DECLARATION
of 30 November 2005
implementing certain provisions of the Renewable Resources Support Act
Pursuant to Article 12 (3) of Act No. 180 / 2005 Coll., on the promotion of the production of electricity from renewable energy sources and on the amendment of certain laws (Act on the Promotion of the Use of Renewable Resources) (hereinafter referred to as "the Act '), the Energy Regulatory Authority provides for the implementation of Sections 4 (3), 5 (3) and 6 (1) (b) (1) of the Act:
Subject matter
This decree sets out the dates and details of the choice of the method of aid for electricity produced from renewable sources, the dates of the notification of the intention to offer electricity produced from renewable sources for compulsory purchase and the technical and economic parameters.
Basic concepts
For the purposes of this decree:
(a) electricity produced from renewable sources - electricity produced from renewable sources at the production site measured at the transmission point of the distribution system operator and / or transmission system operator's network, or the terminal generation of electricity reduced by the technological self-consumption of electricity, in the case of combined combustion of biomass and non-renewable sources, the proportion of electricity from renewable sources;
(b) technological own electricity consumption - electricity consumption for electricity generation in the production of electricity or electricity and heat in the main production facility as well as ancillary plants directly related to production, including production, conversion or modification of fuel, distribution losses, own consumption as well as losses on increase transformers for supply to the distribution system or transmission system when invoicing measurements are installed on their primary side;
(c) other own electricity consumption - electricity from renewable sources which is eligible for a green bonus and which is effectively used by the manufacturer or by another natural or legal person without the use of a regional distribution system or transmission system;
(d) terminal electricity production - total electricity production measured at the terminals of generators installed in the production plant;
(e) weighted average cost of capital - weighted average expected interest rate on loans for investments in renewable energy projects and investor's expected return on equity in renewable energy projects.
Dates and details of the selection of the method of support and dates of notification of the intention to offer electricity produced from renewable sources for redemption
(1) The manufacturer shall notify the decision on the choice of the method of aid for electricity produced from renewable sources in its production plants in the form of a compulsory buyout provided for in Article 4 (4) of the Act to the transmission system operator or the relevant regional distribution system operator no later than one calendar month before the planned start of production.
(2) The manufacturer shall notify the change to the chosen mode of support to the TSO or the relevant regional distribution system operator by 30 November of the calendar year preceding the calendar year from which the change is to take place at the latest.
(3) The model for the notification of the choice of the form of aid for the production of electricity from renewable sources and its amendment is set out in Annex 1 to this Regulation.
(4) The transmission of data by the manufacturer on the estimated annual quantity of electricity produced from renewable sources and the quantity of electricity offered by the manufacturer to the relevant regional distribution system operator or transmission system operator for the mandatory purchase at the dates referred to in paragraph 5 shall be a prerequisite for the application of the aid by the compulsory buying-in. A manufacturer who does not exercise the right to aid in the form of a compulsory buyout and intends to use the aid in the form of green bonuses shall transmit the data on the estimated annual quantity of electricity produced in accordance with paragraph 5. The model of the report on the anticipated production of electricity produced from renewable sources is set out in Annex 2 to this Decree.
(5) The date for the notification of the estimated annual quantity of electricity produced from renewable sources to the transmission system operator or the relevant regional distribution system operator to be produced from renewable sources in the following calendar year and used for support is 31 August of each calendar year. For new production plants, the manufacturer shall transmit these data at least four months before the planned launch of the production plant.
(6) In the decision of the manufacturer to switch from the aid scheme by means of green bonuses to the ransom price scheme, the manufacturer shall be granted such a level of ransom prices as if the aid had not been implemented in the form of green bonuses and the aid was used in the form of a compulsory purchase throughout the past period.
(7) Models for the notification of the choice of the form of aid for the production of electricity from renewable sources and for the modification of electricity referred to in paragraph 3 and the reporting and transmission of data referred to in paragraph 4 shall also be provided by the Energy Regulatory Authority in a way enabling remote access.
Technical and economic parameters for the promotion of electricity produced from renewable sources by ransom prices
(1) In order to ensure a 15-year return on investment, applying the aid by means of purchase prices for electricity produced from renewable sources, compliance with the technical and economic parameters of the renewable electricity plant, where the producer of electricity from renewable sources at specified purchase prices achieves
(a) a reasonable return on the capital injected over the lifetime of the electricity production, which is determined by the average weighted cost of capital; and
(b) the non-negative size of the net present value of the post-tax cash flow over the lifetime of electricity generation, using a discount rate of the average weighted capital cost.
(2) Indicative values of the technical and economic parameters separately for the individual categories of renewable sources supported and selected technologies which enable the required economic criteria to be met in the production of electricity from renewable sources under paragraph 1 are set out in Annex 3 to this Decree.
Efficacy
This decree shall take effect on the day of its publication.

Water energy - Water power plants
1. Expected lifetime of the new plant: 30 years.
2. Requirement for the efficiency of primary energy use: The efficiency of the newly installed turbine is assumed to be at operating optimum ≥ 85% (measured on turbine coupling), for renovation of older types ≥ 80%.

The indicative parameters for biomass energy are based on biomass prices in 2011 at a normal level corresponding to its quality and quantity.
Biogas, landfill gas, sludge and mining gas from closed mines
1. The expected lifetime of the new plant burning landfill, sludge or mining gas for 15 years, and the biogas combustion plant 20 years.
2. Requirement for the efficiency of the use of primary energy content: For the production of combustion biogas for electricity generation, a rational use of waste heat is expected.

Geothermal energy - use of low potential heat
1. Expected lifetime of the new plant: 20 years.
2. Required efficiency of primary energy use: The energy potential of the geothermal energy source is assumed to be at least such that it can be permanently obtained by means of a heat transfer medium at a minimum thermal gain of 50 to 70 litres of water per second at a temperature of > 95 ° C per megawatt of the installed electrical power of the source.

Photovoltaic
1. Expected lifetime of the new plant: 20 years.
2. Requirement for the efficiency of primary energy use: The design and location of photovoltaic cells is envisaged to achieve annual terminal electricity production ≥ 150 kWh per square metre of active solar panel area. At the same time, a decrease in panel power of 0,8% of nominal output per year is expected.
