on technical safety oversight of water components
The Ministry of Agriculture provides, pursuant to Articles 61 (3) and 62 (2) of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act):
Subject matter
This Decree defines technical safety oversight of water components (hereinafter referred to as "supervision ') and provides for:
(a) criteria and procedures for classifying water works into categories;
(b) the scope and frequency of supervision of each category of water works and at each stage of their preparation, construction, modification of the finished construction of the water works or operation;
(c) the elements of the surveillance programme;
(d) the formalities for processing the scope of the supervisory measurement;
(e) processing of the results of observations and measurements; and
(f) the extent of the data and the manner in which the supervisory records are kept.
Basic concepts
For the purposes of this decree:
(a) alert limit - informative criterion for phenomena and events before reaching limit or critical values;
(b) limit value - predetermined limit value of the variable describing the phenomenon or reality, or its time development for the selected load condition,
(c) critical value - value of the variable describing the phenomenon or fact indicating the state of danger to the safety and stability of the water works;
(d) the stage of preparation of the construction of the waterworks - the processing of documentation for the authorisation of the construction of the waterworks or the documentation of the plan of common facilities (11);
(e) by changing the finished construction of the water works - intervention in the water works which results in a change of purpose or technical parameters;
(f) the stage of construction or the change of the finished construction of the water works - the implementation of construction and assembly work on the sifting structure, functional objects or parts of the water works which determine its stability, safety and reliable function from taking over the construction site to the start of the operation stage;
(g) stage of the verification operation - the period of the first load of the water work or part of it with air water, including the testing of operations to the extent that the fulfilment of the project assumptions, reliable function, safety and stability of the water work can be assessed;
(h) the stage of continuous operation - the period of use of the waterworks from the end of the verification operation to the end of the obligation to ensure supervision of the waterworks; for water works where the stage of the verification operation cannot be ensured, from the period of the first load to the end of the obligation to ensure supervision of the water part,
(i) designated water works - water works which have been determined pursuant to § 61 (7) of the Water Act to ensure supervision or water works subject to supervision under § 61 (2) of the Water Act, if they existed before 1 April 1975.
Determination of criteria and procedures for classifying water works into categories
(1) The criteria for the classification of water works in categories I to IV from a supervisory point of view are set out in Annex 1 to this Decree.
(2) The inclusion of a water work in one of the four categories shall be carried out according to the size of the possible damage which may occur in the event of a failure of the stability and safety of the water work accompanied by the emergence of a flood wave of a special flood. The amount of potential damage is calculated by means of the potential damage (P) as the sum of the points of assessment of the potential threat to human lives, possible losses on property in the adjacent territory and possible losses from the limitation of public interest functions and benefits that would have occurred in the course of the water work accident on and below the work.
(3) The calculation of the potential of damage (P) is carried out by the mandate.3) in the framework of the preparation of an assessment for the classification of a waterworks in a category based on:
(a) quantification of the parameters of the specific flood and its effects under water;
(b) a point assessment of the possible damage that may arise from a waterworks accident.
(4) The water work is proposed to be classified into one of four categories according to the achieved number of damage potential points (P)

(5) The assessment for the classification of the water works into the category and the design of the conditions of supervision shall be carried out at the stage of preparation of the construction of the water works and shall include the determination of the degree of safety of the water works during the floods and evaluation of the design and assessment of parameters of the safety and discharge installations according to the regulation governing the requirements for construction and according to Czech technical standard CSN 75 29 35 Assessment of the safety of water works during the floods.
(6) The reason for changing the category of the designated water works may also be the change in the finished construction of the water works, the change in the purpose of using the designated water works or the change in the use of the territory or part thereof under the designated water works.
Scope and frequency of supervision
(1) The methods, scope and frequency of supervision shall be governed by:
(a) categories of designated water works;
(b) the stage of the designated water work referred to in Article 2;
(c) the type of designated water work with regard to operating conditions and loading conditions;
(d) the technical state of the designated water works.
(2) At the stage of the preparation of the construction or modification of the finished construction of the water works, supervision is ensured for the designated water works from Category I to Category III by processing the document of the scope of the supervision measurement according to Section 6. This document shall be processed for a designated Category IV waterwork at the stage of preparation of the construction or modification of the finished waterwork if the obligation to submit the scope of the surveillance measurement is imposed on the owner or, where applicable, the builder by the competent construction office as a condition of overseeing (1).
(3) At the stage of construction or modification of the finished construction of the designated water works, at the stage of verification operation and at the stage of permanent operation of the designated water works from Category I to Category III, supervision shall be carried out
(a) the processing of the surveillance programme;
(b) by observing and measuring the identified phenomena and the facts set out in the surveillance programme;
(c) by walking;
(d) the processing of supervisory reports with proposals for measures to address identified deficiencies;
(e) inspections;
(f) assessing the results of all observations and measurements.
