DECLARATION
of 16 October 2006
determining the types of duplicating machines, the types of unrecorded record carriers and the amount of standard remuneration
The Ministry of Culture provides pursuant to § 25 (7) of Act No. 121 / 2000 Coll., on Copyright Law, on Rights Related to Copyright Law and on the Amendment of Certain Laws (Copyright Act), as amended by Act No. 216 / 2006 Coll.:
Apparatus for making printing copies and flat-rate remuneration
(1) The remuneration of printing works with ink printing technology, allowing the production of a printing copy other than a printing material, shall be:
| a) | do 2 000 Kč | 45 Kč, |
| b) | nad 2 000 Kč do 6 000 Kč | 120 Kč, |
| c) | nad 6 000 Kč do 10 000 Kč | 240 Kč, |
| d) | nad 10 000 Kč do 20 000 Kč | 450 Kč, |
| e) | nad 20 000 Kč | 900 Kč. |
(2) The remuneration from a printing works with a printing technology other than ink, allowing the production of a printing copy of a non-printing material, shall be for apparatus with an average price excluding value added tax
| a) | do 5 000 Kč | 120 Kč, |
| b) | nad 5 000 Kč do 10 000 Kč | 225 Kč, |
| c) | nad 10 000 Kč do 20 000 Kč | 450 Kč, |
| d) | nad 20 000 Kč do 40 000 Kč | 900 Kč, |
| e) | nad 40 000 Kč do 70 000 Kč | 1 650 Kč, |
| f) | nad 70 000 Kč do 100 000 Kč | 2 560 Kč, |
| g) | nad 100 000 Kč do 150 000 Kč | 3 570 Kč, |
| h) | nad 150 000 Kč do 200 000 Kč | 5 250 Kč, |
| i) | nad 200 000 Kč | 6 750 Kč. |
Remuneration from the copying apparatus, which does not allow the production of a copy other than a printing material, shall be:
| a) | do 2 500 Kč | 120 Kč, |
| b) | nad 2 500 Kč do 5 000 Kč | 240 Kč, |
| c) | nad 5 000 Kč do 10 000 Kč | 450 Kč, |
| d) | nad 10 000 Kč do 20 000 Kč | 900 Kč, |
| e) | nad 20 000 Kč do 40 000 Kč | 1 800 Kč, |
| f) | nad 40 000 Kč do 70 000 Kč | 3 300 Kč, |
| g) | nad 70 000 Kč do 100 000 Kč | 5 100 Kč, |
| h) | nad 100 000 Kč do 150 000 Kč | 7 500 Kč, |
| i) | nad 150 000 Kč do 200 000 Kč | 10 500 Kč, |
| j) | nad 200 000 Kč | 13 500 Kč. |
A multi-function apparatus which allows printing copies to be made in both ways referred to in Sections 1 and 2 shall be charged in the same way as the apparatus referred to in Section 2.
Unrecorded record carriers and flat-rate remuneration
(1) The remuneration of an unrecorded analogue audio recording medium shall be:

(2) Remuneration from an unrecorded analogue medium of sound image recording is to be made on the medium

| b) | s délkou záznamu nad 180 minut | 4 Kč. |
(1) Remuneration from unrecorded optical media
| a) | CD všech formátů bez možnosti přepisování | 0,40 Kč, |
| b) | CD všech formátů s možností přepisování | 2 Kč, |
| c) | DVD všech formátů bez možnosti přepisování a ostatních nepřepisovatelných optických nosičů | 1 Kč, |
| d) | DVD všech formátů s možností přepisování a ostatních přepisovatelných optických nosičů | 5 Kč, |
| e) | minidisku | 4 Kč. |
(2) From the non-built storage medium and from the storage medium incorporated or incorporated into the apparatus, if this medium is not charged for charging the instrument according to § 6, a reward of CZK 1.50 is paid for each 1 GB of capacity started, but not more than CZK 90.
(3) The hard disk not built into a personal computer pays a reward of CZK 0.15 for each 1 GB of capacity started, unless the hard disk capacity does not exceed 1 TB. If the capacity of a hard disk is not built into a personal computer of 1 TB, the reward is 150 CZK and 0.10 CZK for every 1 GB of capacity started exceeding the capacity of 1 TB of this hard disk.
Reception apparatus
(1) The instruments for making copies of the records are:
(a) analogue apparatus for making copies on magnetic tape;
(b) data entry devices for optical media and memory cards not built into a personal computer;
(c) data entry devices for optical media and memory cards built into a personal computer;
(d) data entry devices for optical media and memory cards incorporated into a personal computer, unless they have already been charged in accordance with (c);
(e) reproductions for a built-in hard disk, memory card or optical carrier;
(f) hard drives built into a personal computer;
(g) hard drives incorporated into a personal computer, unless they have already been charged under (f);
(h) radio and television receivers which enable the recording of broadcasts to be made.
(2) Paragraph 1 does not apply to digital cameras, digital cameras, mobile phones and wireless telephones. If these devices are supplied with a storage medium, the remuneration is paid only from the capacity of the accompanying medium according to § 5 (2).
All rates of remuneration in this decree are listed without value added tax.
Efficacy
This decree shall take effect on the day of its publication.
