ORDER
GOVERNMENTS OF THE CZECH REPUBLIC
of 20 November 2020
on the adoption of crisis measures
Following the Government Resolution No. 957 of 30 September 2020, the Government, in accordance with Articles 5 and 6 of Constitutional Act No. 110 / 1998 Coll., on the Security of the Czech Republic, declared emergency status in accordance with Article 5 (a) to (e) and § 6 of the Act No. 240 / 2000 Coll., on emergency management and on the amendment of certain laws (Crisis Act), as amended, for the resolution of the crisis situation, the adoption of crisis measures, by virtue of Articles 5 (e) and 6 (1) (b) of the Crisis Act.
For the Council
I. prohibits
1. retail sale and sale and provision of services at premises, except for the following establishments:
(a) food stores;
(b) fuel outlets;
(c) fuel outlets;
(d) stores of sanitary goods, cosmetics and other druggie goods,
(e) pharmacies, dispensers and medical devices outlets;
(f) sales of small domestic animals,
(g) sales of feed and other animal needs;
(h) sales of glasses, contact lenses and related goods;
(i) newspapers and magazines,
(j) tobacco stores;
(k) laundry and dry cleaners,
(l) road vehicle service and repair facilities;
(m) the premises of the towing providers and the removal of in-service vehicle defects on the road;
(n) sales of spare parts for means of transport and manufacturing,
(o) establishments permitting the collection of goods and consignments purchased in a distance manner;
(p) garden shops, including seed and seed;
(q) ticket ticket bill,
(r) florists;
(s) facilities for the negotiation and disposal of construction, project activity under construction, geological work, surveying, testing, measurement and analysis in construction,
(t) sales of textile material and textiles,
(u) computer and telecommunications services, audio and video receivers, consumer electronics, appliances and other household products,
(v) real estate brokerage establishments and the activities of accountants, accounting, tax records,
(w) locking and servicing of other household products,
(x) repair, maintenance and installation of household machinery and equipment,
(y) funeral services, embalming and preserving, cremation of human remains or human remains, including the storage of human remains in Urenas;
z) car washing machines,
(aa) domestic and hardware stores, where furniture, carpets and other floor coverings are not considered as household supplies;
(ab) establishments collecting and purchasing raw materials and composting plants;
ac) stone processing plants (e.g. the production of monuments, tombstones and their installation),
ad) establishments (including mobile plants) with the sale of piety goods, such as wreaths, flower decorations for graves, piety candles, etc., and Christmas trees, Christmas ornaments, mistletoe, praise and related products; for these establishments, the prohibition on sales at mobile premises referred to in point I / 7 shall not apply;
ae) establishments providing treatment and cutting services for dogs and cats,
(af) arms and ammunition sales,
the goods and services are mainly sold or offered at the establishment; This prohibition shall not apply to non-commercial activities under the Trade Code; Furthermore, this prohibition does not apply to the sale of foodstuffs at establishments for which the sale of foodstuffs does not constitute a major part of the activities of the establishment, but the part of the establishment in which the food is sold is separated from the other parts of the establishment,
2. the presence of the public in food service establishments (e.g. restaurants, pubs and bars), except:
(a) in establishments which do not serve the public (e.g. occupational catering, catering of health and social services providers, in prison facilities),
(b) in the case of school meals for staff present at the workplace and for children, pupils and students participating in preschool education,
(c) in establishments in accommodation facilities, provided that they provide catering only to persons residing, and only between 05: 00 and 22: 59,
This prohibition does not apply to sales outside the establishment of catering services (e.g. fast food establishments with a window or the sale of meals with them), with the prohibition that sales to customers at the place of the establishment (e.g. dispensing window) are prohibited between 23: 00 and 04: 59,
3. Sales at the place of the food service establishment located within shopping centres with a sales area exceeding 5 000 m2;
4.
