DECLARATION
of 7 September 2004
on the personality which is a prerequisite for the performance of the service in the Security Corps
In agreement with the Ministry of Finance, the Ministry of Justice, the Security Information Service and the Office for Foreign Relations and Information, the Ministry of Interior provides, pursuant to § 15 (7) and § 79 (7) of Act No. 361 / 2003 Coll., on the service relationship of members of the Security Corps:
Personal characteristics that are a prerequisite for the performance of the service in the Security Corps
The personality characteristics which are a prerequisite for the performance of the service in the Security Corps shall be met by a citizen or a member where:
(a) intellectually in the diameter band or higher;
(b) emotionally stable,
(c) psychologically mature,
(d) resistant to psychological stress;
(e) with desirable motivation, attitudes and values;
(f) without inadequacy in the field of free processes;
(g) there is no shortage of cognitive processes;
(h) without insufficient self-regulation;
(i) without signs of unwanted aggression; and
(j) without psychopathology.
Reasons for the determination of personality
The reason for the determination of personality is
(a) recruitment;
(b) the provisions of a member of the post in the Security Corps for which this survey is provided for as another specific requirement;
(c) the conduct of a member on the basis of which it may be considered that the member is personally unfit to serve in a Security Corps;
(d) the conduct of a member on the basis of which it may be considered that the member is physically unfit to serve at a post within the Security Corps for which another specific requirement of personality is provided; or
(e) the provisions of a member of another Security Corps for a vacant post.
Personal fitness procedure
(1) The psychologist of the Security Corps (hereinafter referred to as "psychologist") shall establish the personality of a citizen or a national (hereinafter referred to as "person under consideration") upon written request (hereinafter referred to as "request").
(2) An official shall apply for the identification of a person's capacity. The provider of occupational medical services may initiate a service official to apply for the reason set out in § 2 (c) or (d). For the same reason, a member may request the identification of his or her personality.
(3) The application shall state the name (s), surname and date of birth of the person under consideration, the reason for which the assessment of personality is required and the indication of which of the psychological workplace of the Security Corps previously established the personality of the person under assessment. An application submitted on the grounds referred to in Article 2 (c) or (d) shall be accompanied by a service evaluation, an interim annual evaluation, an official record, or other material proving to justify its submission.
(1) The Staff Officer shall inform the person under consideration of the date and place of identification of his or her personality. In the case of a determination of personality on the grounds referred to in § 2 (c) or (d), the official shall forward a copy of the request for a determination of personality to the person concerned, together with a communication of the date and location of the examination of his or her personality.
(2) If, for serious reasons, the person concerned is unable to participate in the assessment of his / her personality, he / she shall set a deadline for his / her completion.
(3) The psychological workplace of the Security Corps, which previously identified the personality of the person under consideration, shall, with the written consent of that person, provide its documentation to another psychologist of the Security Corps if requested.
(4) Psychologist uses a method of observation, interview, anamnestic examination, analysis of objective data and psychological test methods when determining personality competence.
(5) If, in the context of the determination of personality for the reasons set out in Section 2 (d), there is a doubt that the person under assessment is unfit to serve in the Security Corps, the psychologist shall inform the staff member accordingly.
(6) The psychologist will fully evaluate the results of the assessment of personality and process 3 copies of the conclusion in paper form.
(7) The psychologist shall provide one copy of the conclusion to the person under consideration, one copy of the conclusion to the service official, leaving one copy of the conclusion in the written documentation of the psychological workplace to the person under consideration. In the case of the determination of personality for the reason referred to in § 2 (c) or (d), the person concerned shall have the right to familiarise himself with the content of the documentation acquired in connection with the determination of his or her personality and to discuss with the psychologist the content of that dossier.
Findings of the psychological conclusion
(1) The psychological conclusion shall always include at least the following elements:
(a) the name (s), surname, academic title and date of birth of the person under consideration;
(b) a statement as to whether or not the person under assessment is competent for the exercise of his or her duties in the Security Corps or in a place of service within the Security Corps for which another specific requirement of personality is laid down;
(c) the name and stamp of the psychological workplace;
(d) the title, the name (s) and surname of the psychologist who sought personality and his own signature;
(e) the date of completion;
(f) guidance on the possibility of making a proposal for a review of the conclusion to the head of the psychological centre of the Security Corps (the head psychologist).
(2) In addition to the particulars referred to in paragraph 1, the conclusion of a psychologist in the case of the determination of personality for the reason set out in § 2 (c) or (d) also includes:
(a) the methods referred to in Article 4 (4) used in the determination of personality,
(b) the personality characteristics referred to in Article 1 which the person concerned has not complied with; and
(c) the justification for the outcome of the assessment of personality.
Review procedure
(1) The lead psychologist shall, on the basis of a proposal from the authorised person, examine the conclusion of a psychologist who has ascertained his or her personality or designated a psychologist of the Security Corps who has not identified a personality in the case under consideration. The assessment shall be carried out without undue delay and the lead psychologist shall inform the person under consideration no later than 30 days after the receipt of the proposal.
(2) The examination procedure shall assess the methods used in determining personality and the accuracy of their evaluation. In order to assess the accuracy of a psychologist's conclusion, the lead psychologist may invite and, in the event of a determination of personality for the reason set out in § 2 (c) or (d), invite other psychologists of the security corps. At least one of the psychologists invited in accordance with the sentence of the other shall not be a psychologist of the Security Corps of which the person under consideration is a national; This does not apply to review procedures carried out by a lead intelligence psychologist. A psychologist invited under the second sentence may not be a psychologist who, in the case at hand, has ascertained his / her personality.
(3) The Head of the psychologist, the commission established by him or his designated psychologist of the Security Corps shall re-establish the personality of the person under consideration, if necessary for the assessment of the conclusion. The staff member shall inform the person under consideration of the date and place of the reassessment of his / her capacity.
(4) The lead psychologist shall draw a conclusion on the outcome of the review confirming or amending the psychological conclusion. The lead psychologist's conclusion is published in paper form in three copies. Paragraph 5 shall apply mutatis mutandis to the particulars of the lead psychologist's conclusion.
(5) The head psychologist shall provide one copy of the conclusion to the person under consideration, one copy of the conclusion to the service officer, leaving one copy of the conclusion in the written documentation of the psychological workplace to the person under consideration. In the case of a determination of personality on the grounds referred to in § 2 (c) or (d), the person concerned shall have the right to acquaint himself with the content of the documentation acquired in connection with the assessment of his / her personality in the review procedure and to discuss with the head psychologist the content of that dossier.
Efficacy
This decree takes effect on the date of the entry into force of Act No. 361 / 2003 Coll., on the service ratio of members of the Security Corps.
