of 21 December 2017
amending Decree No. 39 / 2005 Coll., laying down minimum requirements for study programmes to be qualified for the pursuit of an unmedical medical profession, as amended
The Ministry of Health, in agreement with the Ministry of Education, Youth and Sports, provides, pursuant to Section 90 (2) (d) of Act No. 96 / 2004 Coll., on the conditions for obtaining and recognising the competence to pursue non-medical medical professions and to carry out activities related to the provision of health care and on the amendment of certain related laws (Act on Non-medical Medical Professionals), as amended by Act No. 205 / 2011 Coll. and under Section 38 (1) of Act No. 18 / 2004 Coll., on the recognition of professional qualifications and other competences of nationals of the Member States of the European Union and on the amendment of certain laws (Act on the recognition of professional qualifications), as amended by Act No. 189 / 2008 Coll.:

Decree No. 39 / 2005 Coll., laying down minimum requirements for study programmes to be qualified for the non-medical medical profession, as amended by Decree No. 129 / 2010 Coll. and Decree No. 3 / 2016 Coll., is amended as follows:
1. in Article 2 (k), "quality" is replaced by "quality."
2. In Paragraph 3 (2) (c), "health care 'is replaced by" health services'.
3. In Article 3, at the end of paragraph 2, the dot is replaced by a comma and the following points (h) and (i) are added:
"(h) on the basis of quality management of the health services provided and in order to ensure the safety of patients in the professions referred to in Sections 4 to 28;
(i) in communication with the patient and persons close to him. "
4. Footnote 13 reads:
"13) Decree No. 55 / 2011 Coll., on the activities of health professionals and other professionals, as amended. '.
5. In Article 3 (5), the third sentence shall be replaced by the sentence "This teaching takes place in a health institution and, where appropriate, in other places, where this is provided for in this Decree, for the purpose of studying to acquire competence to pursue the relevant medical profession."
6. In Paragraph 3 (5), at the end of the sentence of the seventh sentence, the words "this does not apply to practical training in programmes which are awarded professional competence to pursue the profession of general nurse and midwife 'shall be added.
7. in Article 4 (3) (a) (1), the words "technical Latin terminology," "pharmacology," shall be inserted after the words "pathological physiology," "biochemistry," the words "genetics, haematology and transfusions, clinical propedeutics," and the words "and handling" shall be added at the end of the text of point 1. "
8. in Article 4 (3) (a) (2), the words "dental medicine," after the word "surgery," shall be inserted the words "orthopedia and trauma of the musculoskeletal system, neurology," after the word "psychiatry," the words "oncology and haematooncology, otorinolaryngology, ophthalmology, dermatoenerology, infectious medicine," shall be inserted after the words "physiotherapy," shall be replaced by the words "treatment of rehabilitation and" and transfusion medicine "shall be deleted.
9. in Article 4 (3) (a) (3), "economics" is replaced by "economics" and "quality and safety of nursing care provided," is deleted;
10. In Article 4 (3) (b), the words "dental medicine," "orthopaedic surgery," shall be inserted after the words "orthopaedic surgery," the words "neurology," "neurology," "psychiatry," the words "oncology and haematooncology, otorinolaryngology, ophthalmology, dermatogeneology, infectious medicine," shall be inserted after the words "psychiatry," and the words "practical teaching may take place in the patient's own social environment and in the care facilities of social services."
11. The following Section 4a is inserted after Section 4:
„§ 4a
Baby Sister
(1) The professional competence to pursue the profession of a child nurse is acquired through an accredited study programme or an accredited training programme.
(2) The programmes referred to in paragraph 1 shall have a standard period of at least 3 years, of which practical training shall be at least 2 000 hours.
