DECLARATION
of 21 December 2009
amending Decree No. 527 / 2006 Coll., on the use of toll roads and amending Decree No. 104 / 1997 Coll., implementing the Road Act, as amended
The Ministry of Transport provides pursuant to Article 46 (2) of Act No. 13 / 1997 Coll., on Road, as amended by Act No. 102 / 2000 Coll., Act No. 132 / 2000 Coll., Act No. 489 / 2001 Coll., Act No. 256 / 2002 Coll., Act No. 259 / 2002 Coll., Act No. 320 / 2002 Coll., Act No. 358 / 2003 Coll., Act No. 186 / 2004 Coll., Act No. 80 / 2006 Coll., Act No. 186 / 2006 Coll., Act No. 311 / 2006 Coll., Act No. 342 / 2006 Coll., Act No. 97 / 2009 Coll., Act No. 227 / 2009 Coll., and Act No. 347 / 2009 Coll. (hereinafter "Act '):
Decree No. 527 / 2006 Coll., on the use of toll roads and amending Decree No. 104 / 1997 Coll., implementing the Road Act, as amended, as amended, as amended, Decree No. 323 / 2007 Coll. and Decree No. 14 / 2009 Coll., is amended as follows:
1. In Article 1 (b) (7), the dot is replaced by a comma and the following point 8 is added:
"8th structure, description and method of calculation of costs and method of setting toll rates. ';
2. Paragraph 3 (1) and (2) reads as follows:
"(1) Coupons proving payment of the time fee differ according to their duration. The coupon models are set out in Annex 1 to this Decree.
(2) The first part of the coupon to be placed in the vehicle shall be in the shape of a square with rounded corners and, for a coupon valid for one year, with rounded right upper corner of the front and the left upper corner of the back of the printing area; the distance of opposite sides is 61 mm. ';
3. In Article 4 (1) (c), "seven days' is replaced by" ten days'.
4. in Paragraph 4 (1) (e), "seven" is replaced by "ten."
5. In Article 4 (1) (j), the words "demetalized transverse lane 'are replaced by the words" demetalized transverse double line', the words "seven-day 'are replaced by the words" 10-day' and the words "demetalised lane 'are replaced by the words" demetalised double lines'.
6. In Article 4 (3) (c), "seven days' is replaced by" ten days'.
7. in Article 4 (3) (i), the words "demetalized transverse lane" shall be replaced by the words "demetalized transverse double line," the words "seven days" shall be replaced by the words "ten days" and the words "demetalised lane" shall be replaced by the words "demetalised double lines."
8. Paragraph 4 (5) reads as follows:
"(5) They are used as basic background colours for coupons valid for:
one year of colour blue and pink,
one month of grey and pink colour,
10 days of colour green and pink. '

Area solution of the first part of coupon
(1) The pictogram of the vehicle symbolizing the mass category of the vehicle is located on the front of the coupon at the bottom right and on the back of the coupon at the bottom of the coupon. The pictogram is 3 mm high and 8,5 mm wide.
(2) The inscription indicating the maximum authorised mass of the vehicle shall be 2 mm high and shall be placed in the right centre section above the letter indicating the period of validity.
(3) The number indicating the year of validity shall be placed on the front of the coupon in the upper half below the registration plate and on the rear half of the coupon. The digits are 13 mm high.
(4) The letter indicating the period of validity shall be placed on the front of the coupon under the indication of the mass of the vehicle at the lower right and on the rear of the coupon at the lower left. The letter is 16 mm high.
(5) The symbols of the road signs "motorway" and "express roads" are placed on both the front and rear sides of the coupon at the top right of the coupon. Both symbols are 5.5 mm high and 4.5 mm wide.
(6) The holographic item is located on the front of the coupon in its left lower part and on the back of the coupon in its right lower part. The holographic item is different in shape according to the duration of the coupon.
(7) The box for registration of the registration mark is located at the top of the coupon on the front of the coupon. The frame is 5 mm high and wide across the entire coupon width. The letters RZ are 2 mm high and are placed directly in the frame on the left of the annual coupon and on the right of the monthly and 10-day coupon.
(8) The two-letter series and the six-digit serial number shall be 3 mm high and shall be located on the front of the coupon in the right-hand section above the mass of the vehicle. The series is placed to the left of a six-digit serial number showing red fluorescence in UV radiation.
(9) The 13-digit code of the dark blue colour is printed on the paper mat under the lower edge of the coupon. "

Area solution of second part coupon
(1) All the elements are located on the front side of the coupon, outside the element according to paragraph 8.
