DECLARATION
of 9 October 2006
amending Decree No 368 / 2001 of the Office for the Protection of Competition Coll., laying down details of the elements of the proposal for the authorisation of the concentration of competitors, as amended by Decree No 407 / 2005 Coll.
According to Article 26 of Act No. 143 / 2001 Coll., on the Protection of Competition and on the amendment of certain laws (Law on the Protection of Competition), as amended by Act No. 340 / 2004 Coll., Act No. 484 / 2004 Coll., Act No. 127 / 2005 Coll. and Act No. 361 / 2005 Coll.:
Decree No. 368 / 2001 Coll., laying down details of the details of the application for the authorisation of the concentration of competitors, as amended by Decree No. 407 / 2005 Coll., is amended as follows:
1. In Part 8 of the Annex, point 8.7, including the title, is deleted.
2. In the Annex, the following Part 9 is inserted after Part 8:
9. Connection with the Community dimension
9.1. Indicate whether the proposed concentration of competitors complies with the turnover criteria set out in Article 1 of Council Regulation (EC) No 139 / 2004 of 20 January 2004 on the control of concentrations between undertakings (the Merger Regulation) and, if so, whether it is a concentration with the Community dimension pursuant to Article 1 (2) or Article 1 (3) of the Merger Regulation.
9.2. Where the proposed concentration meets the turnover criteria set out in Article 1 (2) or Article 1 (3) The Merger Regulation, but each of the merging competitors, will reach more than two thirds of its total turnover within the European Community in one and the same Member State of the European Union, indicate the turnover of each of the merging competitors in the last financial year, calculated in accordance with Article 14 of the Act, achieved on the European Community market, and the State in which such two thirds of the turnover was achieved.
9.3. Indicate all other States whose authorities are also competent to assess the concentration of competitors in question and whether or not a proposal for authorisation has been submitted in those States. '
Part 9 is renumbered Part 10.
3. In Part 10 of the Annex, the numerical indication of point 9 is deleted.
This Decree shall take effect on 1 November 2006.