(3) The study in the programmes referred to in paragraph 1 shall provide the knowledge and skills set out in Section 3 and shall include:
(a) theoretical teaching providing knowledge from disciplines and sciences which form the basis necessary for the provision of nursing care and the upbringing of children of all ages and which includes knowledge
1. from professional Latin terminology, anatomy, physiology, pathological physiology, pathology, microbiology and epidemiology, genetics and prenatal diagnostics, immunology, biophysics, biochemistry, haematology and transfusions, toxicology, clinical propaetics, pharmacology, including basic knowledge of and handling medical devices, radiation protection bases, protection and public health support including disease prevention, early diagnosis of diseases, the relationship between health status, physical and own social conditions of the patient, health education, healthy lifestyle including disease prevention, accidents and dependencies, child nutrition and dietetics and rehabilitation treatment,
2. in nursing and clinical disciplines, in particular in the history, character and ethics of nursing, general principles of health care, community care, nursing in relation to pediatrics, neonatology and other medical disciplines, in particular children's surgery, orthopaedic surgery and trauma to the musculoskeletal system, pediatric neurology, pediatric and adolescent psychiatry, pediatric gynaecology, pediatric oncology and haematooncology, pediatric otorinolaryngology, ophthalmology, pediatric dermatogenerology, infectious medicine and dental medicine, in nursing care for children under 3 years of age and in the provision of therapeutic rehabilitation care, child palliative care, intensive care, intensive care,
3. social and other related fields, from the foundations of philosophy, sociology, general and developmental psychology, health and social psychology, the foundations of pedagogy, educational care and education, social legal protection of the child, economics, informatics, statistics and methodology of scientific research and practice based on evidence,
provided by pedagogic staff who have obtained professional qualifications in accordance with the Education Workers Act, academic staff or other experts who may participate in teaching in accordance with the Higher Education Act,
(b) practical training providing nursing skills in relation to pediatrics and other medical disciplines, in particular maternal and neonatal care, pediatric surgery, orthopaedic surgery and trauma to the musculoskeletal system, pediatric and adolescent psychiatry, pediatric gynaecology, intensive childcare, palliative and community care, dental medicine, as well as skills to contribute to the education of children of all ages and practical training of health professionals; Such skills shall be acquired under the direct management of qualified nurses or, where justified, other healthcare professionals authorised to pursue the profession without professional supervision. In addition to the places referred to in Section 3 (5), practical training may also take place in the patient's own social environment and in the healthcare facilities. '
12. In Article 5 (3), the second sentence is replaced by the sentence "Practical teaching, in addition to the places referred to in Article 3 (5), may also take place in the social environment of women and their families."
13. in the third sentence of Article 5 (3), the words "medical establishments" are replaced by the words "health service providers."
14. in Article 5 (4) (a) (1), the words "technical Latin terminology" shall be inserted after the words "professional terminology," the words "clinical propedeutics," and the words "protection" shall be inserted after the words "and the words" support. "
15. in Article 5 (4) (a) (2), the words "internal medicine, surgery, dental medicine," shall be inserted after "in particular," the words "neonates and infants" shall be replaced by "and neonates," and the words "palliative care" shall be added at the end of the text of point 2.
16. in Article 5 (4) (a) (3), the word "economy" is replaced by the word "economics" and the words "quality and safety of care provided in childbirth assistance" are deleted;
17. in Article 5 (4) (b) (8), the words "or infant" shall be deleted;
18. the words "including palliative care" shall be added at the end of Paragraph 5 (4) (b).
19. in Article 6 (3) (a) (2), the words "palliative care" and the words "communication" shall be replaced by the words "communication technologies."
20. in Article 6 (3) (b), the words "rehabilitation nursing," shall be replaced by the words "rehabilitation care, palliative care," and at the end of point (b), the sentence "Practical teaching may, in addition to the places referred to in Article 3 (5), take place in the patient's own social environment and in the care-service facilities."

26. in Article 9 (3) (a) (3), the words "a geriatrics" shall be replaced by the words "geriatrics and social pathology," and after the words "in community care," the words "in rehabilitation care," shall be inserted;

In Article 9 (3) (b), the words "practical training takes place in post-care hospital, palliative care facilities, constitutional social care facilities, stationary, community care, adult and adult care institutions with internal, surgical and mental diseases, and in social care authorities." shall be replaced by the words "practical training shall take place in the hospital of the bed care provider, in the health care institution, in the health care service, in the patient's own social environment and in the administration of social care."
