of 24 September 1992
amending and supplementing Act No. 30 / 1968 Coll., on State Testing, as amended by Act No. 54 / 1987 Coll. and Act No. 194 / 1988 Coll.
The Federal Assembly of the Czech and Slovak Federal Republic decided on this law:
Act No. 30 / 1968 Coll., on State Testing, as amended by Act No. 54 / 1987 Coll. and Act No. 194 / 1988 Coll., is amended as follows:
1. In Article 6 (2), the words "which are subordinate to it or to other organisations' and the words" and in agreement with their superior bodies' shall be deleted.
2. In Paragraph 13 (1), the words "with the consent of its superior authority 'shall be deleted.
3. In Paragraph 13 (2), part of the sentence after the semicolon is deleted.

The State Service shall evaluate the products on the basis of the manufacturer's proposal. ';
5. Paragraph 16 repeals paragraph 5.
6. In Paragraph 18, the third sentence of paragraph 1 and paragraph 2 are deleted; at the same time, the numbering of paragraphs is deleted.
7. In Paragraph 19 (2), the second sentence is deleted.
8. Paragraph 21 is deleted.
9. In Paragraph 22, the following paragraph 3 is inserted after paragraph 2:
"(3) An importer of a product which has been approved as a type for another importer may draw attention to this when submitting an application for approval to a national service. If the notified conformity has been verified by the State Service as being true, it shall issue a decision on approval to that importer without further procedure. ';
Paragraphs 3 to 5 shall be renumbered paragraphs 4 to 6.
10. In Article 22, the following paragraph 5 is inserted after the newly marked paragraph 4:
"(5) Imported products provided for approval shall also be deemed to have been approved if their importation has been notified to the competent national authority and are marked with signs or with findings (e.g. certificates) recognised for this purpose under an international agreement bound by the Czech and Slovak Federal Republic or recognised by the Federal Office for Standardisation and Measurement. The Federal Standardisation and Measurement Authority may, after consulting the authorities involved, recognise marks or findings if they express the conformity of the product's characteristics with the requirements laid down for its approval under this Act. The marks and findings recognised for approval purposes shall be published in the Bulletin of the Federal Office for Standardisation and Measurement. ';
Paragraphs 5 and 6 shall become paragraphs 6 and 7.
11. the following sentence shall be added at the end of Paragraph 22 (6):
"Importer of a product of an approved type for another importer may put into circulation the imported product as soon as the application for approval has been lodged with the national service, accompanied by a written declaration that such product is identical to the approved product type, until the product approval decision has been taken for that importer. ';
12. Paragraph 29 repeals paragraphs 2 and 3; paragraphs 4 to 9 become paragraphs 2 to 7.
Where the term "organisation 'is used in the State Testing Act, the term" legal persons and natural persons entitled to business' shall be replaced by the term "legal persons'. Where the term" superior bodies' is used, the term "central government bodies' shall be replaced by the term" central government bodies', provided that they perform the function of founder or founder in respect of a legal person '.
This Act shall take effect on the day of its publication.
