GOVERNMENT REGULATION
of 18 October 2006
on the amount of time fees, toll rates, toll discounts and procedure for applying the toll discount
The Government orders pursuant to § 46 paragraph 1 of Act No. 13 / 1997 Coll., on Road, as amended by Act No. 102 / 2000 Coll. and Act No. 80 / 2006 Coll.:
Subject matter
This Regulation (1) implements the relevant European Union2 regulations and regulates the amount of the time charge and toll rates for road motor vehicles for the use of selected sections of the road, the amount of the toll rebate and the procedure for its application.
Amount of the time fee
The time charge for the vehicle in the time charging system shall be:
| a) na kalendářní rok | 1 500 Kč, |
| b) na 1 měsíc | 440Kč, |
| c) na 10 dnů | 310Kč. |
Amount of toll rates for use of motorways and express roads
(1) Toll rates are broken down by:
(a) vehicle emission classes (3) to vehicle tariffs
1. to EURO II class,
2. EURO III and IV classes,
Class 3 EURO V and above,
(b) the number of axles of the vehicle or combination for the rates for vehicles;
1. two axles,
2. Three axles,
3. Four or more axles.
(2) The breakdown of tolls referred to in paragraph 1 (b) does not apply to vehicles of categories M2 and M34).
(3) Toll rates for motorways and express roads are set out in Annex 1 to this Regulation of the Government, with the exception of toll rates for vehicles of categories M2 and M34), which are listed in Annex 3 to this Regulation of the Government.
Amount of toll rates for the use of first-class roads
(1) Toll rates are broken down by:
(a) vehicle emission classes (3) to vehicle tariffs
1. to EURO II class,
2. EURO III and IV classes,
Class 3 EURO V and above,
(b) the number of axles of the vehicle or combination for the rates for vehicles;
1. two axles,
2. Three axles,
3. Four or more axles.
(2) The breakdown of tolls referred to in paragraph 1 (b) does not apply to vehicles of categories M2 and M34).
(3) Toll rates for first-class roads are set out in Annex 2 to this Regulation of the Government, with the exception of toll rates for vehicles of categories M2 and M34) which are listed in Annex 3 to this Regulation of the Government.
Discount on toll
(1) The time period applicable to the calculation of the discount on the total toll levied during that period is fixed at the calendar year.
(2) Where the total amount of stored tolls detected by the electronic toll system during the time period referred to in paragraph 1 for a vehicle in an electronic toll system has reached at least:
a) 100 000 CZK, 5% discount is granted,
b) 150 000 CZK, a discount of 8% is provided,
c) CZK 250,000, a discount of 11% is granted, or
d) 400 000 CZK, 13% discount is provided.
(3) The amount of tolls imposed pursuant to paragraph 2 shall not include tolls imposed prior to the date on which the data and vehicle documents are supplied in accordance with Paragraph 4b (2).
Procedure for applying the toll discount
(1) The vehicle operator shall provide the electronic toll system operator with the data and vehicle documents in the electronic toll system necessary for the calculation of the toll discount for the calendar year for which the discount is to be granted for the first time and shall notify the vehicle operator without undue delay of any changes to those data or documents.
(2) The data and documents relating to the vehicle in the electronic toll system are:
(a) data relating to the vehicle operator:
1. the name and, where applicable, the names and surnames, the address of the place of permanent or similar residence and the contact details for electronic service, in the case of a natural person,
2. the trading firm or the name or, where applicable, the name and surname, or, where applicable, the distinguishing addendum, the address of the place of permanent or similar residence, the address of the place of business, the identification number of the person, if assigned, and the contact details for electronic service, in the case of the person involved; or
3. the business firm or name, the address of the registered office, the identification number of the person, if any, and the contact details for electronic service, in the case of a legal person;
(b) the registration number of the vehicle, including an indication of the State in whose vehicle register or equivalent registration the vehicle is registered;
(c) a copy of the technical document indicating the category of vehicle, the maximum authorised mass and the emission class of the vehicle; and
(d) power of attorney when the vehicle operator is represented by a third party.
(3) Electronic toll system operator no later than 6 months after the end of each calendar year
(a) verify that, in the case of a vehicle in an electronic toll system for which the information referred to in paragraph 1 has been provided, a discount has been claimed in accordance with § 4a (2);
(b) calculate the amount of the toll rebate for each vehicle; and
(c) invite the vehicle operator who has been entitled to a toll discount to provide details of the bank account for which an amount corresponding to the amount of the toll discount can be sent.
(4) The electronic toll system operator shall send an amount corresponding to the amount of the toll discount, rounded down to the whole crown, to the account referred to in paragraph 3 (b). (c) within 4 months of receipt of the bank account data.
Repeal
Government Regulation No 527 / 2004 Coll., setting the amount of the fee for the use of motorways and express roads by road motor vehicles, is hereby repealed.
Efficacy
This Regulation shall enter into force on 1 January 2007, with the exception of Article 4, which shall take effect on 1 July 2007.

1) This Regulation shall be issued on the basis and within the limits of the law, the content of which allows the relevant provisions of the European Union to be incorporated by the Government.
2) Directive 1999 / 62 / EC of the European Parliament and of the Council of 17 June 1999 on the charging of heavy goods vehicles for the use of certain infrastructures. Directive 2011 / 76 / EU of the European Parliament and of the Council of 27 September 2011 amending Directive 1999 / 62 / EC on the charging of heavy goods vehicles for the use of certain infrastructures.
3) Directive 1999 / 96 / EC of the European Parliament and of the Council on the approximation of the laws of the Member States relating to measures to be taken against the emission of gaseous and particulate pollutants from diesel engines of vehicles and the emission of gaseous pollutants from positive-ignition engines of vehicles fuelled with natural gas or liquefied petroleum gas and amending Council Directive 88 / 77 / EEC, as amended.
4) Annex 18 to Decree No 341 / 2002 Coll., on the approval of technical competence and on technical conditions for the operation of vehicles on the road, as amended.
