ORDER
GOVERNMENTS OF THE CZECH REPUBLIC
of 20 November 2020
on the adoption of crisis measures
Following the Government Resolution No. 957 of 30 September 2020, the Government, in accordance with Articles 5 and 6 of Constitutional Act No. 110 / 1998 Coll., on the Security of the Czech Republic, declared emergency in accordance with Article 5 (a) to (e) and § 6 of the Act No. 240 / 2000 Coll., on emergency management and on the amendment of certain laws (Crisis Act), as amended, for the resolution of the crisis situation, the adoption of emergency measures within the meaning of § 5 (b) to (e) and § 6 (1) (b) of the Crisis Act.
The Government shall, with effect from 30 November 2020, limit from 00: 00 until 12 December 2020 to 23: 59.
1. the operation of universities pursuant to Act No. 111 / 1998 Coll., on Higher Education and amending and supplementing other laws (Act on Higher Education), as amended, including foreign universities and their branches operating in the territory of the Czech Republic (hereinafter referred to as "higher education"), by prohibiting the personal presence of students in teaching and examinations, if more than 10 persons take part at one time in the examination, in the study of higher education and participants in lifelong learning courses; the prohibition on the presence of students under this point shall not apply:
(a) to participate in the clinical and practical teaching and practice of students in general medical, dental, pharmacy and other medical studies programmes, and in educational and vocational training in primary, primary and secondary schools or educational institutions for the performance of constitutional and protective education;
(b) to participate in clinical and practical teaching and practice with external bodies;
(c) for laboratory, experimental or artistic teaching in the final year of the Bachelor's or Master's programme in the presence of a maximum of 20 students;
(d) study in the doctoral study programme;
(e) for individual consultations and individual visits to libraries for the purpose of receiving or submitting study literature;
2. the operation of higher education institutions by prohibiting the provision of accommodation to students of higher education who are resident in the Czech Republic, in the accommodation facilities of higher education institutions, with the exception of those who have been required by the Government to work under Act No. 240 / 2000 Coll., on crisis management and on the amendment of certain laws (Crisis Act), as amended, and students who may take part in education under point 1 (a), (b), (c) or (d);
3. the operation of secondary and higher vocational schools and conservatories pursuant to Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (the Education Act), as amended, by prohibiting the personal presence of pupils and students in secondary and higher vocational education in schools and in the Conservatory under the Education Act, with the exception of:
(a) schools established in establishments for the exercise of constitutional or protective education;
(b) schools established by the Ministry of Justice,
(c) practical training and training of pupils and students in health and social services establishments;
(d) pupils in the field of education Practical school of one year and Practical school of two years,
(e) individual consultation (only one pupil or student and one pedagogical worker),
(f) pupils of the final years and pupils of the fourth years of the six-year training programmes in the Conservatory;
(g) practical training and training in the presence of a maximum of 20 pupils or students;
(h) pupils of lower grades of six and eight years of Gymnasium and of the first to fourth years of the eight-year Conservatory Education Programme, in a way that education does not take part in the first half of the classes in an odd week and does not participate in the second half of the classes in an even week (for an odd number of classes, the number may be rounded),
(i) final examinations, graduation examinations, discharge and internationally recognised examinations;
with the fact that preschool teaching must take place in fixed classes, departments or groups of pupils or students,
4. the operation of primary schools under the Education Act by prohibiting the personal presence of pupils at primary school, except:
(a) primary schools for medical institutions;
(b) children in the preparatory class,
(c) pupils in grade 1 primary school;
(d) pupils of the ninth grade of primary school,
(e) pupils from the 6th to 8th grade of primary school, in the way that education does not take part in the first half of classes in an odd week and does not participate in the second half of classes in an even week (for an odd number of classes, the number may be rounded),
(f) special children at the preparatory stage of the primary school;
(g) schools established in establishments for the exercise of constitutional or protective education;
(h) primary schools or classes established under § 16 (9) of the Education Act;
(i) individual consultation (only one child or pupil, one pedagogical worker and possibly a legal representative),
having regard to the report of the Committee on Budgetary Control (A8-0021 / 2015),
5. the operation of primary arts schools, language schools with the right to state language examinations under the law of the school law and educational institutions providing one-year foreign language courses with daily training under Act No. 117 / 1995 Coll., on State Social Support, as amended, by prohibiting the personal presence of pupils in primary artistic education in primary art school and language education in a language school with the right to state language examinations including the participation of pupils and applicants in the state language examination, with the exception of:
(a) individual consultation or teaching (only one pupil, one pedagogical worker and possibly a legal representative),
(b) holding national language examinations with a maximum of 10 persons;
6. the operation of leisure centres by prohibiting the personal presence of children, pupils and students and other participants in such education, with the exception of individual consultation or training;
7. the operation of school clubs and school satellites by prohibiting the personal presence of children, pupils and students and other participants in such education, except for children or pupils who may participate in preschool training under this crisis measure, provided that only one class of preschool education is present in the department or group, and if it is not possible to do so, then in the case of a single-year school cooperative,
8. the operation of educational and accommodation facilities by prohibiting the provision of accommodation for pupils of schools and students of higher vocational schools under the Education Act who have a different residence in the Czech Republic, in educational establishments (youth home, boarding school), with the exception of pupils and students who have been assigned by the Government to work under the Crisis Act, and pupils and students who are allowed to take part in preschool training under this Crisis Measure, and prohibit school in nature and school trips;
9. the operation of schools and educational establishments under the Education Act and the operation of universities in such a way that there is no singing in education, except:
(a) nursery schools;
(b) the fields of secondary and higher vocational education and study programmes of universities and basic arts schools in which singing is a central part of the framework or accredited educational or study programme;
(c) leisure centres in activities where singing is the essence of interest education;
10. the operation of schools under the Education Act and the operation of universities by prohibiting sports activities as part of education, with the exception of:
(a) nursery schools;
(b) the fields of secondary and higher vocational education and the study programmes of universities and basic arts schools in which sport activities are a central part of the framework or accredited educational or study programme;
(c) leisure centres in activities where sport activity is the essence of interest education;
11. the operation of parent, primary and secondary schools, conservatories, higher vocational schools and school establishments, so that third-party access (excluding children, pupils, students or participants and staff) to the school premises or school facilities is possible only where strictly necessary, with the restriction of third-party contact with persons in the school premises.
