-Silesian countries, in which the vast majority of the population is not publicly unreliable, according to other provisions of this Regulation.
(2) The elections to the Regional National Committees in Slovakia are governed by the regulations issued by the Slovak National Council.
A choice.
(1) Elections to the District National Committees will be conducted by the electorate at the Regional Assembly, elected pursuant to Article 2 of the Government Decree of 25 August 1945, No 48 Coll., on the election of the Provisional National Assembly. Choice

the District National Committee.
(2) Election to the Regional National Committees will be carried out by delegates at the Regional Departures, elected pursuant to § 3 of Decree No. 48 / 1945 Coll. Choice

the Regional National Committee.
(3) Of the 80 members of the Moravian-Silesian National Committee, 20 members belong to the exposition of this Committee in Moravian Ostrava. The members of the exposition are chosen by delegates, elected in the perimeter of the exposition.
(4) An alternate shall be elected for each member of the national committee. The provisions of this Regulation on members of national committees shall also apply to their alternates.
(5) The election is governed by the district, following the case of the Regional Election Commission, set up pursuant to § 3, § 3 and § 5, § 2, paragraph 2, paragraph 48 / 1945 Coll.
Candidate papers.
(1) Only political parties which, on the date of application of this Regulation, are publicly active in the territory of the Czechoslovak Republic may submit candidate lists for election to the Regional and Regional National Committees. In a reasonable number, the candidate lists shall also include the persons proposed by the single interest unions, organised outside the political parties, and other relevant elements of public life.
(2) Details, in particular the terms of the candidate documents, the time and place of the submission, their presentation and the delivery to the electorate, after the delegates, are laid down by the Minister of the Interior by a decree in the Official Journal.
Optional.
(1) Members of the Regional and Regional National Committees may be elected to the upstanding, national, state and democratically reliable national citizens of the Czechoslovak Republic, Czech, Slovak or other Slavic nationality, regardless of gender, who have reached 18 years of age on the day of the election and who are resident in the relevant political district, if they are elected to the Regional National Committee, or if they are elected to the Regional National Committee.
(2) Persons active in the military service and members of the National Security Corps may also be elected.
Choice of acclamation.
(1) If all political parties represented in the Electoral Board have agreed, following the case of the Delegation College,
(a) the lodging of a common list of candidates; or
(b) that all existing members of the National Committee are to remain in their duties, the choice of aclamations shall take place.
(2) The Common Candidate List may also be submitted if the national committee chosen by acclamation in its current composition is to be supplemented to the number of members prescribed.
(3) The Agreement of the Parties referred to in paragraph 1 shall be declared by the political party agents (Article 3) at the relevant assembly of voters or delegates.
Vote.
If, pursuant to § 5, no acclamation is chosen, the election shall be by voting, for which the provisions of § 45 to 48 of the Act of 14 April 1920, No 330 Coll., on the elections of the Regional and Regional Councils, as amended by the Law of 14 July 1927, No 126 Coll.
Choice report.
The Election Commission (§ 2 (5)) shall write on the choice of registration in the necessary number of copies, one of which shall be deposited with the competent national committee and the other sent to the Ministry of Interior. A further copy of the register of election of the District National Committee shall be submitted to the superior Regional National Committee.
Announcement of election results.
The result of the election shall be announced by the President of the relevant Election Commission (§ 2 (5)) in a manner that is normal in the county and shall be immediately notified by the superior Regional National Committee as regards the Ministry of Interior.
Corrective procedure.
(1) Complaints for elections to regional national committees may be lodged by the electorate called upon to make the election, within three days of the announcement of the result of the election. They shall be definitively decided by the Regional National Committee.
(2) Complaints for elections to the Regional National Committees may be lodged with the relevant Regional National Committee by delegates who have been called to hold elections within three days of the announcement of the result of the election. They shall be decided definitively by the Ministry of the Interior.
Authentication.
The Regional National Committee shall examine definitively whether non-electable persons have been elected as members of the Regional National Committee. For members of the Regional National Committee, this examination shall be carried out by the Ministry of Interior. The nullity of the choice of non-optional persons shall be declared by a public decree.
A directive.
The Home Secretary shall lay down the details of the electoral procedure by means of directives.
Final provision.
This Regulation shall enter into force on the day of its publication; they shall be carried out by the Minister for the Interior.