28. In Article 11 (3) (b), the words "practical teaching takes place in an outpatient medical institution of an eye doctor, a stationary for children with visual impairment, an ocular separation of hospitals or treatments and a strabological workplace." shall be replaced by the words "practical teaching takes place in an outpatient or bedside care institution of patients with visual impairment or in a school laboratory."
29. The heading of Section 12 reads: "Assistant to the Protection and Promotion of Public Health."
30. Paragraph 12 (1) reads:
"(1) Professional competence in the profession of assistant for the protection and promotion of public health shall be acquired through the completion of:
(a) accredited study programme pursuant to § 13 (1) (a) of Act No. 96 / 2004 Coll.,
(b) the accredited study programme pursuant to § 13 (1) (c) of Act No. 96 / 2004 Coll. and the course training programme; or
(c) accredited training programme according to § 13 (1) (c) of Act No. 96 / 2004 Coll. and training programme. '
31. in Article 12 (2), "the programme referred to in paragraph 1" shall be replaced by "the accredited study programme referred to in paragraph 1 (a)."
32. In Article 12, the following paragraph 3 is inserted after paragraph 2:
"(3) The accredited study programme referred to in paragraph 1 (b) and the accredited training programme referred to in paragraph 1 (c) shall have at least 3 years each standard study period. Practical teaching in the accredited study programme and in the training programme of the course or in the accredited training programme and in the training programme of the course shall be at least 1 200 hours. ';
Paragraph 3 shall become paragraph 4.
33. In Article 12 (4) of the introductory part of the provision, the words "Study in the programme referred to in paragraph 1" shall be replaced by "Study in the accredited study programme referred to in paragraph 1 (a), accredited study programme and in the training programme referred to in paragraph 1 (b) or accredited training programme and in the training programme referred to in paragraph 1 (c)."
34. in Article 12 (4) (a) (2), the words "protection and" shall be inserted after the words "methods."
35. in Article 12 (4) (a) (3), the words "and aid" shall be inserted after the word "protection."
36. in Article 12 (4) (b), the words "protection and" shall be inserted after the words "protection and"; the words "aid" shall be replaced by "administrative offices";

1. fields which form the basis for providing urgent health care and nursing care, and which include knowledge of Latin terminology, anatomy, physiology, pathological physiology, pathology, epidemiology and microbiology, biology, biochemistry, haematology and transfusion medicine, toxicology, clinical propedeutics, pharmacology, basic knowledge and handling of medical devices, radiology bases including radiation protection, protection and promotion of public health including disease prevention and health education;
2. nursing, clinical disciplines and other specific areas related to emergency care, emergency and war medicine, emergency and emergency care, emergency care in emergency and emergency situations (20), integrated emergency care system, health care and other medical disciplines, in particular internal medicine, surgery, neurology, pediatrics, gynaecology and obstetrics, psychiatry including addiction to addictive substances, care for the elderly and geriatrics, palliative care, community care, medical rehabilitation care,
3. social and other related fields, in general and developmental psychology, health and disease psychology, the foundations of legal issues in the field of health and social services, telecommunications technologies, the foundations of informatics, statistics and methodology of scientific research;
(b) practical training providing skills and knowledge in pre-hospital emergency care, in situations characteristic of emergency and war medicine, emergencies and emergency situations in connection with the components of the integrated rescue system, in instruction to provide lay first aid, including distance instruction, driving and navigational skills and other physical skills necessary for work in emergency care and nursing, in particular in relation to practical medicine, dental medicine, internal medicine, surgery, neurology, pediatrics, gynaecology and obstetrics, psychiatry including the management of an aggressive patient, care for the elderly and geriatria, palliative care, resuscitation and intensive care, community care, therapeutic rehabilitation care; practical training shall take place at the health care establishment of the health service provider providing in particular pre-hospital emergency care, intensive emergency bed care, including emergency income care, as well as at the health establishment of the bed care provider in the field of internal medicine, surgery and the workplace of other components of the integrated rescue system. ';
51. in Article 18 (3) (b), the words "for other health care providers carrying out the preparation of medicinal products under the supervision of a pharmacist, a pharmaceutical assistant or, where appropriate, a specialist in the preparation of radiopharmaceuticals" shall be replaced by the words "the provider of pharmaceutical or clinical pharmaceuticals."
