of 14 November 2002
on strengthening the protection of the airspace of the Czech Republic at the time of the summit of the North Atlantic Treaty Organisation in Prague and amending the Criminal Act
Parliament has decided on this law of the Czech Republic:

ČÁST PRVNÍ

RESIDENCE OF THE UNITED STATES OF AMERICA ON THE TERRITORIES OF THE CZECH REPUBLIC FOR THE PURPOSE OF ENFORCEMENT OF THE PROTECTION OF THE AIR AREA OF THE CZECH REPUBLIC IN THE PERIOD OF THE COMPETITION OF THE SUPERVISORY AUTHORISATION OF THE NORTHERLANTIC TREATY IN PRE
§ 1
This law regulates the legal status and conditions for the residence of the armed forces of the United States of America in the Czech Republic in order to strengthen the protection of the airspace of the Czech Republic at the time of the summit of the North Atlantic Treaty Organisation in Prague.
§ 2
The legal conditions of residence of the armed forces of the United States of America in the territory of the Czech Republic are governed by this Act and other legislation of the Czech Republic 1) and by international treaties which make the Czech Republic vazana.2)
§ 3
(1) The armed forces of the United States of America may, for the period from 15 to 30 November 2002, participate in the provision of the protection of the airspace of the Czech Republic throughout the Czech Republic by means of their own funds earmarked for this purpose and located in and outside the Czech Republic.
(2) The provision of airspace security referred to in paragraph 1 shall include the possibility of using force against air hazards.
(3) The resources of the United States armed forces allocated pursuant to paragraph 1 will be under the constant command of the United States authorities.
(4) The use of force referred to in paragraph 2 shall be possible only at the request or with the consent of the Minister of Defence of the Czech Republic or his authorised representative.
§ 4
(1) Members of the United States armed forces may not be prosecuted for acts related to the use of force pursuant to Paragraph 3 (2), subject to the condition of Paragraph 3 (4), or be extradited to or transferred to other authorities for such prosecution.
(2) Damages to legal and natural persons in connection with the use of force pursuant to Article 3 (2), subject to the condition laid down in Article 3 (4), shall be reimbursed by the Czech Republic.
§ 5
(1) Nothing in this Act can be interpreted as restricting the privileges, immunities and rights of the United States of America under the Agreement between the Parties to the North Atlantic Treaty on the Statute of their Armed Forces (3) or other international treaties by which the Czech Republic is bound, including the right of members of the United States' armed forces to individual or collective self-defence.
(2) The detailed conditions of residence of the armed forces of the United States of America in the territory of the Czech Republic in order to strengthen the protection of the airspace of the Czech Republic at the time of the summit of the North Atlantic Treaty in Prague may be regulated by an international treaty.

Amendment of criminal law
§ 6
In Article 20a (2) of Act No. 140 / 1961 Coll., the penal law, as amended by Act No. 175 / 1990 Coll. and Act No. 290 / 1993 Coll., the word "does not accept 'is replaced by the word" lays down' and the words "or special law 'are added at the end.

§ 7
(1) This Act shall take effect on the day of its publication.
(2) Part One will expire on 1 December 2002.
