determining the scope of knowledge for obtaining a certificate proving knowledge of mushrooms, the method of examination, as well as the particulars of the application and certificate (Mushroom test order)
According to Article 19 (1) (h) of Act No. 110 / 1997 Coll., on Food and Tobacco Products and amending and supplementing certain related acts, as amended by Act No. 146 / 2002 Coll., (hereinafter referred to as "the Act"):
§ 1
Preliminary provisions
This Decree regulates the scope of knowledge to obtain a certificate proving the knowledge of wild and cultivated mushrooms, the method of testing, the particulars of the application and the certificate proving the knowledge of mushrooms requested by the applicant, which puts into circulation or uses for the production of wild or cultivated edible mushrooms intended for sale to the consumer or for further processing for food purposes, or an appointed representative of a legal person who is their producer, seller or importer (the applicant).
§ 2
Forms of application
(1) The applicant shall submit to the public health authority responsible for the place of residence of the natural person or the registered office of the legal person, if the designated representative of the legal person is the applicant for the knowledge test.
(2) In the application for a mushroom knowledge test, the applicant shall indicate:
(a) the name, surname and, where applicable, title, address of the place of permanent residence, date and place of birth, identity card or passport number, if any, if any, if it is a person with a residence permit;
(b) education achieved and its focus;
(c) the length and content of existing practice on the collection, sorting and processing of mushrooms.
(3) The application for examination shall be accompanied by the documents provided for in Article 3 (9) of the Act or by an officially certified copy of those documents.
Mushroom knowledge test
§ 3
(1) When testing the knowledge of fungi, the applicant shall demonstrate the knowledge of the legislation1) governing the division of fungi into groups and sub-groups, knowledge of the characteristics of individual groups and sub-groups of fungi, their quality and health requirements, marking, their collection, sorting and processing, their conditions of transport, storage, packaging and sales. Furthermore, the applicant must always demonstrate the ability to distinguish between edible and poisonous mushrooms according to visual aids such as atlas, knowledge of the causes of the most common poisoning of mushrooms, health manifestations of fungi and associated principles of first aid. The list of differentiated poisonous fungi is set out in Annex 2 to this Decree.
(2) The mushroom knowledge test shall consist of a written and oral part.
(3) The condition for acceptance of the oral part of the test is the successful conduct of a written test, which means the correct answer to at least two thirds of the questions in total and all questions concerning the toxicity of fungi.
§ 4
(1) The test of knowledge of fungi shall be carried out before the Examination Board (hereinafter referred to as the "Commission") established by the Public Health Protection Authority. The Commission shall be a three-member and shall be chaired by a university-educated person active in the field of health protection in the food safety sector for at least 5 years.
(2) The public health authority shall inform the applicant of the site, date and hour of the examination at least 14 days before the examination.
(3) The Commission shall act by a majority vote. If the candidate has succeeded in both the written and oral part of the examination, the panel shall evaluate the result of the examination by saying "succeeded '. If the candidate failed in the written or oral part of the examination, the panel shall evaluate the result of the examination by saying" failed'.
§ 5
(1) A report shall be drawn up by the commission on the course of the knowledge test, indicating:
(a) the names and surnames of the members of the Commission;
(b) the date and place of holding of the written and oral part of the mushroom knowledge test;
(c) the list of tenderers and the results of their evaluation;
(d) the date of completion of the Protocol.
(2) The annex to the report shall include written tests.
(3) The Protocol is signed by all members of the Commission. The Protocol shall be deposited with the Public Health Protection Authority established by the Examination Board.
§ 6
Certification
(1) The public health authority shall issue a certificate to the applicant who has successfully passed the test of knowledge of mushrooms, the particulars of which are set out in Annex 1 to this Decree.
(2) An applicant who has failed to pass the mushroom knowledge test may repeat the test not earlier than 2 months.
(3) In the context of the expiry of the certificate at the end of the period specified since its issue [Paragraph 21 (10) (b), (c), (d)], the holder of the certificate may submit an application for an examination under this Order.
§ 7
Efficacy
This Decree shall take effect on 1 January 2003.
