DECLARATION
of 21 December 2017
amending certain regulations in connection with the termination of pension savings
The Czech National Bank provides pursuant to § 110 (1) of Act No. 426 / 2011 Coll., on Pension Savings, for the implementation of § 39 (3), § 41 (6), § 45 (8) (a) and (b), § 52 (6), § 63 (5), § 68 (3), § 69 (4), § 79 (3), § 82 (3) and § 99 (5) of the Pension Savings Act and pursuant to § 170 (1) of Act No. 427 / 2011 Coll., on Supplementary Pension Savings Act, implementation of § 84 (4) of the Supplementary Pension Savings Act:
Amendment of the Decree on minimum requirements for the Statute of the Participating Fund and the Statute of the Pension Fund
Decree No 57 / 2012 Coll., on the minimum requirements for the Statute of the Participating Fund and the Statute of the Pension Fund, is amended as follows:
1. In the title of the decree, the words "and the Statute of the Pension Fund 'are deleted.
2. In Article 1, the words "and the Statute of the Pension Fund 'and the words" and the Pension Savings Act' are deleted and the word "their 'is replaced by the word" his'.
3. in Article 5 (i), the words "and pension funds" shall be deleted;
(4) Paragraph 15, including the title and footnotes No 16 and 17, shall be deleted.
Amendment of the Decree on a more detailed regulation of the activities of the pension company, pension fund and participating fund
Decree No 117 / 2012 Coll., on a more detailed regulation of the activity of the pension company, pension fund and participating fund, as amended by Decree No 145 / 2014 Coll., is amended as follows:
1. In the title of the decree, the words "pension fund 'are deleted.
2. In Article 1 (d), the words "Article 79 (3) of the Pension Savings Act and 'are deleted.
3. in § 1 (e), the words "in § 82 (1) of the Pension Savings Act and" shall be deleted;
4. In Article 1 (f), the words "which a pension fund may use for the efficient management of assets under Section 52 (6) (a) of the Pension Savings Act and 'are deleted.
5. In Article 1 (g), the words "pursuant to Article 52 (6) (b) of the Pension Savings Act and 'are deleted.
6. In Article 1 (h), the words "the method of determining the fair value of the assets in the pension fund and the liabilities of the pension fund under Article 63 (5) of the Pension Savings Act and 'are deleted.
7. In Section 1 (j), the words "under Section 68 (1) of the Pension Savings Act and 'are deleted.
8. in Article 6 (2) (a), the words "pension unit of the pension fund" shall be deleted;
9. In Paragraph 19 (2), the words "Paragraph 31 (2) of the Pension Savings Act and 'are deleted.
10. in Paragraph 22 (1) (d), the words "pension saving or" shall be deleted;
11. In Part Three of Title II, the words "THE PENSION FUND A 'are deleted.
12. In Part Three, under Title II, the words "Section 52 of the Pension Savings Act and 'are deleted.
13. in Paragraph 30 (1), the words "in the pension fund and" shall be deleted.
14. in § 30 (2) (a) and (b), § 32 (1), § 37 and § 38 (4), the words "pension fund and" shall be deleted;
15. in § 30 (2) (c), § 31 (1) (a) and (b), § 32 (1), § 34 of the introductory part of the provision, § 35 (1) (c) and § 41 (1) (b), the words "the pension fund" shall be deleted;
16. in Paragraph 30 (2) (c), the word "theirs" is replaced by "his."
17. in § 31 (1) of the Introductory Part of the Provisions and § 2, § 32 (2) and (5), § 35 (1) of the Introductory Part of the Provisions, § 36 and § 38 (6), the words "Pension Fund and Participant" are replaced by the words "Participant."
18. In Section 34 of the introductory part of the provision, the words "Paragraph 53 (3) of the Pension Savings Act and 'are deleted.
19. in Paragraph 36, the words "Paragraph 53 (1) and (5) of the Pension Savings Act or under" are deleted.
20. In Part Three of Title III, the words "PENSION FUND A 'are deleted.
21. In Part Three, under Title III, the words "Section 63 of the Pension Savings Act and 'are deleted.
22. in Article 38 (4) and (6), the words "or pension fund" shall be deleted;
23. In the text under the heading of Part Four, the words "Sections 79 and 82 of the Pension Savings Act and 'are deleted.
24. Paragraph 39 (1) is deleted.
Paragraphs 2 to 4 shall be renumbered paragraphs 1 to 3.
25. In Paragraph 39 (1) of the introductory part of the provision, the words', investment policy of pension funds' and the words' on pension savings or 'shall be deleted.
26. In Section 39 (2) of the introductory part of the provision, the words "pension saving or 'are deleted.
27. in Paragraph 39 (2) (c), the words "pension fund" shall be deleted;
28. Paragraph 40 (1) is deleted.
Paragraphs 2 to 4 shall be renumbered paragraphs 1 to 3.
29. in § 40 (2), the words "in § 82 (1) (a) to (h) of the Pension Savings Act and" are deleted.
30. In Paragraph 40 (3), the words "under § 82 (1) (j) to (l) of the Pension Savings Act and" are deleted.
31. In the text under the heading of Part Five, the words "Sections 67 and 68 of the Pension Savings Act and 'are deleted.
32. in Article 42 (1) and (2), the words "pension fund" shall be deleted;

