DECLARATION
of 4 November 2002
amending Decree No. 245 / 2002 Coll., on the time of fishing for each species of game and on the closer conditions for carrying out the hunt
The Ministry of Agriculture provides pursuant to § 68 for the implementation of § 42 paragraph 2 of Act No. 449 / 2001 Coll., on hunting, hereinafter referred to as "the Act":
Decree No. 245 / 2002 Coll., on the time of fishing for each species of game and on the closer conditions for carrying out the catch, is amended as follows:
1. In Article 1 (j), "16 August 'is replaced by" 1 August';
2. In Article 1 (l), "16 August 'is replaced by" 1 August';
3. in Paragraph 1, points (s) to (ii) are renumbered as points (p) to (gg).
4. In Article 1 (p), the words "with the exception referred to in Article 2 (3) and from 1 January to 31 December by catch only 'are replaced by the words" with the exceptions provided for in Article 2 (3) and (5)'.
5. Paragraph 1 (s) reads as follows:
"(s) pheasant - rooster from 16 October to 31 December, with the exception of the part of the chase which is a pheasant [§ 2 (k) of the Law] in which the pheasant can be fished - rooster and hen from 16 October to 31 January, and with the exceptions set out in § 2 (5) and (6), '.
6. in Article 1 (y), "16 August" is replaced by "1 September."
7. in Paragraph 1 (aa), "16 August" is replaced by "1 September."
8. in Paragraph 1 (cc), "16 August" is replaced by "1 September."
9. in Paragraph 1 (dd), "16 August" is replaced by "1 September."
10. in Paragraph 1 (ee), "1 June" is replaced by "1 July."
11. in Paragraph 1 (ff), "1 June" is replaced by "1 July."
12. in § 1, point (gg) reads:
"(gg) mountain orb until the date of entry into force of the Treaty of Accession of the Czech Republic to the European Union from 16 October to 31 December, in pheasants [§ 2 (k) of the Act] from 16 October to 31 January."
13. in Paragraph 2 (1), the word 'catch' shall be deleted;
14. in Paragraph 2, paragraph 4, including footnote 1, reads:
"(4) At public and private national and international airports used for air traffic and at military airports, all types of game referred to in § 1 may be fished year-round and liable to endanger the safety of air traffic. Specific legislation (1) concerning the fishing of other game species which could jeopardise the safety of air traffic at those airports shall remain without prejudice.

Decree No. 395 / 1992 Coll., implementing certain provisions of the Czech National Council Act No. 114 / 1992 Coll., on Nature and Landscape Protection, as amended by Decree No. 105 / 1997 Coll., Decree No. 200 / 1999 Coll., Decree No. 85 / 2000 Coll. and Decree No. 190 / 2000 Coll. '.
15. in Article 2, paragraphs 5 and 6 are added:
"(5) The fishing period for hake and pheasant for hunting by hunting predator is from 1 September to 31 December.
(6) The fishing period for hare is from 1 January to 31 January. The period of fishing for pheasant shall be from 1 January to 31 March, except for the part of the chase which is a pheasant [§ 2 (k) of the Law], in which it may be fished by catching pheasant - rooster and hen from 1 February to 31 March. '
16. in Article 3 (1), the second sentence is replaced by the following: "The restriction shall not apply to field hake and pheasant of the general hunting predators and to pheasant in pheasants [§ 2 (k) of the Act]."
17. in Article 4 (2), "§ 1 (ii) shall cease" shall be replaced by "§ 1 (gg) and § 2 (4) shall cease."
This Decree shall take effect on 1 January 2003.