(4) For the designated water works category I to III, changes and occurrences of phenomena and facts are always monitored to the extent specified in Annex 2 to this Decree.
(5) Supervision of the designated water works of Category IV at the stage of construction or the change of the finished construction of the water works, in the stage of verification operation and in the phase of continuous operation is carried out by cross-checks with monitoring and recording of water level height. In cases of occurrence of unusual phenomena or events, the measurement of the surveillance values according to Annex 2 to this Decree shall be carried out.
(6) In the case of drains where the load of the dam system is gradually increased, supervision shall be performed as at the stage of the verification operation throughout their operation. This also applies to cases of reclamation of the drain until complete completion.
(7) For designated water works where it is not possible to secure the verification phase, the scope and frequency of supervision shall be determined according to the operating modes and load of the designated water works. In a situation without water loading, the frequency or extent of surveillance may be reduced.
Processing of the scope of the supervisory measurement
(1) The scope of the surveillance measurement is a technical document which contains the scope and manner of measurement and observation of the designated water work as well as the design of the related equipment and apparatus needed to ensure measurement. It shall be processed by the authorised person (3) at the latest at the stage of the preparation of the construction of the waterwork or in the preparation of documentation for the permit or modification of the completed construction of the waterwork.
(2) The scope of the supervisory measurement includes:
(a) a description and analysis of the risks associated with the existence of a designated water work or the change in the finished construction of a water work in the environment and operation concerned;
(b) requirements for research and project work in excess of the project documentation already drawn up for the permit of the construction, the documentation of the joint equipment plan or the change of construction of the finished water work;
(c) an overview of the important assumptions of the safety and stability of the designated water works for the relevant stage of construction or operation of the designated water works and a proposal for a method of monitoring phenomena and facts;
(d) design of methods of measurement and observation, their scope and accuracy of instruments and devices for monitoring;
(e) an overview of the limit values of the observed phenomena and facts affecting the safety and stability of the designated water work and its endangered territory;
(f) design of safe access to measuring equipment and of measures to ensure the safe performance of measuring and maintenance of measuring equipment, including their protection against damage;
(g) the timetable for installation and first measurements according to the construction process or the change in the finished construction of the water works;
(h) requirements for the renewal and modernisation of measuring instruments and equipment;
(i) a draft period during which measurements and observations will be carried out;
(j) documentation of inspection facilities.
Surveillance programme and its content
(1) The surveillance programme is a technical document which contains the scope and provision of activities that are relevant to the safety and stability of the designated waterworks. It serves for the supervision of water works in each stage.
(2) The surveillance programme shall include:
(a) the contact details of the authorised person3) and the natural person responsible for the surveillance 2), the relevant flood authorities 9) and the fire brigade of the relevant county;
(b) the frequency of rounds, observations and measurements of phenomena and facts relevant to the safety and stability of the designated water work;
(c) the subject matter and extent of the observations, measurements and rounds, as well as the method of recording their results;
(d) working procedures for observation and measurement;
(e) instructions for the operation of the designated waterworks, which report the results of observations, measurements or rounds without delay to the designated natural person responsible for the surveillance 2) and to the authorised person, 3)
(f) guidance on alternative measurement and transmission of results in the event of failure of the monitoring system, if introduced on the designated water work, including frequency of control verification measurements or readings carried out manually;
(g) the arrangements and dates for the processing and evaluation of the results obtained in the supervisory reports referred to in Article 10;
(h) the supervisory reporting regime;
(i) references to documentation of integrated measuring instruments and equipment;
(j) the limit or, where appropriate, the critical values of the phenomena and facts monitored and their time evolution;
(k) limits on the vigilance of the phenomena and facts observed;
(l) data on the parameters of the specific flood caused by a failure of the fictitious structure of the designated waterwork, a failure to seal or cover its safety overflows and discharge devices, or an emergency solution to the critical situations thereof, and the link of these situations to the supervision and degree of flood activity4) or declared emergency status, 5)
(m) the location of the supervisory programme.
Processing of observation and measurement results
(1) The results of the observations and measurements are immediately compared to pre-established vigilance limits or limit or critical values, if any, and their expected time developments.
(2) The results of the observations, measurements and rounds shall be recorded without delay to the extent and in the manner specified in the surveillance programme. The determination of limit or critical values shall be reported by the operator of the designated waterwork to the natural person responsible for the supervision 2) and the authorised person.3)
(3) The results of all measurements, observations and rounds on the designated water work shall be kept for the entire duration of the water work.
Tours
(1) During the rounds, the designated water work and its nearby surroundings shall be monitored, flow rates, regularity of operation of all mechanisms, the occurrence of cracks and visible deformations, shifts and slides, the occurrence of leaks, vents and infested up to derelict sites, the effects of operation and the environment on the technical state of the objects and technological equipment, in particular the design of discharge, tidal and sampling devices.
