DECLARATION
of 1 November 2002
laying down the professional competence of medical practitioners investigating death and medical examiners carrying out tests to confirm irreversible death for the purpose of the collection of tissues or organs intended for transplantation
According to Section 10 (7) of Act No. 285 / 2002 Coll., on Donation, Collection and Transplantation of Tissue and Organs and on the Amendment of Certain Laws (Transplant Act):
Professional competence of doctors investigating the death of a potential donor by demonstrating irreversible pawning of blood circulation
(1) Physicians investigating the death of a potential donor of tissues or organs intended for transplantation (hereinafter referred to as "potential donor") by demonstrating irreversible pawning of blood circulation must have at least a level I specialisation in one of the basic specialisation fields; It does not justify specialisation in the basic field of hygiene and epidemiology, clinical biochemistry, medical microbiology, radiodiagnostic or dentistry by demonstrating death by demonstrating irreversible arrest of blood circulation.
(2) If the expected tissue or organ should be collected before 2 hours after the possible donor has been found to be dead, at least one of the doctors detecting death shall have evidence of irreversible blood circulation by specialising in grade II in at least one of the fields of anaesthesia and resuscitation or surgery or internal medicine.
(3) If death is ascertained by demonstrating irreversible arrest of the blood stream of a potential donor to whom the child is a child, at least one of the doctors who studies the death of the child by the end of the 18 years of age must have a degree II specialisation in anesthesiology and resuscitation, or
(a) if the child is lost by the 27th day of life,
1. degree II specialisation in pediatrics; or
2. extension specialization in neonatology,
(b) if the child goes from 28 days of life to 18 years of age,
1. degree II specialisation in pediatrics; or
2. the extension specialization in neonatology, if the death of a child who is in bed care of the neonatology hospital is detected.
Professional competence of doctors investigating the death of a possible donor by demonstrating irreversible loss of brain function including brain stem
(1) At least one of the doctors investigating the death of a potential donor by demonstrating irreversible loss of function of the entire brain including the brain stem (brain death) must have:
(a) level II specialisation in at least one of the fields of anesthesiology and resuscitation or neurology; or
(b) extension specialization in neurosurgery.
(2) If death is ascertained by proving the death of a possible donor's brain, which is a child, at least one of the doctors investigating the death of a child until the end of the 18-year-old age must have a grade II specialisation in anesthesiology and resuscitation or neurology or extension specialisation in child neurology or neurosurgery, or
(a) if the child is lost by the 27th day of life,
1. degree II specialisation in pediatrics; or
2. extension specialization in neonatology,
(b) if the child goes from 28 days of life to 18 years of age,
1. degree II specialisation in pediatrics; or
2. the extension specialization in neonatology, if the death of a child who is in bed care of the neonatology hospital is detected.
Professional competence of physicians conducting examinations confirming the irreversible death of a possible donor's brain
(1) A physician performing an examination confirming the irreversible death of a possible donor by means of angiography of the cerebral arteries must have a level II specialisation in radiodiagnostic.
(2) A physician performing an examination confirming the irreversible death of a possible donor by means of brain perfusion scintigraphy must have an extension specialisation in nuclear medicine.
(3) A doctor conducting an examination confirming the irreversible death of a possible donor by means of transcranial Doppler sonography must have:
(a) level II specialisation in radiodiagnostic or neurology; or
b) extension specialization from neurosurgery or children's neurology
and demonstrated at least three years of experience in the continuous implementation and interpretation of the results of the Doppler examinations.
(4) A physician conducting an examination confirming the irreversible death of a possible donor by means of auditory stem-evoked potential must have:
(a) specialisation in neurology or otorinolaryngology, at least 1st degree; or
b) extension specialization in children's neurology
and a qualification course in the methodology of evocaed potentials and demonstrated at least three years of experience in the continuous implementation and interpretation of the results of the evocative potentials.
Repeal
The following shall be deleted:
1. Directive No 24 / 1997 of the Czech Ministry of Health on the extraordinary removal of tissues and organs (registered in the amount of 11 / 1978 Coll.).
2. Directive No 1 / 1984 MZ ČSR, which amends and complements Directive No 24 / 1997. MZ ČSR, on the extraordinary removal of tissues and organs (registered in the amount of 10 / 1984 Coll.).
Efficacy
This decree shall take effect on the day of its publication.
