DECLARATION
of 4 October 2006
laying down how the heat energy supply costs are to be allocated in the joint measurement of the amount of heat energy collected for the preparation of hot commercial water for several sampling points
The Ministry of Industry and Trade provides, pursuant to § 98 (6) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of State Administration in the Energy Sector and on the amendment of certain laws (Energy Act), as amended by Act No. 670 / 2004 Coll., ("the Act ') for the implementation of § 76 (3) (e) of the Act:
(1) The cost of the supply of heat energy corresponding to its quantity and its price per unit quantity is fixed at each sampling post (1).
(2) The costs of the supply of hot water (hereinafter referred to as "hot water") in its joint preparation and measurement for several sampling points include all costs corresponding to the cost-effective, reliable and safe operation of the heat energy source, the distribution heat equipment and the sampling heat equipment and which have been incurred to ensure the supply of hot water to all sampling points.
(3) If a quantity of hot water and heat energy in hot water are installed at all sampling points, the supply to customers shall be charged according to the measurement data.
(4) If it is not possible to determine the amount of heat energy supplied for the preparation of hot water in the joint measurement of the hot water supply, data on the measured quantity of cold water collected for the preparation of hot water and the amount of heat energy consumed for heating it in the previous calendar year shall be used for the necessary time to determine the amount of heat energy.
(5) Where the owners of an object or parts thereof with one common, technologically linked heat collection installation, one common heat connection and one common supply point do not agree with each other on the method of allocating the costs to be incurred on individual buildings or parts thereof, the heat energy supply costs shall be divided into individual objects or parts of them in proportion to the uniform manner determined by the floorboards (3).
(1) If no agreement has been reached pursuant to Paragraph 76 (3) (e) of the Act on the method of allocating the cost of the supply of hot water in the joint preparation and joint measurement of the quantity of heat energy and water for several sampling points, the allocation of costs per sampling point shall be as follows:
(a) heat energy costs for the preparation of hot water in the joint preparation and delivery to all sampling points are divided into essential and consumer components, the basic component being 30% and the consumer component being 70% of the costs;
(b) the basic cost component shall be divided into individual sampling points according to the floor flats3) of the spaces used by each customer; where the customer does not provide the supplier with data on the floor area of flats and non-residential areas or where the data are inaccurate, the floor area shall be determined according to the size of the building and taking into account the extent of the collection, the nature of consumption and the use of hot water,
(c) the consumption component of the heat energy costs for the preparation of hot water and the cost of the supply of water for the preparation of hot water and its clogging shall be distributed in proportion to the measurement data (2) of the hot water collection at the delivery sampling points; until the time of installation of the measurement of the supplied hot water at the sampling point, the sum of the hot water consumption measurement data according to waters2) shall be used for final consumers;
(d) if the measurement data referred to in point (c) are not known from all delivery points on the ground that it has not yet been installed at the delivery point of the measurement of the supplied hot water, or if the hot water supplier has not been supplied with the sum of the hot water consumption measurement data according to the water meters installed at final consumers, the consumption component of the costs shall be distributed in the same way as the basic component referred to in point (b);
(e) where the supplier is not installed at all sampling points, the measurement of the supplied quantity of hot water and where the different data between the measured quantity of hot water delivered in its joint preparation and the sum of the data from the sampling points with the installed measurement and the data from the water meters in final consumption are not installed,
1. where the measurement figure in the joint preparation is less than the sum of the measurement data at all sampling points, or where the measurement figure in the joint preparation is less than 15% higher than the sum of the measurement data from all sampling points, the cost of the consumption component referred to in point (c) shall be distributed; or
2. where the measurement figure in the joint preparation is more than 15% or more than the sum of the measurement data at all sampling points, the cost of the consumption component shall be distributed from all sampling points corresponding to the sum of the measurement data at all sampling points referred to in point (c), the remaining costs as the basic component referred to in point (b).
Decree No. 224 / 2001 Coll., laying down rules on the allocation of heat energy supply costs to individual sampling points, is hereby repealed.
This Decree shall take effect on 1 January 2007.
