DECLARATION
of 20 December 2012
amending Decree No. 197 / 1996 of the Ministry of Justice Coll., which issues the examination rules for the bar examinations and recognition examinations (the bar examination rules), as amended
According to § 52 (1) of Act No. 85 / 1996 Coll., on Advocacy, as amended by Act No. 228 / 2002 Coll.:
Decree No. 197 / 1996 Coll., which issues the Rules of Procedure for Law and Recognition Examinations (Law and Law), as amended by Decree No. 245 / 1999 Coll. and Decree No. 267 / 2003 Coll., is amended as follows:

(1) A candidate who has not passed the test but has been assessed in four fields with the least beneficial degree "benefit," will perform a repeat test in accordance with Paragraph 7 (3) of the Act only in the field in which he was evaluated in the previous test with the benefit degree "benefit degree." However, the second repeated test shall take place from all disciplines.
(2) A candidate who has not passed the examination, having been assessed in two or more fields by means of a "non-profit-making" degree, will perform a repeat test in accordance with Section 7 (3) of the Act from all fields. "
2. the following Part Four is inserted after Part Three, including the title and footnote 7:
MEDIATOR TEST AND FAMILY MEDIATION TEST
The provisions of the order on the examination and remuneration of the mediator7) shall apply mutatis mutandis to the mediator's examination and examination of family mediation provided by the Chamber under Section 49a of the Act.

The fourth part is renumbered fifth.
Transitional provision
The examination of the candidate who has submitted a written request to enable the examination to be carried out before the date of entry into force of this Order shall be completed in accordance with the existing legislation.
Efficacy
This Decree shall take effect on 1 January 2013.
