Act of the Czech National Council on Measures in the System of Central Authorities of the Czech Republic

THE LAW
Czech National Council
of 23 September 1992
on measures in the system of central government bodies of the Czech Republic
The Czech National Council decided on this law:
Čl. I
(1) The following central government bodies of the Czech Republic are hereby established, headed by a member of the Government of the Czech Republic:
(a) Ministry of Economy,
(b) Ministry of Industry and Trade,
(c) the Ministry of Competition.
(2) The seat of the Ministry of Competition is Brno.
(3) The following central government bodies of the Czech Republic are hereby repealed:
(a) the Ministry of Economic Policy and Development;
(b) Ministry of Industry,
(c) Ministry of Trade and Tourism,
(d) Czech Competition Authority.
(4) The existing scope resulting from the laws and other generally binding legislation passes,
(a) the Ministry of Economic Policy and Development;
1. in the fields of energy, heating, gas, oil and gas extraction, mining, treatment and refining of solid fuels, ores, radioactive raw materials and magnesite and the production of foreign economic policy including foreign investment and the management of the Czech Energy Inspection to the Ministry of Industry and Trade;
2. in matters of scientific policy and technological development for the Ministry of Education, Youth and Sports;
3. in other matters, to the Ministry of Economic Affairs,
(b) from the Ministry of Industry to the Ministry of Industry and Trade;
(c) from the Ministry of Trade and Tourism
1. on tourism and the private business of citizens at the Ministry of Economic Affairs,
2. on other matters to the Ministry of Industry and Trade,
(d) from the Czech Competition Authority to the Ministry of Competition,
(e) from the Ministry of Education, Youth and Sports on vocational training of apprentices for the Ministry of Economic Affairs,
(f) the Ministry of the Interior on local economy, paid services and local production, public utility services and housing management and non-residential premises for the Ministry of Economy,
(g) the Ministry of Forestry Agriculture, with the exception of the economic management of forests and the exercise of the right of forest management owned by the Czech Republic, to the Ministry of the Environment,
(h) from the Ministry of Social Welfare to the Ministry of Labour and Social Affairs,
(i) from the Ministry of the Environment in matters relating to zoning and construction rules to the Ministry of Economy.
(5) The rights and obligations arising from employment and other relationships shall be transferred in the context of the transition referred to in paragraph 4:
(a) from the Ministry of Economic Policy and Development to the Ministry of Industry and Trade, the Ministry of Education, Youth and Sports and the Ministry of Economic Affairs,
(b) from the Ministry of Industry to the Ministry of Industry and Trade;
(c) from the Ministry of Trade and Tourism to the Ministry of Economy and the Ministry of Industry and Trade;
(d) from the Czech Competition Authority to the Ministry of Competition,
(e) from the Ministry of Education, Youth and Sports to the Ministry of Economic Affairs,
(f) from the Ministry of the Interior to the Ministry of Economy,
(g) from the Ministry of Agriculture to the Ministry of the Environment,
(h) from the Ministry of Health to the Ministry of Labour and Social Affairs;
(i) from the Ministry of the Environment to the Ministry of Economic Affairs.
(6) The transfer of rights and obligations referred to in paragraph 5 shall be concluded by the ministries of the economy, industry and trade, labour and social affairs, health, education, youth and sports, interior, agriculture and the environment of the relevant agreements, specifying between them those rights and obligations. The ministries shall conclude the de-limitation protocols on transfers of appropriations.
(7) An Office for Legislation and Public Administration of the Czech Republic is hereby established.
Čl. II

1. Paragraph 1 (1) reads as follows:

4. In Section 1, point 14 is deleted.
5. in Paragraph 2 (1), point 6 shall be deleted;

„§ 3
(1) The Ministry of Economic Affairs is the central body of government in matters of small and medium-sized enterprises, trade, tourism, professional training of apprentices in the field of occupation, the creation of a single raw material policy, the exploitation of mineral wealth and geological research, regional policy, housing policy, the development of the home and housing funds, and the rental of flats and non-residential premises, for territorial planning and building order, investment policy, technology and technology development, state information system, technical standardisation, metrology and state testing.
(2) The Ministry of Economic Affairs is the central authority of the State Administration for Road and Urban Transport, Special Destination Railways, Infrastructure, Inland Navigation, Waterways and Civil Aviation, excluding air transport.
(3) The Ministry of Economic Affairs is the central authority of the State Administration for Postal and Telecommunications, with the exception of the administration of the frequency spectrum for radio and television broadcasting.
(4) The Ministry of Economic Affairs is the central body of the State Administration for Economic Mobilisation and the economic measures necessary to safeguard defence. "
7. In Section 4, the words "investment companies and investment funds' are inserted after the words" financial market 'and the words "investment companies and investment funds' are deleted.
(8) Article 6 (3) shall be added as follows:
"(3) The Ministry of International Relations is also the central body of the state administration for the creation and implementation of the international foreign aid policy of the Czech Republic, the provision of contacts with the United Nations, the European Communities and other international organisations, the coordination of bilateral and multilateral cooperation relations, the preparation of staff for the performance of foreign services."
9. In Section 7, the words "with the exception of matters falling within the competence of the Ministry of Economic Affairs, for scientific policy and technological development 'are inserted after the words" primary, secondary and higher education institutions'.
10. In Section 9, the words "except for health care for disabled citizens," are deleted.

