on the compensation of certain victims of the repression of demonstrations on the first anniversary of the occupation of Czechoslovakia by the army of the Union of Soviet Socialist Republics, the German Democratic Republic, the Polish People's Republic, the Hungarian People's Republic and the Bulgarian People's Republic
Parliament has decided on this law of the Czech Republic:
Purpose of the law
The purpose of the Act is to compensate the citizens of the Czech Republic who, as citizens of the Czechoslovak Socialist Republic, were killed or injured in connection with the intervention of the armed forces of the Czechoslovak Socialist Republic and the Czech Socialist Republic in the repression of demonstrations which took place on the first anniversary of the invasion of the Union of Soviet Socialist Republics, the German Democratic Republic, the People's Republic of Poland, the People's Republic of Hungary and the People's Republic of Bulgaria ("the demonstration against the invasion ') in the territory of the former Czechoslovakia.
(1) The person entitled under this law is a natural person who was injured between 19 August 1969 and 22 August 1969 in connection with the intervention of Public Security, the National Security Corps, the People's militia or other armed forces of the then Czechoslovak Socialist Republic or the Czech Socialist Republic in the repression of demonstrations against invasion and who was a citizen of the Czechoslovak Socialist Republic or the Czech Socialist Republic at the time of his injury.
(2) Where a person meeting the conditions laid down in paragraph 1 has died, the persons entitled under this law shall become children and the spouse or partner if the marriage, partnership or registered partnership lasted at the time of death of the person referred to in paragraph 1. In the absence of persons authorised under the first sentence, the parents of a person meeting the conditions laid down in paragraph 1 shall become eligible persons; in the absence of parents, the siblings of that person shall become eligible persons.
(3) The persons entitled under this law are children and the husband of a natural person who was killed or injured during the period from 19 August 1969 to 22 August 1969 as a result of death in connection with the intervention of Public Security, the National Security Corps, the People's militia or other armed security forces of the then Czechoslovak Socialist Republic or the Czech Socialist Republic in the repression of demonstrations against invasion and who was a citizen of the Czechoslovak Socialist Republic or the Czech Socialist Republic at the time of death or injury. The spouse is entitled to the first sentence if the marriage to a person killed or injured with a result of death at the time of death or injury persists.
(4) In the absence of persons authorised under paragraph 3, the parents of a person who has been killed or injured as a result of death during the period 19 August 1969 to 22 August 1969 shall become eligible persons under the conditions described in paragraph 3; in the absence of parents, the siblings of that person shall become eligible persons.
(1) Authorised persons are entitled to a lump sum (hereinafter referred to as "entitlement") if they are citizens of the Czech Republic; the condition of citizenship of the Czech Republic is deemed to be fulfilled if the citizenship continues on the date of the application for a lump sum.
(2) The claim must be applied in the form of a written application to the authority responsible for the decision by 31 December 2025 at the latest, otherwise the claim shall cease.
(1) The total entitlement of persons authorised under § 2 (3) and (4) of this Act is CZK 200,000.
(2) The total entitlement of persons authorised under Article 2 (1) and (2) of this Act is:
(a) 90 000 CZK, if the injury left permanent consequences,
b) 40 000 CZK in other cases.
(1) The entitlement shall be exercised by the beneficiary in writing with the Ministry of the Interior.
(2) The claim may be demonstrated by a medical report, death certificate, testimony of at least two witnesses or otherwise.
(3) The provision of a one-off cash amount is decided and paid by the Ministry of the Interior.
(1) Proceedings under this Act shall be initiated on the basis of a proposal from the authorised person. In the event of the entitlement being exercised, if it has not been decided on or if a lump sum has not been paid, it shall, in the event of the death of the beneficiary, pass on to its heir.
(2) This procedure shall apply, save as otherwise provided in this Law, to the administrative rules (1).
(3) The decision of the Ministry of the Interior to grant a lump sum shall not be subject to legal remedies.
(4) An action against a decision by the Ministry of the Interior to grant a lump sum in accordance with the Special Act (2) is the local jurisdiction of the regional court in whose territory the applicant resides or resides.
(1) Proceedings under this Act shall be exempt from administrative charges.
(2) The one-off amount of money granted under this Act is not subject to personal income tax and is not included in income applicable for the purposes of State social support and social welfare benefits.
(3) The costs of a lump sum are borne by the State.
(4) At the request of the Ministry of the Interior, state bodies, legal entities and natural persons are required to provide, free of charge, the documents necessary to demonstrate entitlement and to establish the necessary synergies.
This Act shall take effect on 1 January 2021.
