GOVERNMENT REGULATION
of 21 December 2009
amending Government Regulation No. 77 / 2008 Coll., on the establishment of thresholds for the purposes of the Act on Public Procurement, on the definition of goods acquired by the Czech Republic - Ministry of Defence, for which a specific financial limit applies, and on the conversion of amounts laid down in the Act on Public Procurement in Euro into Czech currency, and Government Regulation No. 78 / 2008 Coll., establishing financial limits for the purposes of the Concession Act
The Government mandates pursuant to § 159 (1) of Act No. 137 / 2006 Coll., on Public Procurement, as amended by Act No. 76 / 2008 Coll., and under § 34 (3) of Act No. 139 / 2006 Coll., on Concession Contracts and Concession Procedure (Concession Act), as amended by Act No. 30 / 2008 Coll.:
Amendment of Government Decree No. 77 / 2008 Coll., on the setting of the thresholds for the purposes of the Act on Public Procurement, on the definition of goods procured by the Czech Republic - Ministry of Defence, for which a specific financial limit applies, and on the conversion into Czech currency of the amounts set out in the Act on Public Procurement in Euro
Government Decree No. 77 / 2008 Coll., on the determination of the thresholds for the purposes of the Act on Public Procurement, on the definition of goods acquired by the Czech Republic - Ministry of Defence, for which a specific financial limit applies, and on the conversion of amounts laid down in the Act on Public Procurement in Euro into Czech currency, is amended as follows:
1. in footnote 1, third sentence, the words "and 2004 / 18 / EC (2007 / C 301 / 01) 'are replaced by the words", 2004 / 18 / EC and 2009 / 81 / EC (2009 / C 292 / 01)';
2. footnote 2 shall read:
"(2) Commission Regulation (EC) No 1177 / 2009 of 30 November 2009 amending Directives 2004 / 17 / EC, 2004 / 18 / EC and 2009 / 81 / EC of the European Parliament and of the Council as regards the thresholds applicable to public procurement procedures."
3. in Paragraph 2 (1) (a), "3 782 000" is replaced by "3 236 000."
4. in Paragraph 2 (1) (b), "5 857 000" is replaced by "4 997 000."
5. in Paragraph 2 (1) (c), "11 715 000" is replaced by "10 020 000."
6. in Paragraph 2 (2) (a), "3 782 000" is replaced by "3 236 000."
7. in Article 2 (2) (b), "5 857 000" is replaced by "4 997 000."
8. in Paragraph 2 (2) (c), "11 715 000" is replaced by "10 020 000."
9. in Paragraph 2 (3), "146 447 000" is replaced by "125 451 000."
10. in Article 3 (a), "21 327 000" is replaced by "19 419 000."
11. in Article 3 (b), "2 274 000" is replaced by "2 071 000."
12. in § 3 (c), "28436 000" is replaced by "25893 000."
Amendment of Decree No. 78 / 2008 Coll., establishing financial limits for the purposes of the concession law
Government Regulation No. 78 / 2008 Coll., setting financial limits for the purposes of the concession law, is amended as follows:
1. in footnote 1, third sentence, the words "and 2004 / 18 / EC (2007 / C 301 / 01) 'are replaced by the words", 2004 / 18 / EC and 2009 / 81 / EC (2009 / C 292 / 01)';
2. footnote 2 shall read:

This Regulation shall enter into force on 1 January 2010.