„§ 10
(1) The Ministry of Health is the central body of the State Administration for Health, Public Health Protection, Medical Scientific Research, Medical Education, Medical Facilities under direct management, search, protection and use of natural medical resources, natural medical baths and natural mineral water sources, pharmaceuticals and medical devices for the prevention, diagnosis and treatment of people, health insurance and health information system.
(2) The main hygienist of the Czech Republic is established as a public health authority in the Ministry of Health.
(3) Part of the Ministry of Health is the Czech Inspectorate of Spa and Rays. "
12. in Article 12, paragraph 3 is deleted.

„§ 13
(1) The Ministry of Industry and Trade is the central body of the state administration for:
(a) State industrial policy, commercial policy, foreign economic policy, energy, heating, gas, oil and gas mining, treatment and refining, solid fuels, radioactive raw materials, ores and minerals;
(b) metallurgy, engineering, electrical engineering and electronics, chemical and oil processing industry, rubber and plastics, glass and ceramics, textile and clothing, leather and polygraphic, paper and cellulose and wood pulp and for the manufacture of building materials, construction, medical production, collection materials and metal waste;
(c) for internal trade and protection of consumers' interests, foreign trade.
(2) The Ministry of Industry and Trade is the central body of the state administration in commodity exchanges, with the exception of cases falling within the competence of the Ministry of Agriculture.
(3) The Ministry of Industry and Trade manages the State Service for Precious metals.
(4) The Ministry of Industry and Trade is subordinate to the Czech Energy Inspection and the Czech Trade Inspection. "
14. A new Paragraph 14 shall be added to the place of cancellation:
„§ 14
The Ministry of Competition shall be the central body of the State Administration for the Promotion of Competition and Protection against Illicit Restriction. ';

„§ 15
(1) The Ministry of Agriculture is the central authority of the State Administration for Agriculture, with the exception of the protection of the Agricultural Soil Fund, for the economic management of forests, for the exercise of the right of forest management owned by the Czech Republic, for hunting and fishing, with the exception of national parks, and for the food industry.
(2) The Ministry of Agriculture is the central body of the state administration in commodity exchanges which organise trade in goods originating in agricultural and forestry production, including products resulting from its processing.
(3) The Ministry of Agriculture manages the Czech Agricultural and Food Inspection, the State Veterinary Administration of the Czech Republic, the Central Audit and Examination Institute of the Agricultural and Czech Inspectorate for Breeding and Breeding of livestock.
(4) The Ministry of Agriculture is subordinate to the Institute for the Economic Treatment of Forests, the Research Institute of Forestry and Hunting and the Education and Education Administration. '
16. Paragraph 17 is deleted.
17.
"(2) The Ministry of the Environment is the central body of the State Administration for Water and Forestry (except for items falling within the competence of the Ministry of Agriculture), Air Protection, Nature Protection, Agricultural and Forestry Fund Protection, State Geological Service, Mineral Property Protection, Environmental Control and Waste Management. '
Paragraph 19 (6) reads as follows:
"(6) The Ministry of the Environment is subordinate to the Czech Environmental Inspection and the Czech Hydrometeorological Institute."
19. The following Section 28a is inserted after Section 28:
„§ 28a
(1) The Office for Legislation and Public Administration of the Czech Republic performs the tasks related to the legislative activity of the Government of the Czech Republic and those resulting from the reform of public administration.
(2) The head of the Office for Legislation and Public Administration of the Czech Republic is the Vice-President of the Government of the Czech Republic, who manages its activities.
(3) The Government of the Czech Republic may set up the Legislative Council as its advisory body. It is headed by the Deputy Prime Minister responsible for the administration of the Office of Legislation and Public Administration of the Czech Republic. "
Čl. III
The Act of the Czech National Council No. 173 / 1991 Coll., on the establishment of the Czech Competition Authority is hereby repealed.
Čl. IV
Act of the Czech National Council No. 103 / 1992 Coll., on the Council of the Czech Republic for Radio and Television Broadcasting, is added as follows:
In Article 2 (1), the following point (j) is inserted:
"(j) to conduct public administration in the field of spectrum management for radio and television broadcasting."
Čl. V
This Law shall take effect on 31 October 1992.