(a) concerts and other musical, theatre, film and other artistic performances including circuses and variations with the presence of spectators;
(b) the joint singing of more than 5 persons in the interior of buildings, with the exception of residence, even if it is a work or business activity, with the exception of nursery schools;
(c) pilgrims and similar traditional events;
(d) congresses, educational events and examinations in presentation form, with the exception of practical teaching and practice under Act No. 95 / 2004 Coll., on the conditions for obtaining and recognition of professional competence and specialised competence for the exercise of the medical profession of a physician, dental practitioner and pharmacist, as amended, and under Act No. 96 / 2004 Coll., on the conditions for obtaining and recognition of competence for the performance of non-medical professions and for the exercise of activities related to the provision of medical care and on the amendment of certain related laws (Law on non-medical medical professions), as amended, as amended, and as amended by Act No. 561 / 2004 Coll., on the training of fire protection and fire protection and fire-fighting personnel, and other education (Act No. 111 / 1998 Coll., on the Act on the Law on Testing, which forms part of the Education Act No 561 / 2004 Coll., as amended; the presence of more than 10 persons at one time and, if the test is public, more than 3 persons from the public,
(e) fairs;
(f) the operation of gambling, casinos and betting offices;
(g) the operation and use of sport sites in the indoor areas of buildings (e.g. gyms, playgrounds, ice rink, courts, rings, bowling or billiards, training facilities) and the internal premises of outdoor sports sites, dance studies, gym and fitness centres, with the exception of sports activities in schools or educational establishments and universities, where emergency measures allow, and with the exception of training carried out by persons in the framework of the performance of employment, business or other similar activities such as preparation for sporting events held in competitions organised sports associations, and sports events which do not comply with point VI of the Government Resolution of 20 November 2020 No 1200, published under No 476 / 2020 Coll., prohibited;
(h) the operation and use of artificial swimming pools (swimming pool, swimming pool, swimming pool for infants and toddlers, paddling grounds), wellness facilities including saunas, solarium and salt caves, unless it is a health service provider;
(i) visits and inspections of zoos and botanical gardens;
(j) visits and visits to museums, galleries, exhibition premises, castles, castles and similar historical or cultural objects, observatories and planetariums;
k) the operation of an establishment or the provision of services to persons aged 6 to 18 who are engaged in activities similar to those of interest education pursuant to § 2 of Decree No. 74 / 2005 Coll., such as in particular an interest, educational, recreational or educational activity, including preparation for teaching,
5. providing accommodation services, with the exception of providing accommodation services
(a) persons for the purpose of pursuing a profession, business or other similar activity;
(b) persons required under the Crisis Act;
(c) foreigners until they leave the territory of the Czech Republic and foreigners authorised to work in the territory of the Czech Republic,
(d) persons ordered to be isolated or quarantined;
(e) persons whose accommodation has been agreed by the State, the local authorities or bodies set up by them or established by them in order to relax the capacities of health service providers or social services providers or to provide accommodation for homeless persons;
(f) persons with a view to completing their accommodation before the Government's resolution is effective;
6. drinking alcoholic beverages in public places,
7. sales in markets, markets and mobile plants (sales in stalls, mobile shops and sales from other mobile devices), walking and door-to-door sales; the prohibition does not apply to mobile shops providing for the sale of food and drugist goods in municipalities where such goods cannot be purchased at another establishment; Furthermore, the prohibition shall not apply to the sale of fruit and vegetables (fresh or processed), herbs, flowers, milk and milk products, meat and meat products, including live fish, eggs, bakery and confectionery products, honey and honey products produced in the Czech Republic (hereinafter referred to as the "agricultural markets'),
8. retail sale and sale and provision of services at premises on Sundays, public holidays and other holidays throughout the day and on Mondays to Saturdays between 23: 00 and 04: 59, with this prohibition not applicable to non-business activities under trade law, and to operations
(a) petrol and lubricant filling stations;
(b) pharmacies,
(c) shops at points of increased passenger concentration at airports, railway stations and bus stations;
(d) shops in medical establishments;
(e) food service establishments within the scope of point I / 2;
(f) establishments (including mobile plants) with the sale of piety goods, such as wreaths, flower decorations for graves, piety candles, etc., and Christmas trees, Christmas ornaments, mistletoe, praise and related products, if sold on Sunday at between 05: 00 and 22: 59;
