DECLARATION
of 29 November 2005
issuing the Dispute Order for the Gas System of the Czech Republic
According to Article II (17) of Act No. 670 / 2004 Coll., amending Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of Government Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended, for the implementation of Article 57 (8) (h) of the Energy Act:
Subject matter
(1) The dispatching order of the gas system of the Czech Republic (hereinafter referred to as the "dispatching order") applies to:
(a) the transmission system operator,
(b) distribution system operators;
(c) gas container operators;
(d) the manufacturer.
(2) The Dispatching Regulations lay down the rules governing the gas system's control. The dispatching procedure shall include:
(a) preparation of dispatching control of the operation of the gas system;
(b) operational control of the gas system,
(c) technical evaluation of the operation of the gas system.
Basic concepts
For the purposes of this decree:
(a) the transport capacity of the quantity of gas agreed under the contract between the customer and the transmission system operator;
(b) the input power of the amount of gas in m3 which may be pushed into the underground gas storage tank per day;
(c) the extractive power of the quantity of gas in m3 which may be extracted from the underground gas storage tank per day;
(d) the transfer point, instead of the transfer point between two gas market participants, enabling the quantity and, where applicable, the pressure of the gas transmitted and received, the regulation of gas flow, the measurement of the gas quality for the purpose of calculating its supply in kWh or MWh and the transfer of data to dispatches.
Preparation of the control of gas system operation
(1) The preparation of dispatching control of transmission system operations includes:
(a) discussion of transport capacities with foreign suppliers and customers in the scope and terms of transport contracts, including the processing and discussion of a shutdown programme for technological equipment affecting transport capacity for foreign partners;
(b) processing and discussion of the outage programme of technological equipment affecting the agreed transport capacity;
(c) consideration of the technical parts of the contracts between the transmission system operator and downstream transmission system operators abroad, distribution system operators and gas storage operators setting out the links and conditions of operation;
(d) transmission of the forecast annual balance of gas transport by the transmission system, the expected and actual quantities of gas transported for final customers to the Bilance Centre;
(e) transmission of data on technical parameters of transmission system capacity to the Bilance Centre.
(2) The preparation of the dispatching control of distribution system operation includes:
(a) discuss the repair plan and the outage of the high-pressure distribution system with the transmission system operator in cases requiring mutual cooperation;
(b) discussion of the distribution system repair and outage plan with interconnected distribution system operators in cases requiring mutual cooperation;
(c) consideration of the technical parts of the contracts with the transmission system operator and the interconnected distribution system operators, setting out the links and operating conditions.
(3) The preparation of dispatching control of the operation of the underground gas storage tank includes:
(a) the processing of the timetable for the repairs and shutdowns of the gas storage facility and its discussion with the gas system operator to which the container is connected and those with a gas storage contract concluded;
(b) the processing of the forecast annual stock balance at the beginning of the extraction and incorporation, the initial total output of the extraction and incorporation and the dependence of daily production on stocks and its transmission to the Bilance Centre before 1 April of each calendar year;
(c) consideration of the technical parts of the contracts with the transmission system operator and the downstream distribution system operators.
(4) The preparation of the dispatching control of the gas manufacturer's operation includes:
(a) the annual processing of the gas production plan after each month and gas production plant and its transmission to the Bilance Centre;
(b) drawing up the timetable for planned repairs, shutdowns and putting into service of new technological installations for gas production;
(c) the reciprocal transmission of information with the transmission system dispatcher or distribution system dispatcher or other gas market participants, where appropriate, on the course of gas production, transmission pressures, gas production failures and planned and emergency work affecting gas production.
Operational control of gas system operation
(1) Operational control of transmission system operation includes:
(a) dispatching control of transmission system operation according to continuously monitored operational data and on the basis of daily gas supply diagrams, subject to agreed conditions;
(b) ensuring a balance between the quantity of gas entering and leaving the transmission system;
(c) the approval, coordination and monitoring of the progress of the repairs, including outages of gas transmission system equipment;
(d) ensuring the most favourable transport and changes in the operating parameters of the transmission system;
(e) the reciprocal transmission of information on the operation of the transmission system with the dispatches of operators of downstream foreign transmission systems, distribution systems and underground gas storage facilities;
(f) ensuring the occurrence of an emergency and the termination of an emergency on transmission system facilities or national measures immediately preventing the occurrence of an emergency for the whole territory of the State;
(g) the management of the gas system in emergency states declared for the whole gas system of the Czech Republic and the issuing of instructions to the relevant distribution system operators, underground storage tanks and producers in emergency states;
(h) ensuring the necessary measures provided for in the transmission system emergency plan for the management of disturbances, accidents and emergency situations on the transmission system;
(i) provision of the necessary measures set out in the emergency plan of the gas system of the Czech Republic for the disposal of disturbances, accidents and emergency situations.