(2) The rounds are carried out by the operator of the designated water works on a specified route at least once a day for the designated water works of Category I, at least three times a week for the designated water works of Category II, at least once a week for the designated water works of Category III and at least once a month for the designated water works of Category IV.
(3) In justified cases, the authorised person (3) in the surveillance programme may reduce or adjust the frequency of the rounds to better suit the climatic conditions, loading condition and nature of the designated waterwork.
Surveillance reports
(1) Supervision shall be processed at the stage of construction or the change in the completed construction of the designated waterworks of the surveillance sub-report and the summary report on supervision, at the stage of the verification operation of the surveillance sub-report and the overall supervisory report and at the stage of continuous operation of the surveillance phase and the aggregated surveillance phase report.
(2) The supervisory sub-reports shall be processed in terms specified in the surveillance programme. The summary report on the surveillance during the construction phase or the change in the finished construction of the water works shall be prepared no later than before the start of the verification operation and the overall surveillance report no later than before the start of the permanent operation of the designated water works. Stage surveillance reports at the stage of permanent operation shall be processed for the date of the inspection of the designated water works. Each fifth stage supervisory report shall be processed as a summary phase supervisory report.
(3) Surveillance reports shall include an evaluation of the results of observations, measurements and rounds, in relation to pre-established limit and critical values, and, where appropriate, limitations on vigilance, project documentation parameters, knowledge from the construction and operation of the designated water works.
(4) The details of each type of supervisory report are set out in Annex 3 to this Regulation.
Tours
(1) The inspections carried out under the supervision provided for in Section 62 (5) (b) of the Water Act include an evaluation of:
(a) operational capabilities and functional reliability in relation to the safety and stability of the designated water work;
(b) unusual facts arising from operations;
(c) the exercise of supervision.
(2) Proposals for corrective measures and planned implementation dates and suggestions for improving the technical condition, use, operation and maintenance to improve the safety and stability of the designated water works shall be discussed during the inspections.
(3) The inspection of the designated waterworks shall be carried out by registration, the content of which is laid down in Annex 4 to this Order.
Scope of the owner's or builder's participation in supervisory activities
The owner or, where applicable, the builder of the designated water works shall participate in the supervision of the designated water works from Category I to Category III in such a way that:
(a) collect the results of observations, measurements and rounds and transmit them for evaluation by the authorised person (3) within the deadlines set by the surveillance programme;
(b) ensure the maintenance and repair of measuring equipment;
(c) to convene, participate and register, as appropriate, regular and exceptional inspections;
(d) be aware in advance of the person responsible (3) of the preparation of design and construction work or of other interventions in and around the designated water works, where they may affect the safety and stability of the designated water works or the results of control measurements;
(e) inform the authorised person (3) of the processing and approval of the handling orders of the designated waterwork.
Surveillance records
(1) Surveillance records cover water works classified in category I to IV in terms of supervision. The surveillance record shall contain the information set out in Annex 5 to this Regulation.
(2) Authorised persons who supervise the designated water part shall keep a register of the surveillance in electronic form and to the extent set out in Annex 5 to this Regulation, with the exception of information to be supplemented by the competent building authority.
(3) The construction office for Category IV water works not supervised by the authorised person shall keep a surveillance record in electronic form and to the extent set out in Annex 5 to this Regulation, except for information which is mandatory only for Category I to Category III waterworks.
(4) The construction authorities and authorised persons shall remove any discrepancies identified in the surveillance record immediately after they have been established.
Transitional and final provisions
A supervisory programme prepared under the existing legislation (6) shall be deemed to have been processed under this Regulation if, within two years of the entry into force of this Regulation, it is supplemented by the data referred to in Article 7 (2) (j).
Efficacy
This Decree shall take effect on 1 January 2002.

OVERVIEW OF RELATED YEEVES AND FACTS
When carrying out surveillance, the following shall in particular be monitored according to the type and type of designated water work:
(a) the static and dynamic stability of the sifting structure and related objects of the designated water work, or parts thereof,
(b) deformation of the designated water work, mutual displacement of individual parts of structures, cracks in the construction material;
(c) deformation of the subsoil;
(d) the physical mechanical properties of construction and support materials;
(e) the groundwater and leakage water regime, i.e. water pressure, continuity, direction and speed of water flow in the area of the designated water work;
(f) the function of the protective, sealants, filtration and drainage elements of the designed water work and its substrates;
(g) hydraulic gradient in structural and ground materials and their filtration stability;
(h) environmental effects on the technical condition of the designated water work and its technological equipment, i.e. the effects of the weather (especially frost and wave), the landslides of the banks of the water tank and the landslides and slides in the vicinity of the designated water work, the aggressive effects of the air and water in the water tank and the abatement, the impact of the groundwater, the effects of the construction and tear works in the vicinity of the designated water work, earthquakes, undermining, operational and transport shocks, vegetation, animals and unauthorised interventions by third parties;
(i) the effect of operation on the technical condition of the designated water work and its technological equipment, i.e. the effects of water handling in the water tank and storage tank, the mechanical and other effects of the discharged water and drifting materials, the wear and possible consequences of failure of the closures and of the paying structures of the discharge, overflows and sampling facilities;
j) status and function of safety and discharge devices according to Czech technical standard ČSN 75 29 35 Assessment of the safety of water works in floods, their control and the capacity of equipment compared to the applicable standards of other phenomena and facts that can affect the safety, stability and mechanical strength of the designated water works according to local conditions.
