THE LAW
of 11 December 2008
amending Act No 22 / 1997 Coll., on Technical Requirements for Products and amending and supplementing certain acts, as amended, and Act No 505 / 1990 Coll., on Metrology, as amended
Parliament has decided on this law of the Czech Republic:
Amendment to the Act on Technical Requirements for Products
Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts, as amended by Act No. 71 / 2000 Coll., Act No. 102 / 2001 Coll., Act No. 205 / 2002 Coll., Act No. 226 / 2003 Coll., Act No. 277 / 2003 Coll., Act No. 186 / 2006 Coll. and Act No. 229 / 2006 Coll., is amended as follows:
1. In Article 5, the following sentence is added at the end of paragraph 6: "In such a case, the Office shall be entitled to choose for professional activities related to the security of the issue and proper distribution of Czech technical standards of payment. These activities and the level of remuneration shall be determined by the Ministry by decree. ';
2. In the introductory part of Section 13b, the words "or in Turkey 'shall be inserted after the words" the European Union'.
Amendment to the Metrology Act
Act No. 505 / 1990 Coll., on Metrology, as amended by Act No. 119 / 2000 Coll., Act No. 13 / 2002 Coll., Act No. 137 / 2002 Coll., Act No. 226 / 2003 Coll. and Act No. 444 / 2005 Coll., is amended as follows:
1. In Article 6 (2), the third sentence is replaced by the following: "This requirement shall be deemed to be met if the gauge complies with the requirement laid down in a general measure. '
2. In Article 9 (1), the sentence "This requirement shall be deemed to be met if the gauge complies with the requirement laid down by a general measure of a general nature 'is inserted after the first sentence.
3. In Article 14 (1), the words "carrying out research and development in the field of electronic communications and participating in international cooperation in this field, assessing conformity and testing of products to the extent granted by authorisations or accreditation pursuant to the legislation governing technical requirements for products 2b) and assessing the technical competence of measuring and technical equipment for electronic communications, shall be inserted after the words" implementing the technical requirements for products 2b), and shall issue measures of general character 2c) in accordance with § 24c and 24d, '.

4. The following Section 24c and 24d are inserted after Section 24b, including the title and footnote 6:
"General measures
Measures of a general nature shall lay down metrological and technical requirements for a specified gauge. Measures of a general nature shall also establish methods of testing for the type-approval and for the verification of a specified gauge.
(1) The authorities concerned are public authorities in the metrologies6 to discuss the draft measure of a general nature.
(2) The general measure shall take effect on the 15th day from the date of its publication, unless the Czech Metrology Institute provides later for the beginning of its effectiveness. The date of publication shall be that indicated in the heading of the general measure.
6) Article 2 of Act No. 20 / 1993 Coll., on the performance of state administration in the field of technical standardisation, metrology and state testing, as amended. '
Transitional provision
The approval of the type of measuring instrument and the verification of the specified measuring instrument, started before the date of entry into force of this Act, shall be completed in accordance with Act No. 505 / 1990 Coll., on Metrology, as effective by the date of entry into force of this Act.
EFFECTIVE
This Act shall take effect on 1 January 2009.
