GOVERNMENT REGULATION
of 16 November 2009
amending Decree No. 197 / 2003 Coll., on the Waste Management Plan of the Czech Republic
The Government orders pursuant to § 42 (3) of Act No. 185 / 2001 Coll., on Waste and on the amendment of certain other laws, as amended by Act No. 188 / 2004 Coll.:
Government Decree No. 197 / 2003 Coll., on Waste Management Plan of the Czech Republic, is amended as follows:
1. in the Annex, point 4 (i) is deleted;
Points (j) to (o) shall be renumbered (i) to (n).
2. In the Annex, points (g) to (i) are replaced by the following:
"(g) assess mixed municipal waste, including where it has undergone only mechanical treatment, gravity separation of density fractions or similar treatment which has not substantially altered its characteristics, in accordance with Article 3 (5) of Regulation (EC) No 1013 / 2006 of the European Parliament and of the Council on shipments of waste, as amended;
h) do not allow cross-border shipments of waste to the Czech Republic for the purpose of energy recovery in municipal waste incineration plants if, as a result of cross-border shipments, waste generated in the Czech Republic would have to be disposed of;
(i) do not allow cross-border shipments of waste to the Czech Republic for energy recovery purposes if, as a result of cross-border shipments, waste generated in the Czech Republic would have to be treated in a way which does not comply with this plan or the plans for the waste management of regions. "
Efficacy
This Regulation shall enter into force on the day of its publication.
