GOVERNMENT REGULATION
of 7 December 2005
amending Government Regulation No 148 / 2005 Coll., laying down the conditions for granting non-food aid for the non-food use of oilseed rape for the production of rapeseed methyl ester, as amended by Government Regulation No 418 / 2005 Coll.
The Government orders the implementation of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 128 / 2003 Coll., Act No. 41 / 2004 Coll., Act No. 85 / 2004 Coll., Act No. 237 / 2004 Coll., Act No. 482 / 2004 Coll. and Act No. 441 / 2005 Coll.:
Government Decree No 148 / 2005 Coll., laying down the conditions for granting aid for non-food use of oilseed rape for the production of rape oil methyl ester, as amended by Government Decree No 418 / 2005 Coll., is hereby amended as follows:
1. In Paragraph 2 (1), the words "and from 1 January 2006 to 31 December 2006 'shall be inserted after the words" 1 July 2005 to 31 December 2005'.
2. In Article 2 (2) (d), "the calendar year preceding the processing period in which the subsidy is to be granted 'is replaced by" if the subsidy is to be granted for the processing period of 2005 and until 31 December 2005, if the subsidy is to be granted for the processing period of 2006'.
3. In Paragraph 2 (2) (g), the words ", Podporní a garanční rolniční a lesnikých fond, a.s., České consolidation agency" shall be inserted after the words "Land Fund of the Czech Republic."
4. In Article 2 (3) (c), the words "in accordance with paragraph 2 (e) 'shall be inserted after the words" the applicant'.
5. in Article 2 (3) (d), the words "being an entrepreneur as referred to in paragraph 2 (b)" shall be replaced by the words "meeting the conditions laid down in paragraph 2 (a) to (c)";
6. Paragraph 4 (1) reads as follows:
"(1) The Fund shall grant a grant for the processing of seed of oilseed rape for the production of rapeseed methyl ester for the processing period
(a) from 1 July 2005 to 31 December 2005 for a quantity of 50 000 tonnes of rapeseed methyl ester,
(b) from 1 January 2006 to 31 December 2006 for a quantity of 125 000 tonnes of rapeseed methyl ester. "
7. In § 5, the words "for the processing period 2005 and 6 570 CZK for the processing period 2006" shall be inserted after the words "3 680 CZK."
8. In Article 6, at the end of the text of paragraph 2, the words "if it is for the 2005 processing period and within 60 calendar days of the end of the 2006 processing period 'shall be added.
9. In Article 6 (3), the words "which have been processed into mixed fuel 'shall be inserted after the words" sales of rapeseed methyl ester'.
10. in Article 7 (2), "2005" is replaced by "2006";
Transitional provision
The procedure for granting the subsidy for the period from 1 July 2005 to 31 December 2005, initiated on the basis of existing legislation and not final at 31 December 2005, shall be completed in accordance with existing legislation.
Efficacy
This Regulation shall enter into force on 15 December 2005.
