amending Act No. 274 / 2008 Coll., amending certain laws in connection with the adoption of the Law on the Police of the Czech Republic, Act No. 361 / 2000 Coll., on road traffic and on amendments to certain laws (Road Traffic Act), as amended, and Act No. 141 / 1961 Coll., on criminal proceedings (Criminal Code), as amended
Parliament has decided on this law of the Czech Republic:

ČÁST PRVNÍ

Amendment of the Act amending certain laws in connection with the adoption of the Police Act of the Czech Republic
Čl. I
Act No. 274 / 2008 Coll., amending certain laws in connection with the adoption of the Law on the Police of the Czech Republic, is amended as follows:
1. In point 1 of Part Three of Article VI, the word "council 'shall be replaced by" council'.
2. In Part Six, Article X, point 17 is deleted.
3. In point 24 of Part Six of Article X, the words "In the Annex to the Act 'are replaced by the words" In the Annex to the Act, the table is replaced by the following: "In the Annex to the Act, the seventh entry is replaced by:'.
4. In point 25 of Part Six of Article X, the words "In the Annex to the Act" The summary of acts consisting of infringement of the selected obligations laid down in the road traffic regulations and the number of points for these negotiations, "in point 25, the fifth row of the table is replaced by the words" In the Annex to the Act, the first entry for 3 points is: "
5. In Part Twenty-third Article XXXI, points 13 and 14 are deleted.

1. Paragraph 79a, including the title and footnote 13a, reads as follows:
„§ 79a
Vehicle speed measurement
(1) In order to improve road safety, police and municipal police are entitled to measure the speed of vehicles. The municipal police carry out this activity in places designated by the police while continuing to cooperate with the police.
(2) The municipal police may measure the speed only in the section designated by police13a), the origin of which is marked by a portable road sign showing the speed camera and indicating "FISHING MEASURE." The end of this section is marked with a portable road sign with this picture crossed out in an oblique way and marked "THE END OF THE MEASUREMENT OF FISH."
13a) § 1 (3) and § 2 (d) of Act No. 553 / 1991 Coll., on Municipal Police, as amended. § 86 (d) of Act No. 200 / 1990 Coll., on Infringements, as amended. '
2. In Section 123b, the following paragraph 6 is inserted after paragraph 5, including footnote 35g:
"(6) The public administration contact point shall, at the request of the driver, issue a certified output from the driver's register of his score records in accordance with special legislature35g).

Paragraph 6 shall become paragraph 7.

1. Paragraph 161 (2) and (3) read:
"(2) Unless otherwise provided for by the law, investigations shall be carried out by the police services of the Czech Republic.
(3) Investigation of criminal offences committed by members of the Police of the Czech Republic, members of the Security Information Service and members of the Office of Foreign Relations and Information shall be carried out by the Prosecutor; acting appropriately in accordance with the provisions governing the procedure of the investigating police authority; the provisions on the consent of the prosecutor required to carry out an action by a police authority shall not be used. When investigating criminal offences of members of the Police of the Czech Republic, members of the Security Information Service and members of the Office for Foreign Relations and Information, the Prosecutor may request the authorities referred to in Article 12 (2), within the scope of their jurisdiction, to provide individual evidence or conduct an individual investigation, to cooperate in providing evidence or in carrying out an investigation, to present a person or, under the conditions of Section 62 (1), to service the document. This authority shall comply with the public prosecutor promptly. ';
2. in Paragraph 161, the following paragraph 4 is inserted after paragraph 3:
"(4) Subject to the conditions of Paragraph 20 (1), the prosecutor shall conduct an investigation in accordance with paragraph 3 and against those co-accused who are not members of the Police of the Czech Republic, members of the Security Information Service or members of the Office of Foreign Relations and Information; Paragraph 23 is not affected by this. '
Paragraphs 4 and 5 shall become paragraphs 5 and 6.