Amendment of the Order on professional competence for the distribution of certain products on the financial market
Decree No 215 / 2012 Coll., on professional competence for the distribution of certain products on the financial market, is amended as follows:
1. in Paragraph 3 (1), point (b) shall be deleted;
Points (c) to (f) shall be renumbered (b) to (e).
2. in Articles 4 (1) and 2 (a) to (c), the words "pension savings and" shall be deleted;
3. In Article 4 (2) (d), the words "pension savings and 'are deleted.
4. In Annex 1, point (b) is deleted.
Points (c) to (f) shall be renumbered (b) to (e).
Amendment of the Order on the scope of the activities of the pension fund depositary and the participant fund depositary
Decree No 341 / 2012 Coll., on the scope of the activities of the pension fund depository and the participant fund depository, is amended as follows:
1. In the title of the decree, the words "the depositary of the pension fund and 'are deleted.
2. In Section 1 (1) of the introductory part of the provision, the words "the depositary of the pension fund and 'are deleted.
3. in Articles 1 (1) (a) to (c), (f) to (h) and (j) and 2 of the introductory part of the provision, the words "in the pension fund and" shall be deleted;
4. In Article 1 (1) (d), the words "pension units of the pension fund (the pension unit) and 'are deleted.
5. in Paragraph 1 (1) (e), the words "pension units and" shall be deleted;
6. In sections 2 and 3, the words "in the pension fund and 'are deleted.

Decree No. 425 / 2012 Coll., on the submission of information by the pension company Česká národní banka, is amended as follows:
1. in Article 2 (a), the words "pension fund," shall be deleted;
2. in Article 3 (1) (a) (3), the word "pension /" shall be deleted;
3. In the text of the Annex to the first and second paragraphs, the word "pension 'is deleted.
4. In the text in the Annex to the second paragraph, the words "pension laws and 'are replaced by the words" legislation'.
5. In the text of the Annex to the third paragraph, the words "pension / '," pension and' and "pension / 'are deleted.
6. In the text of the Annex to the fifth paragraph, the words "pension and 'are deleted.

Decree No 474 / 2013 Coll., on the remuneration of the liquidator, the forced administrator and the insolvency administrator of certain service providers on the capital market and the reimbursement of their final expenses, is amended as follows:
1. In Section 3 (2) of the introductory part of the provision, the words "pension funds' are deleted.
2. in Articles 3 (2) (a) and 9 (1) (a), the words "pension funds and" shall be deleted;
3. in Articles 3 (6) and 5 (4) (c), the words "pension fund" shall be deleted;
4. In Article 4 (3) (c), the words "pension funds managed 'are replaced by" beneficiaries'.
5. In Article 5 (2), the words "pension funds' and" pension funds' are deleted.

EFFECTIVE
