GOVERNMENT REGULATION
of 30 October 2002
amending Government Regulation No. 426 / 2000 Coll., laying down technical requirements for radio and telecommunications terminal equipment
The Government orders pursuant to Section 22 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts, as amended by Act No. 102 / 2001 Coll. and Act No. 205 / 2002 Coll., ("the Act ') to implement Sections 12 and 13 of the Act:
Čl. I
Government Decree No. 426 / 2000 Coll., laying down technical requirements for radio and telecommunications terminal equipment, is amended as follows:
1. In Article 1, at the end of paragraph 2, the dot is replaced by a comma and the following point (c) is added:
"(c) class of equipment class identifying the types of instruments and equipment and interfaces for which the apparatus or equipment is intended. The classes of equipment are defined by the Czech Telecommunications Authority (hereinafter referred to as" the Office ") with measures. (8) Instruments and equipment may be included simultaneously or gradually in more than one class of equipment."
2. In Paragraph 2 (4), the introductory part of the provision reads: "Instruments and equipment in certain classes or instruments and equipment of certain types shall be published by the Office in the Telecommunications Bulletin by means of a communication which shall comply with the relevant international contract, 8) and such instruments and equipment shall be so designed as to '.
footnote 8 is replaced by the following:
"(8) The Europe Agreement establishing an Association between the Czech Republic, of the one part, and the European Communities and their Member States, of the other part, published under No 7 / 1995 Coll."
3. in Article 2 (4) (a), the words "and in the territory of a Member State of the European Union" shall be inserted after the words "the Czech Republic."
4. In the first sentence of Article 3 (6), the words "frequencies or" and "contrary to the frequency allocation plan and frequency bands' are deleted; after the words" frequency bands', the words "the use of which is not 'and the words" the Czech Republic' shall be inserted after the words "the Authority has set out in the General Licence, 10a) '.
Footnote 10a) reads as follows:
"10a) § 46 et seq. of Act No. 151 / 2000 Coll., on Telecommunications and on the amendment of other laws. '.
5. The following paragraph 8 is added to Article 3, including footnote 10b:
"(8) If instruments and equipment comply with the requirements of this Regulation and are covered by the relevant international agreement, 10b) the following procedure shall apply instead of the procedure referred to in paragraph 4. The manufacturer, his authorised representative or the person responsible for placing the apparatus and equipment on the market shall place the CE17 marking on the apparatus or equipment) and shall attach to each product a certificate of conformity indicating compliance with the essential requirements laid down in this Regulation for the type of product specified. The manufacturer shall use the type number, serial number or serial number and the name or surname of the manufacturer or the person responsible for placing the apparatus on the market to identify the apparatus or equipment. Where the procedures laid down in Annex 3, Annex 4 or Annex 5 are applied, this marking shall be accompanied by the identification number of the notified person as set out in Annex 6. In addition, for radio equipment, the identification mark of the device class in Annex 7 shall be provided. Any other marking may be affixed to the device provided that this does not reduce the visibility and legibility of the CE marking. No apparatus or apparatus, whether or not it meets the relevant essential requirements, shall bear any other marking which may mislead third parties as regards the meaning or graphic presentation of the CE marking as set out in Annex 7.
10b) Protocol to the Europe Agreement on Conformity Assessment and Acceptance of Industrial Products, published under No 56 / 2001 Coll., as amended by the Sectoral Annex 'Telecommunications'. '
6. In Article 5, the following paragraph 4 is added:
"(4) Instruments and equipment which do not comply with the requirements laid down in this Regulation may be made publicly available at trade fairs, exhibitions, demonstrations and similar events only on condition that they are visibly marked with a warning that they cannot be placed on the market and operated before their conformity with the requirements laid down in this Regulation is ensured. ';
7. the following Section 5a is inserted after Section 5, including footnote 11a:
„§ 5a
Where a protective measure has been imposed on instruments and equipment under the special legislation11a) as a result of non-compliance with the requirements of this Regulation, the notification provided for in Article 7 (8) of the Act shall state whether the reason for the imposition of the protective measure was caused by:
(a) incorrect application of harmonised standards;
(b) shortcomings in harmonised standards;
(c) failure to comply with the requirements laid down in Article 2 (3) where instruments and equipment do not comply with harmonised standards.
11a) For example § 7a of Act No. 64 / 1986 Coll., on Czech Trade Inspection, as amended. '
8. In Annex No 2, points 1, 2, 3 and 5, in Annex No 3, point 2, Annex No 4, points 2, 3 and 4, Annex No 5, point 1 and the title of Annex No 7, the words "Article 4 'are replaced by the words" § 3 (8) and § 4'.
9. In Annex 7, point 5, in the first sentence after the word "character ', the words" class of equipment with any additional indication' are inserted, the words "radio equipment 'are inserted after the word" user' and the word "instrument 'is replaced by the words" device'.

This Regulation shall enter into force on the day of its publication.