52. Paragraph 19a is deleted.
(53) In Article 20 (3) (a) (2), the words "intervention radiology," and the words "intervention radiology" shall be inserted after the words "quality in radiodiagnostic."
54. in Paragraph 20a (1):
"(1) Professional competence in the profession of adictologist is acquired through an accredited study programme."
55. in Paragraph 20a (3) of the introductory part of the provision, the words "(a)" shall be deleted;
56. in Article 20a (3) (a) (2), the words "the foundations of communication," shall be deleted and the words "healthcare" shall be replaced by the words "health services."
57. in Article 20a (3) (a) (3), the words "the foundations of financial management of an undertaking," shall be deleted;
58. Paragraph 20a (4) is deleted.
59. The following Sections 20b and 20c are inserted after Section 20a, including the headings:
„§ 20b
Behavioral analyst
(1) The professional competence to pursue the profession of behavioural analyst is obtained through the completion of an accredited study programme and a course training programme. The accredited study programme shall have a standard study period of at least 5 years or at least 2 years, depending on the accredited Bachelor's study programme.
(2) The training programme shall cover at least 420 hours of theoretical teaching and at least 1 800 hours of practical teaching.
(3) The study in the course training programme provides the knowledge and skills set out in Section 3 and includes:
(a) theoretical teaching providing knowledge in:
1. areas or methods which form the basis necessary for the provision of behavioural analysis care, in the concepts and principles of behavioural analysis, history and development of behavioural theories, the foundations of experimental behavioural analysis and applied behavioural analysis;
2. other, with behavioural analysis of behavioural methods and techniques related to behavioural analysis by functional evaluation and functional analysis of behaviour, measurement of behaviour, analysis of data focusing on topography, frequency, duration, latency, intervals of occurrence and intensity of behaviour, depistation and monitoring of problem behaviour, implementation of behavioural change programmes including the creation of individual learning plans, conditioning and application of various behavioural strengthening plans, behavioural deficits and excesses, and ethics, professional behaviour in behavioural analysis;
3. related areas, in the organisation of the provision of behavioural analytical care in the framework of health and social care, in the basis of the methodology of scientific research and practice based on evidence, the basis of legal issues provided by behavioural analytical care and in the field of health and social services and education,
(b) practical training providing skills related to theoretical knowledge, in particular in the field of direct observation of behavioural analysts in the implementation of the behavioural programme, carrying out behavioural analysis, diagnostics and differential diagnostics of behaviours, preparation, implementation and systematic evaluation of behavioural programmes aimed at learning new skills and reducing problem behaviours, carrying out behavioural analysis, rehabilitation and reeducation of behaviours, compliance with ethical and professional standards in behavioural analysis, conducting organised reflection and medical documentation, cooperating in a multidisciplinary team and with family; practical training shall take place under the direct guidance of qualified behavioral analysts or, where justified, other healthcare professionals authorised to pursue the profession without professional supervision, in particular with the health service provider, in social services facilities and in the patient's own social environment.
§ 20c
Practical nurse
(1) Professional competence in the profession of a practical nurse is acquired through the completion of a school training programme or a course training programme.
(2) The school curriculum has a standard period of at least 4 years, of which practical training is at least 1 200 hours. The training programme shall cover at least 700 hours of theoretical teaching and at least 600 hours of practical teaching.