(2) The vehicle pictogram symbolizing the relevant vehicle mass category is placed at the bottom of the letter indicating the period of validity. The pictogram is 3 mm high and 8,5 mm wide.
(3) The inscription indicating the maximum permissible mass of the vehicle is 2 mm high and is placed at the lower edge of the coupon under the symbols of the road signs.
(4) The number indicating the year of validity shall be placed at the top of the coupon above the two-letter series and six-digit serial number. The digits are 10 mm high.
(5) The letter indicating the period of validity is located in the lower right of the coupon to the right of the holographic item and is 10 mm high.
(6) The symbols of the road signs "motorway" and "express roads" are located in the lower part below the holographic element. Both symbols are 5.5 mm high and 4.5 mm wide.
(7) The holographic item is located in the lower left part of the coupon. Its shape is identical and for all types of coupons the holographic item theme is rotated 90 ° from the first part.
(8) The box for registration of the registration mark is 6 mm high and 42 mm wide and is placed on a paper pad on the back of the coupon. The letters RZ are 1.5 mm high to the right of the frame.
(9) The two-letter series and the six-digit number are 3 mm high and are located in the middle of the coupon above the holographic item. The series is placed to the left of a six-digit serial number showing red fluorescence in UV radiation.
(10) The inscription "BUDGET PROFITTING THE PAYMENT FOR THE USE OF ALUMINIUM AND FISHING SILENCE (2nd PART)" is placed at the top of the coupon. The inscription is divided into five lines and the height of the letters in the inscription is 2 mm. '
11. in Article 6 (10), "2" is replaced by "1,5."
12. in Article 7 (3), 'seven' is replaced by 'ten';
13. In Part One, Title III, the following Part 4 is inserted after Part 3, including the title and footnotes No 4 and No 5:
Structure, description and method of calculation of costs and method of setting toll rates
(Paragraph 22 (7) of the Law)
Description of costs attributable to the calculation of tolls
(1) The costs of building toll roads include all costs directly related to their construction, which are:
(a) the price of buildings and land;
(b) the cost of financing the construction of toll roads;
(c) the cost of processing project and zoning documentation;
(d) costs of archaeological, geological and other similar surveys;
(e) depreciation under other legislation4).
(2) The costs of maintaining and repairing toll roads include all the costs of normal and continuous maintenance and repairs which constitute:
(a) road and road maintenance costs, including winter maintenance;
(b) maintenance costs for road signs, transport equipment and other accessories;
(c) the costs of treating road vegetation.
(3) The management costs related to the operation of toll roads include other costs not mentioned in paragraphs 1 and 2 which are directly related to the operation of toll roads and which are not related to the construction and operation of the electronic toll system. These costs include payments resulting from concession contracts.
(4) The costs of building and operating an electronic toll system include:
(a) costs for the construction, establishment and maintenance of toll collection sites;
(b) costs related to the operation, administration, collection and recovery of tolls;
(c) depreciation under other legislation4).
(5) The costs of building the toll roads referred to in paragraph 1 shall include:
(a) the costs of building infrastructure completed after 10 June 1978, until the date of entry into force of this Decree, which shall be determined by a ratio corresponding to the share of the expected lifetime of the toll infrastructure remaining after 10 June 2008 in the total estimated lifetime of the charged infrastructure;
(b) the costs incurred and foreseen for the construction of the infrastructure which are under construction at the date of entry into force of this Decree;
(c) the estimated costs of construction of the planned infrastructure, which are recorded in the planning documentation; These costs shall be distributed according to the planned service life of the infrastructure, but for at least 20 years.
Method of calculating the cost of toll infrastructure
The costs of the toll infrastructure shall be determined by the ratio of the sum of the costs referred to in Section 23a relating to the actual or anticipated performance of vehicles in the electronic toll system. For the calculation of costs only for a certain part of the road, only the corresponding part of the costs related to the actual or anticipated operational performance of vehicles in the electronic toll system shall be used. The cost of the calendar year shall be used for the calculation.
Method for setting toll rates
The calculation of toll rates shall be carried out on the actual or anticipated proportion of toll vehicles in kilometres travelled on toll roads. Only the proportion of costs calculated in accordance with § 23a and relating separately to motorways and express roads and to selected first-class roads listed in Annexes 3 and 4 to this Decree may be used for the calculation. That share of costs shall be allocated only to the actual or anticipated share of toll vehicles. The proportion of costs thus determined shall be distributed according to the conditions laid down in another legislation5) and shall always relate to the actual or anticipated performance of vehicles in the electric toll system.