For a designated water work
Category I shall be monitored for all phenomena and facts the change of which can objectively indicate or cause the project documentation to exceed the assumptions of the project documentation to such an extent that the degree of stability of the designated waterwork or significant part thereof would fall below the permissible limit given by the technical standard (8). The weather and operational conditions shall be determined to the extent necessary for the assessment of all the phenomena and facts observed. Measurements shall be carried out not only in places characterised by average ratios, but also in places where, above all, discontinuous development of phenomena could occur, e.g. failures in the foundations, changes in connection of sealing and drainage elements, etc. In doubt about the reliability of the method of monitoring the most important phenomena and facts, the mandator3) sets out more measurement methods.
Category II is the scope of supervision similar to Category I, with no need to monitor events and facts, the existence of which, where appropriate, a disproportionate change, may be derived from another phenomenon or aggregate phenomenon, such as total leakage and deformation or displacement. Measurements are usually concentrated in characteristic profiles. Only weather and operational conditions are detected which immediately clarify the phenomena and facts observed.
Category III supervision shall be carried out by assessing the phenomena, facts and their development, as a general rule at rounds. The measurement of leakage, water pressures and total deformations on the surface of the specified water work is introduced from normal measurements. Water levels and water flow in the tank, air temperature and precipitation shall be determined from the weather and operational conditions.
Category IV supervision shall be carried out by assessing the phenomena and facts and by comparing them with the findings of previous rounds. Each tour shall be recorded in writing.

IMPLEMENTATION OF SINGLE SPECIES OF SUPERVISORY REPORTS
1. The supervisory sub-reports shall contain:
(a) an overview of the process of construction or modification of the finished construction of the designated water works, changes in loading conditions, procedure in installation of measuring equipment;
(b) an overview of all results of observations and measurements;
(c) findings from rounds,
(d) an assessment of the phenomena observed and the facts established, any proposals for corrective measures.
2. The summary supervisory reports shall contain:
(a) a description of the surveillance;
(b) documentation of the location and description of all the measurement instruments and equipment installed in the installation to exercise supervision;
(c) the cumulative processing of all the observed phenomena and the facts as compared to the project documentation assumptions and the assessment of their impact on the safety and stability of the designated water work and its supporting documents;
(d) a surveillance programme in the verification operation.
3. The overall supervisory reports shall include:
(a) a description of the surveillance;
(b) an assessment of the phenomena observed and of the facts found;
(c) the determination of whether, after checking all major loading conditions and operating situations, or after the implementation of corrective measures, the designated waterworks have, or do not have, defects from the point of view of supervision which would prevent their continued operation.
4. The ESAs shall contain:
(a) a description of the surveillance during the period of permanent operation since its launch or the period since the last stage report or, where appropriate, the aggregated phase report;
(b) a brief overview of the results of the observations and measurements;
(c) an assessment of the safety of the designated water works with regard to all the phenomena and facts observed and their relationship to the limit values;
(d) control of the duties imposed and proposals for corrective measures.
5. The summary supervisory phase reports shall contain:
(a) a description of the surveillance over the period since the last stage report and the previous aggregated phase report;
(b) documentation of any changes in equipment for measuring instruments and devices;
(c) design of renewal or modernisation of measuring instruments and equipment;
(d) aggregated processing of the results of observations and measurements;
(e) an assessment of the safety of the specified water work with regard to all the phenomena and facts observed and their relationship to the limit values;
(f) the results of the review of the stability of the main structures of the designated water works and the determination of the level of safety on the basis of newly acquired knowledge;
g) the results of the examination of the safety of the designated water works in floods according to current hydrological evidence, regulations governing the requirements for construction and according to the requirements of Czech technical standard ČSN 75 29 35 Assessment of the safety of water works in floods,
(h) environmental and ageing performance assessment, functional reliability and overall safety and stability of the designated water work;
(i) a review of the surveillance programme, including alertness limits, limit and critical values of the observed phenomena and facts;
(j) a proposal for corrective measures.