(3) The study in the programmes referred to in paragraph 1 shall provide the knowledge and skills referred to in Section 3 and shall include:
(a) theoretical training providing knowledge
1. general subjects; This does not apply in the case of the course training programme,
2. the sciences which form the basis necessary for the provision of general nursing care, which includes knowledge from the specialist Latin terminology, anatomy and physiology, from the protection and promotion of public health, including disease prevention and health education, from microbiology and epidemiology, biochemistry, haematology and transfusion medicine, clinical propedeutics, pharmacology including basic knowledge of and handling medical devices and radiation protection bases,
3. in nursing and clinical disciplines, in the theory of nursing, nursing in relation to practical medicine, dental medicine and other medical disciplines, in particular internal medicine, surgery, neurology, pediatric, gynaecology, psychiatry, care for the elderly and geriatrics, palliative care, community care and rehabilitation care,
4. in social and other related fields, general and developmental psychology, health and disease psychology and the foundations of legal issues in the field of health and social services;
(b) practical training providing skills and knowledge in nursing in relation to general practical medicine, dental medicine and other medical disciplines, in particular internal medicine, surgery, neurology, pediatrics, gynecology, care for the elderly and geriatrics, palliative care, community care, rehabilitation and physical medicine; those skills shall be acquired under the direct guidance of qualified general nurses, nurses, midwives or, where justified, other healthcare professionals authorised to pursue the profession without professional supervision. In addition to the places referred to in Section 3 (5), practical training may also take place in the patient's own social environment and in the healthcare facilities. '
60. in Paragraph 21 (3) (b), the words "and social facilities" are replaced by the words "establishments, social services facilities."
61. The heading of § 22 reads: "Logoped in health care and clinical logoped."
62. In Section 22, the following paragraph 1 is added:
"(1) The professional competence to pursue the profession of speech in health care shall be obtained through the completion of an accredited study programme and the training programme of a course in health care, which is carried out by a university. '.
Paragraphs 1 to 4 shall be renumbered paragraphs 2 to 5.
63.In Paragraph 22 (3), the words "under paragraph 3" are replaced by the words "referred to in paragraph 4."
64. In Section 22 (4) of the introductory part of the provision, the words "paragraph 1 'are replaced by the words" paragraphs 1 and 2'.
65. In Paragraph 22 (4) (a) (1), the words "psychology," and "voice" shall be replaced by the words "voice and nervous," and the words "instruments" shall be inserted after the words "medical devices for diagnosis and treatment of swallow disorders."
66. In Paragraph 22 (4) (a) (2), the words "swallowing disorders," "and" oropharyngeal swallowing disorders, "and" otorinolaryngology, "shall be inserted after the words" dental surgery, ";
67. in Article 22 (4) (b), the words "and swallow disorders in the oropharyngeal region" shall be inserted after the word "competence" and the words "social facilities and educational establishments including special educational establishments" shall be replaced by the words "social services facilities and facilities."

"(1) Professional competence in the field of the profession of visual therapist is obtained through the completion of an accredited study programme and a course training programme."
71. in Article 22a (2), the words "Accredited specialisation programme has a standard study period of 1 year and" shall be replaced by the words "course training programme."
72.Paragraph 22a (4) is deleted.
73. The heading of Section 23 reads: "Physiotherapist and professional physiotherapist."
74. In Paragraph 23 (1), the words "or accredited master's programme" shall be deleted.
75. in Paragraph 23 (2):
"(2) The programme referred to in paragraph 1 shall have a standard period of at least 3 years, of which practical training shall be at least 1 600 hours. ';
76. in Article 23 (3), the words "(a)" shall be deleted;
77. In Article 23, the following paragraph 4 is inserted after paragraph 3:
"(4) Specialised competence to pursue the profession of professional physiotherapist is acquired through completion
(a) an accredited follow-up medical master's physiotherapy programme which has a standard study period of at least 2 years, of which practical training shall be 600 hours; or
(b) a specialisation programme in the field of applied physiotherapy with a standard period of at least 1,5 years, of which practical training shall be 480 hours. "
Paragraphs 4 and 5 shall become paragraphs 5 and 6.
78. In Article 23 (5), the words "the programme referred to 'shall be replaced by the words" the programmes referred to', the text "2 (b) 'shall be replaced by the words" 4', and the words "(for example, the Lewito methodology, hippotherapy, the Kabat technique for proprietary nervomuscle mobility, Vojt's developmental kinesiology, the Moses methodology, the Brügger concept) 'shall be replaced by the words" physiotherapy'.

Assistant behavioral analyst
(1) The professional competence to pursue the profession of assistant behavioural analyst is obtained through the completion of an accredited study programme and a course training programme.
