DECLARATION
of 19 December 2012
amending Decree No. 82 / 2011 Coll., on the measurement of electricity and on the method of determining the compensation for unauthorised collection, unauthorised delivery, unauthorised transmission or unauthorised distribution of electricity
The Ministry of Industry and Trade provides pursuant to § 98a (1) (a) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of State Administration in the Energy Sector and on the amendment of certain laws (Energy Act), as amended by Act No. 158 / 2009 Coll. and Act No. 165 / 2012 Coll.:
Decree No. 82 / 2011 Coll., on the measurement of electricity and on the method of determining the compensation for unauthorised collection, unauthorised delivery, unauthorised transmission or unauthorised distribution of electricity, is amended as follows:
1. Paragraph 1 (2) reads as follows:
"(2) The measurement of electricity and the evaluation of data is used
(a) a type A measurement, which is a run-through measurement with remote daily data transmission, and a continuous record of the mean power value over the measurement interval is carried out directly by the measuring device; or
(b) the type B measurement, which is a run-through measurement with remote data transmission other than daily, and the continuous recording of the mean power value over the measurement interval shall be carried out directly by the measuring device; where it is not possible to transmit data remotely for technical reasons, data transmission may be carried out in another way; or
(c) type S measurements which are measurements with remote transmission of data which are neither type A nor type B measurements; if it is not possible to carry out remote transmission of data for technical reasons, the transmission of data may be carried out in another way; or
(d) type C measurements which are other measurements. ';
2. in Article 1 (3) (b), the words "for voltage above 1 kV" shall be replaced by the words "where appropriate."
3. in Article 2 (1) (e):
"(e) power transmission points with a voltage greater than 1 kV directly connected to the transmission or distribution system;"
4. in Article 2 (2) (b):
"(b) transmission points of power generation up to 1 kV directly connected to the distribution system,"
5. In Article 2, at the end of paragraph 2, the dot is replaced by a comma and the following point (g) is added:
"(g) electricity plants or, for each power source, electricity generation plants connected to a transmission system or distribution system, through another electricity plant.";
6. Paragraph 2 (4) reads as follows:
"(4) By measuring type S, electricity may be measured at customer demand points with a voltage up to 1 kV of electricity from the distribution system. ';
7. in Article 2 (5), the words "paragraph 7 'are replaced by the words" paragraph 6' and in point (a) the words "and at the transmission points of the electricity producers';
8. Paragraph 2 (6) and (8) are deleted.
Paragraph 7 shall become paragraph 6.
9. In Article 2, the following paragraph 7 is added:
"(7) In order to promote electricity from renewable energy sources or from secondary energy sources in the form of an annual green bonus, the electricity producer shall provide the power plant with an installed power up to 5 kW including separate measurement of the electricity produced by at least type C measurements. In case of the application of an hourly green bonus, the electricity producer shall ensure the measurement of the electricity produced by the measurement of type B. '
10. In the second sentence of Article 6 (1), the words "or transfer points' shall be inserted after the words" sampling points'.
11. in § 6 (1), the third sentence is: "The replacement of an electrical switchboard or the replacement of a supply line shall be regarded as a reconstruction for these purposes."
12. Paragraph 6 (5) reads:
"(5) At the request of the electricity manufacturer or the customer, and where the measurement allows, the transmission system operator or distribution system operator shall provide the electricity producer or the customer with an impulse measurement output continuously directly at the transmission point or at the sampling point. The provision of measured values by the distribution system operator through other communication interfaces of the electrometer shall not be allowed by the electricity producer or the customer without the consent of the transmission system operator or distribution system operator. ';
13. In Article 6, the following paragraph 6 is added:
"(6) In the transmission point of a power plant with a voltage up to 1 kV connected to the distribution system, the direction of the flow of electricity at each stage shall be evaluated for newly installed or changed measuring equipment. ';
14. In Section 10, the word "Annex 'is replaced by" Annex No 1';
15. the following Sections 10a to 10c are inserted after Section 10, including the title:
"Scope and dates of transmission of data to the market operator
The transmission system operator, transmission system operator and distribution system operators shall transmit to the market operator for the processing and recording of electricity production data for which a future connection contract or connection contract has been concluded and the deadline and conditions for the connection for:
(a) a statement on the issue of State authorisations for the construction of electricity generation to the Ministry; and
(b) the processing of the report on future expected electricity and gas consumption and the way in which the balance between supply and demand for electricity and gas is ensured.
(1) The transmission system operator or distribution system operator shall transmit to the market operator:
(a) data on the electricity generation plant within the scope of Annex 2 to this Regulation; and
(b) data on electricity generation plants to be excluded from the register by the market operator.
(2) The transmission system operator or gas distribution system operator shall transmit to the market operator the data relating to the electricity generation plant to the extent specified in Annex 3 to this Regulation if the electricity generation plant is connected to the gas system.
(2) The transmission system operator, transmission system operator and distribution system operators shall update the data referred to in Annex 2 and Annex 3 to this Regulation on the last day of the relevant quarter and transmit them to the market operator by the 15th day of the following month. ';
16. The Annex to this Decision is renumbered Annex 1 and the following Annexes 2 and 3 are added:

(f) For mills with installed power of 30 kW or more, the date of issue of the zoning information on the conditions of the zoning decision

Transitional provision
(1) The electricity producer whose electricity generation has been put into service by 31 December 2012 will equip the electricity generation plant with the measurement of electricity pursuant to Article 2 (2) (g) by 31 March 2013.
(2) For the first time, the transmission system operator and distribution system operators in electricity shall transmit to the market operator the data referred to in Article 10b (1) on the status by 31 December 2012 at the latest by 15 January 2013.
(3) The transmission system operator and distribution system operators in the gas industry shall, for the first time, transmit to the market operator the data referred to in Article 10b (2) on the status by 31 December 2012 at the latest by 15 January 2013.
Efficacy
This Decree shall take effect on 1 January 2013.
