amending Act No. 171 / 1991 Coll., on the Jurisdiction of the Bodies of the Czech Republic on Transfers of State Assets to Other Persons and on the National Property Fund of the Czech Republic, as amended, Act No. 219 / 2000 Coll., on the Property of the Czech Republic and its Presence in Legal Relations, as amended, Act No. 229 / 2001 Coll., amending Act No. 219 / 2000 Coll., on the Property of the Czech Republic and its Presence in Legal Relations, as amended, Act No. 492 / 2000 Coll., and certain other laws, and Act No. 77 / 1997 Coll., Act No. 77 / 1997 Coll., on State Enterprise, as amended by the Act No. 77 / 1997 Coll.
Parliament has decided on this law of the Czech Republic:
Amendment to Act No. 219 / 2000 Coll., on the assets of the Czech Republic and its presentation in legal relations, as amended
Act No. 219 / 2000 Coll., on the property of the Czech Republic and its appearance in legal relations, as amended by Act No. 492 / 2000 Coll., Act No. 229 / 2001 Coll., Act No. 320 / 2001 Coll., Act No. 202 / 2002 Coll., Act No. 280 / 2002 Coll., the Constitutional Court Act No. 476 / 2002 Coll., Act No. 88 / 2003 Coll. is amended as follows:
1. In Paragraph 59 (1), "3 'is replaced by" 6'.
2. In Paragraph 60c (1), the words "during the period laid down in Paragraph 59 (1) and 31 December 2003 at the latest 'are inserted after the words" referred to in the first sentence'.
Amendment to Act No. 229 / 2001 Coll., amending Act No. 219 / 2000 Coll., on the assets of the Czech Republic and its presentation in legal relations, as amended by Act No. 492 / 2000 Coll., and certain other laws
In Part Four, Article IV, point 1, of Act No. 229 / 2001 Coll., amending Act No. 219 / 2000 Coll., on the assets of the Czech Republic and its presentation in legal relations, as amended by Act No. 492 / 2000 Coll., and certain other laws, the heading "2004 'is replaced by" 2007'.
Amendment to Act No. 77 / 1997 Coll., on State Enterprise, as amended
In Article 16 of Act No. 77 / 1997 Coll., on a State Company, as amended by Act No. 220 / 2000 Coll., Act No. 103 / 2001 Coll. and Act No. 202 / 2002 Coll., paragraph 9 is added, including footnotes No. 12a), 12b) and 12c):
"(9) Non-movable goods with which they have the right to manage enterprises established by central government authorities may be transferred free of charge by a donation agreement on the basis of a proposal from the founder, after the Government has given its consent, into the ownership of the local authorities or their associations. 12a) This property, which the government has decided to transfer, is considered to be permanently unnecessary for the State. 12b) The provisions of the Special Act shall apply mutatis mutandis to the transfer of such property. 12c)
12a) § 46 of Act No. 128 / 2000 Coll., on municipalities (municipal establishment), as amended by Act No. 313 / 2002 Coll. § 24 of Act No. 129 / 2000 Coll., on counties (regional establishment), as amended by Act No. 231 / 2002 Coll. § 21 and 22 of Act No. 131 / 2000 Coll., on the capital city of Prague.
12b) § 21 paragraph 1 of Act No. 219 / 2000 Coll., as amended by Act No. 202 / 2002 Coll.
12c) § 3 of Act No. 174 / 2003 Coll., on the transfer of some unnecessary military assets and assets with which the Ministry of Interior is responsible, from the ownership of the Czech Republic to the local authorities. "
footnote 12 (a) shall be renumbered 12d.
EFFECTIVE
This Act shall take effect on the day of its publication.
