GOVERNMENT REGULATION
of 30 October 2002
amending Government Regulation No 175 / 2001 Coll., laying down the conditions and principles for granting financial aid for potato processing and starch wheat and laying down the conditions and principles for granting the subsidy on exports of potato starch products, as amended by Government Regulation No 250 / 2002 Coll.
The Government orders pursuant to § 12 (2) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund) (hereinafter referred to as "the Act"):
Government Regulation No 175 / 2001 Coll., laying down the conditions and principles for granting financial aid for the processing of potatoes and starch wheat and laying down the conditions and principles for granting subsidies on exports of potato starch products, as amended by Government Regulation No 250 / 2002 Coll., is hereby amended as follows:
1. In Paragraph 4 (1), the word "to 'shall be inserted after the words" to'.
2. In Paragraph 4, the following paragraph 2 is inserted after paragraph 1:
"(2) The Fund shall fix the amount of aid for wheat starch which may be granted under paragraph 1 for the marketing year concerned, on the basis of the approved budget of the Fund and the total quantity of wheat starch for which aid is requested. ';
Paragraphs 2 and 3 shall become paragraphs 3 and 4.
3. In Paragraph 4 (3), "15 000 'is replaced by" 25 000'.
4. Paragraph 5 (5) reads as follows:
"(5) The Fund shall decide on the application in accordance with Article 5 (5) of the Act; the amount of aid for wheat starch for the marketing year concerned shall be fixed in accordance with Article 4 (1) and (2). If the quantity of wheat starch declared by the producers of wheat starch in the non-rejected aid applications exceeds the total quantity laid down in Article 4 (3), the Fund shall adjust the requirements of the individual producers of wheat starch aid for wheat starch. '
Transitional provisions
1. A natural or legal person who has submitted an aid application pursuant to Article 5 of the Act and pursuant to Article 2 of Decree-Law No 175 / 2001 Coll., as amended by Government Regulation No 250 / 2002 Coll., for the period from 1 September 2002 to 31 August 2003 and has not been rejected, may apply for aid for a total quantity of 21 000 tonnes of potato starch by 30 November 2002 at the latest.
2. A natural or legal person who has submitted an aid application pursuant to Article 5 of the Act and pursuant to Article 5 of Decree-Law No 175 / 2001 Coll., as amended by Decree-Law No 477 / 2002 Coll., for the period from 1 September 2002 to 31 August 2003 and has not been rejected, may apply for aid for a total quantity of 10 000 tonnes of wheat starch by 30 November 2002 at the latest.
Efficacy
This Regulation shall enter into force on the day of its publication.
