THE LAW
of 5 August 2004
amending Act No. 143 / 2001 Coll., on the Protection of Competition and amending certain laws (Law on the Protection of Competition), as amended by Act No. 340 / 2004 Coll., Act No. 513 / 1991 Coll., Commercial Code, as amended, and Act No. 526 / 1990 Coll., on Prices, as amended
Parliament has decided on this law of the Czech Republic:
Amendment of Act No. 143 / 2001 Coll., on the Protection of Competition and on the Amendment of Certain Acts (Law on the Protection of Competition)
Act No. 143 / 2001 Coll., on the Protection of Competition and on the amendment of certain laws (Law on the Protection of Competition), as amended by Act No. 340 / 2004 Coll., is amended as follows:
1. the following paragraph 8 is added to Article 1, including footnote (3a):
"(8) Furthermore, that law shall not apply to the conduct of competitors in the field of the production and trade of agricultural products, insofar as they act in accordance with European Community law. 3a)
(3a) Regulation No 26 on the application of certain rules on competition to the production of and trade in agricultural products. "
2. In Article 6 (1), at the end of point (b), the dot is replaced by a comma and the following point (c) is added:
"(c) sales organisations and associations of agricultural producers' agreements on the sale of unprocessed agricultural commodities. 3a) '.
3. In Paragraph 11 (1), at the end of the dot, point (g) is replaced by the following:
"(g) direct or indirect demand for cash or non-cash benefits for entering into the register of a competitor in the capacity of a customer for placing goods at the premises of a competitor in the capacity of a customer, or direct or indirect demand for special discounts and financial advantages in connection with the opening of an establishment or the organisation of various sales events by a competitor in the capacity of a customer."
Amendment to Act No. 526 / 1990 Coll., on Prices, as amended
In Section 14 of Act No. 526 / 1990 Coll., on Prices, the following paragraph 3 is added:
"(3) By 31 January of the following year, the Government shall submit to the Chamber of Deputies a report on the price control provided for in this Act, containing in particular an overview of the measures taken by the price control authorities to avoid any breach of the provisions of this Act. '
EFFECTIVE
This Act shall take effect on the day of its publication.