(2) The accredited study programme has a standard study period of at least 3 years.
(3) The training programme shall cover at least 300 hours of theoretical teaching and at least 1,200 hours of practical teaching.
(4) Study in the training programme of the course provides the knowledge and skills set out in § 3 and also contains
(a) theoretical teaching providing knowledge in:
1. areas or methods which form the basis necessary for the provision of behavioural analysis care, in the concepts and principles of behavioural analysis, history and development of behavioural theories, the foundations of experimental behavioural analysis and applied behavioural analysis;
2. Other, with behavioural analysis of behavioural methods and techniques related to behavioural analysis by functional evaluation and functional analysis of behaviour, measurement of behaviour, data analysis bases focusing on topography, frequency, duration, latency, intervals of occurrence and intensity of behaviour, depistation and monitoring of problem behaviour, implementation of behavioural change programmes, including the creation of individual learning plans, conditioning and application of various plans for strengthening behavioural patterns, behavioural deficits and excesses, ethics and behavioural practices,
3. related areas, in the organisation of the provision of behavioural analytical care in the framework of health and social care, in the basis of the methodology of scientific research and practice based on evidence, the basis of legal issues provided by behavioural analytical care and in the field of health and social services and education,
(b) practical training providing skills related to theoretical knowledge, in particular in the field of direct observation of behavioural analysts and assistant behavioural analysts in the implementation of the behavioural programme, the implementation of behavioural evaluation and diagnostics of behaviours, preparation, implementation of behavioural programmes aimed at learning new skills and reducing problem behaviours in cooperation with behavioural analysts, the implementation of behavioural analytical therapy, rehabilitation and reeducation of behaviours, compliance with ethical and professional standards in behavioural analysis, management of organised reflection and medical documentation, cooperation in a multidisciplinary team and family; practical training shall take place under the direct guidance of qualified behavioural analysts or, where justified, other healthcare professionals authorised to pursue the profession without professional supervision, in particular with the health service provider, social services facilities and the patient's own social environment. ';
95. After Paragraph 28, the following Section 28a is inserted:
„§ 28a
Behavioral technician
(1) Professional competence for the pursuit of the profession of behavioural technician is acquired through the completion of a school training programme and a course training programme.
(2) The school curriculum has a standard study period of at least 4 years.
(3) The training programme shall cover at least 100 hours of theoretical teaching and at least 120 hours of practical teaching.
(4) Study in the training programme of the course provides the knowledge and skills set out in § 3 and also contains
(a) theoretical teaching providing knowledge in:
1. areas or methods which form the basis needed for the provision of behavioural analytical care, in the basis of applied behavioural analysis for assistance in carrying out basic behavioural evaluation, diagnostics and assistance in behavioural analysis, rehabilitation and reeducation;
2. basic knowledge in other behavioural analysis of related methods and techniques, in the basis of behavioural analysis of data with a focus on behavioural measurement, basic methods and techniques of behavioural intervention, including conditioning and application of various plans to strengthen behavioural behaviour, the foundations for behavioural behavioural behavioral interventions and excesses, the foundations of ethics and professional behaviour in behavioral analysis,
3. related areas, in the organisation of the provision of behavioural analysis care in the framework of health and social care, in the basis of evidence-based practice and the basis of legal issues provided by behavioural analysis care and in the field of health, social services and education;
(b) practical training providing skills related to theoretical knowledge, in particular in the area of direct observation by a behavioural analyst, an assistant behavioural analyst and behavioural technician in the implementation of the behavioural programme, participation in direct work with a client according to a plan established by a behavioural analyst or an assistant behavioural analyst, including data collection and preparation for further evaluation, assistance in the design of behavioural intervention plans, cooperation in a multidisciplinary team and family; practical training shall take place under the direct guidance of qualified behavioural analysts or, where justified, other healthcare professionals authorised to pursue the profession without professional supervision, in particular with the health service provider, social services facilities and the patient's own social environment. ';
96.In Article 31 (3) (a) (4), the word 'economy' is replaced by 'economics'.