II. limits
1. the operation of an establishment of catering services, the operation of which is allowed under point I / 2, in such a way that their operators must comply with the following rules:
(a) customers shall be so established that the distance between them is at least 1,5 metres, except for customers sitting at one table;
(b) not more than 4 customers sit at one table, except for members of the household; In the case of a long table, it may accommodate several customers so that there is a distribution of at least 2 metres between groups of not more than 4 customers, with the exception of household members,
(c) in the case of sales from an establishment of catering services outside its internal premises (e.g. a window of dispensation), persons who consume food and food in the immediate vicinity of the establishment, including drinks purchased there (except alcoholic beverages whose drinking is prohibited in public places), are required to keep spacing from other persons at least 2 metres, if not for household members;
(d) the operator shall not allow more customers in the interior of the establishment than in the interior of the establishment of seating places for customers; the operator is obliged to record in writing the total current number of seating positions for customers;
(e) a ban on the production of live music and dance;
f) the possibility of wireless internet connection for the public will not be provided,
2. the operation of musical, dance, game and similar social clubs and discos by prohibiting the presence of the public;
3. the activity of shopping centres with a sales area exceeding 5 000 m2 so that
(a) the use of resting places (chairs, chairs, benches, etc.) is restricted so as not to be places of assembly;
(b) the possibility of wireless Internet connection for the public is not provided;
(c) the operator shall ensure at least one person oversees compliance with the following rules and shall act on customers and other persons to comply with them;
(d) the following customer instructions are communicated to customers and other persons in particular by means of information boards, leaflets, screens, radio, etc.,
(e) the operator shall ensure a visible indication of the order to comply with the 2 metres spread between persons on publicly accessible areas in the shopping centre (e.g. in the form of info, radio centre spots, information at the entrance to stores and other premises, information on the floor of public spaces, etc.),
(f) the assembly of persons is prevented, in particular in all places where this can be expected, e.g. entrances from underground garages, spaces in front of elevators, escalators, travelers, toilets, etc.,
4. the operation of the agricultural markets referred to in point I / 7 by prohibiting on-the-spot consumption, spacing between stands, tables or other points of sale shall be at least 4 metres; at one time there shall be no more than 1 person per 15 m2 on the area of the farmer's market;
5. the operation of libraries in such a way as to prohibit the supply of other than pre-ordered borrowings and their return through the window or without contact;
III. Orders the operator to comply with the following rules at the premises referred to in point I / 1 whose operation is not prohibited:
1. does not allow more customers in the establishment than 1 customer per 15 m2 of sales space; in the case of an establishment with a sales area of less than 15 m2, this restriction shall not apply to a child under 15 years of age accompanying a customer and accompanying a customer holding a disabled person's licence; in the case of other establishments, this restriction shall not apply to a child under 6 years of age accompanying the customer;
2. actively prevents customers from staying less than 2 metres away, except for persons from the common household;
3. ensure the management of fronts of waiting customers, both inside and outside the establishment, in particular by means of the marking of the area for waiting and placing marks for minimum spacing between customers (minimum spacing of 2 metres), with a customer holding a disabled person's licence having the right of priority purchase;
4. place disinfectants on frequently touched articles (mainly handles, railings, shopping carts) so that they are available to employees and customers of the premises and can be used for regular disinfection;
5. ensure that customers are informed of the above-mentioned rules, in particular by means of information posters at the entrance and at the premises and, where appropriate, by communicating the rules of the speakers at the premises;
6. in the case of a person carrying a stroller with a child, the operator shall not require that he use a shopping cart for purchase, and the child in the stroller shall not be counted against the total permissible number of persons per sales space,
the sales area means the part of the establishment which is intended for the sale and display of goods, i.e. the total area to which customers have access, including test rooms, the area occupied by desks and interpretations, the area behind desks used by sellers; The sales space shall not include offices, warehouses and preparation rooms, workshops, staircases, dressing rooms and other public spaces.