(2) Operational control of the distribution system
(a) monitoring the operational parameters of the distribution system to ensure the safe operation and management of the distribution system;
(b) identifying the causes of an imbalance on the distribution system, designing solutions and overseeing its implementation;
(c) the setting of operational arrangements for transmission points to ensure balance and safe operation of the distribution system;
(d) coordination and monitoring of repairs, including outages, gas distribution system installations;
(e) ensuring continuous reception of gas leakage, operational failures and accidents reported on the distribution system;
(f) ensuring an emergency declaration within the relevant distribution system;
(g) coordination of operations in operational failures, accidents, emergency situations or measures to prevent the immediate occurrence of an emergency.
(3) Operational control of the operation of the underground gas storage tank includes:
(a) the distribution of the incorporation and extraction into the individual entry and exit points of the underground gas container;
(b) the operational management of gas injection and extraction for users having a gas storage contract;
(c) transmission of regular information to the transmission system operator's dispatcher to which the underground gas storage device is connected on the course of storage of gas, transfer pressures, failures affecting the operation of the underground gas storage device and on the initiation, operation and termination of scheduled and emergency work on the facilities of the underground gas storage tank;
(d) coordination of operations in operational failures, accidents, emergency situations or measures to prevent the immediate occurrence of an emergency;
(e) the provision of the necessary measures provided for in the emergency plan for the disposal of disturbances, accidents and incidents on the underground gas storage tank.
(4) Operational control of the gas manufacturer's operation includes:
(a) the management of gas production on the basis of contracts concluded and in accordance with the operational guidelines of the transmission system dispatching system and distribution system dispatches and, where appropriate, other gas market participants to which the manufacturer is connected;
(b) registration of quality gas parameters, transmission pressures and operating data at the gas transmission points;
(c) coordination of operations in operational failures, accidents, emergency situations or measures to prevent the immediate occurrence of an emergency;
(d) the provision of the necessary measures provided for in the emergency plan for the disposal of defects, accidents and emergencies on the manufacturer's premises.
Technical evaluation of gas system operations
(1) Technical evaluation of transmission system operations includes:
(a) evaluation of transport by transmission system for individual foreign suppliers and customers and other users having a transport contract with the transmission system operator;
(b) acceptance of the values of the gas supplies and withdrawals made by individual distribution system operators;
(c) recording the change in the free system accumulation or the purchase of gas intended to ensure a balance between gas entering and leaving the transmission system;
(d) assessing the impact of the average daily temperature on balancing gas entering and leaving the transmission system;
(e) recording of quality gas parameters, transmission pressures and operating losses on the transmission system;
(f) evaluation of gas transmission through the transmission system and transmission of aggregated data to the Bilance Centre.
(2) Technical evaluation of distribution system operation includes:
(a) evaluation of gas distribution and data recording of the operating parameters of the distribution system and transmission of aggregated data to the Bilance Centre;
(b) identification of distribution system locations with insufficient distribution capacity;
(c) assessing the impact of the average daily temperature on the operating parameters of the distribution system.
(3) The technical evaluation of the operation of the underground gas storage tank includes:
(a) evaluation of the quantity of gas injected and extracted, the daily input and extraction capacity and the changes in the storage volume and production curve;
(b) processing of gas storage and transmission data to the Bilance Centre.
(4) The technical evaluation of the gas manufacturer's operation involves an evaluation of the quantity of gas produced and the transmission of aggregated data to the Balance Centre.
Transmission of data between manufacturers, transmission system operators, distribution system operators and underground gas storage operators
(1) In order to ensure the safe and reliable operation of the gas system, manufacturers, transmission system operators, distribution system operators and gas storage operators shall transmit the necessary data, in particular:
(a) at interconnection points between the operators of each part of the gas system;
(b) in the event of failures, accidents, repairs and reconstructions, requiring mutual cooperation between dispatches;
(c) preventing and addressing emergencies.
(2) When issuing or preventing emergency situations, the dispatches of transmission system operators, distribution system operators, underground gas storage facilities and manufacturers shall transmit operational information and data to the extent specified by the gas system emergency plan of the Czech Republic.
Repeal
Decree No. 165 / 2001 Coll., on the Dispatching Order of the Gas System of the Czech Republic, is repealed.
Efficacy
This Decree shall take effect on 1 January 2006.
