THE LAW
of 18 December 2013
amending Act No. 634 / 1992 Coll., on Consumer Protection, as amended
Parliament has decided on this law of the Czech Republic:

1. Paragraph 20, including the title and footnote 34, reads as follows:
"Obligations related to the holding of organised actions
(1) The Seller who intends to sell or offer products or services in the framework of an organised event is obliged to notify the Czech Trade Inspection of the information referred to in paragraph 4.
(2) Actions intended for a limited number of consumers who have been invited to it by or without an invitation to do so shall be considered to be organised in accordance with paragraph 1 and shall involve the sale or promotion of products, services, and shall not be decisive whether the transport of persons participating in the action is part of the action.
(3) The notification referred to in paragraph 1 shall be made no later than 10 working days before the organised action takes place.
(4) The notification must include, in addition to the general requirements laid down in the Administrative Regulation (34):
(a) the address of the place where the sale, promotion or offering of products, services are made;
(b) the date of the organised action, including its expected timetable;
(c) the identification of the product or service to be promoted, offered, sold or provided as part of an organised action;
(d) a copy of the invitation to participate in an organised event.
34) Paragraph 37 (2) of Act No. 500 / 2004 Coll., on Administrative Procedure, as amended. '
2. the following Sections 20a and 20b are inserted after Section 20, including footnote 35:
(1) The seller referred to in Article 20 (1) shall always state in each invitation to participate in an organised event referred to in Article 20:
(a) the address of the venue of the organised event, or any other precise identification of the venue of the organised event;
(b) the date of the organised action, including its expected timetable;
(c) the identification of the product or service to be promoted, offered, sold or provided as part of an organised action;
(d) the name, registered office and identification number of the person holding the organised action, if any, if any, of the natural person involved, or of the firm, its registered office and the identification number of the person, if any, and the identity details of their representative,
(e) where the seller is a different person from the person organising the organised action, his name, address and identification number, if any, if any, or business name, registered office and identification number, if applicable, and the identity of his representative, if established.
(2) Where an organised event is organised by an entrepreneur other than the seller, the undertaking shall be obliged to provide the information referred to in paragraph 1 in an invitation to participate in the organised event.
(1) Paragraphs 20 and 20a do not apply to the organisation of public auctions under the Specific Law 35).
(2) In the case of an event organised solely for the purpose of tasting, consumption and sale of tasting products, the provisions of Sections 20 and 20a shall not apply. This shall not apply where the promotion, offer or sale of other products or the provision of other services is part of such an action.
(3) In the case of an action organised solely for the purpose of the individual negotiation of an insurance contract, supplementary pension insurance, investment services or trade on the market in investment vehicles, the provisions of paragraphs 20 and 20a shall not apply.

3. In Article 24, the following paragraphs 8 and 9 are inserted after paragraph 7:
"(8) The seller referred to in Paragraph 20 (1) shall commit an administrative offence by:
a) does not notify the Czech Trade Inspection in accordance with § 20 (1);
b) does not make a notification to the Czech Trade Inspection within the time limit referred to in § 20 (3); or
(c) in the notification of the Czech Trade Inspection Office pursuant to § 20 (1) it shall provide false or incomplete information.
(9) The seller referred to in Article 20 (1) or a legal person or an undertaking natural person referred to in Article 20a (2) shall commit an administrative offence by not giving the information referred to in Article 20a (1) in an invitation to participate in an organised event, or by not giving it false or incomplete. ';
Paragraphs 8 to 11 shall be renumbered paragraphs 10 to 13.
4. In Article 24 (12) (b), "8 'is replaced by" 10'.
5. in Article 24 (12) (d), "paragraph 9" is replaced by "paragraphs 8, 9 and 11."
Efficacy
This Act shall take effect on the 15th day following its publication.
