DECLARATION
of 20 December 2012
amending Decree No. 244 / 1996 of the Ministry of Justice Coll., which, pursuant to Act No. 85 / 1996 Coll., on the Advocacy, provides for a disciplinary order, as amended
According to § 51 paragraph 1 of Act No. 85 / 1996 Coll., the Ministry of Justice provides:
Decree No. 244 / 1996 Coll., which, pursuant to Act No. 85 / 1996 Coll., on the Advocacy, provides for a disciplinary order (Law Order), as amended by Decree No. 246 / 1999 Coll. and Decree No. 265 / 2009 Coll., is amended as follows:
1. In Article 11 (1), the words "; this shall not apply in the event of an exclusion pursuant to § 7b (1) (g), § 8 (1) (d) and § 37 (4) (b) of the Act 'shall be added at the end of the text of point (d).
2. In Article 11, the dot is replaced by a semicolon at the end of paragraph 1 and the following point (g) is added:
"(g) after expiry of the period laid down in Article 12 (1) (a) and (b)."
3. Paragraph 12 (1) and (2) reads as follows:
"(1) The Board of Appeal shall suspend the disciplinary proceedings,
(a) if the accused has been removed from the list of lawyers referred to in Article 7b (1) (g) or Article 8 (1) (d) of the law, but for a maximum period of five years, or
(b) if the accused person has been removed from the list of lawyers under Section 37 (4) (b) of the Act, for a maximum period of three years.
(2) The Board of Appeal may suspend disciplinary action if the action which is the subject of a disciplinary action has been brought against the accused person before another body, pending a final decision by that body. "
Transitional provision
The disciplinary proceedings which were not definitively completed at the date of entry into force of this Order shall be completed in accordance with Decree No. 244 / 1996 Coll., as effective from the date of entry into force of this Order.
Efficacy
This Decree shall take effect on 1 January 2013.
