DECLARATION
of 19 December 2012
on the use of toll-charged infrastructure
The Ministry of Transport provides for the Act No. 13 / 1997 Coll., as amended by Act No. 102 / 2000 Coll., Act No. 132 / 2000 Coll., Act No. 489 / 2001 Coll., Act No. 256 / 2002 Coll., Act No. 259 / 2002 Coll., Act No. 320 / 2002 Coll., Act No. 358 / 2003 Coll., Act No. 186 / 2004 Coll., Act No. 80 / 2006 Coll., Act No. 196 / 2006 Coll., Act No. 347 / 2009 Coll., Act No. 406 / 2010 Coll., Act No. 152 / 2011 Coll., Act No. 288 / 2011 Coll., and Act No. 196 / 2012 Coll. (hereinafter "Act '):
§ 1
Subject matter
This decree implements the relevant provisions of the European Union5)
(a) infrastructure the use of which is subject to tolls;
(b) other elements listed in the toll data register necessary for the operation of the electronic toll system;
(c) the amount of bail in the provision of electronic equipment;
(d) the way in which the toll data are recorded;
(e) the way in which electronic equipment is handled and the conditions for its use;
(f) the method of payment of tolls;
(g) the types of data needed to enter the electronic equipment and which enable toll to be determined;
(h) the structure, description and method of calculating costs and the method for setting tolls;
(i) the method for determining the CO2 emission class of the vehicle in the electronic toll system; and
(j) the details of the risk plan.
§ 2
Ground roads for which tolls are levied
The land roads for which tolls are levied are listed in Annexes 1 and 2 to this Decree.
§ 3
Amount of the deposit
Bail is CZK 2,468.
§ 4
Registration of toll data
The Toll Data Record contains the information set out in Section 22c (2) of the Act and:
(a) the number of the vehicle toll account in the electronic toll system;
(b) the payment scheme and the method of paying tolls.
§ 5
Method of recording toll data
(1) The registration of toll data includes the registration of a vehicle into a pre-payment or post-payment mode to be carried out at contact or distribution points or through a customer service.
(2) Toll records shall be made on the basis of a copy of the vehicle registration certificate or on the basis of a similar document issued by a Member State other than the Member State of the European Union and an indication of whether the registered vehicle has metal-plated windscreens.
(3) If it is a vehicle in an electronic toll system registered in the Czech Republic, the electronic toll system operator also records toll data on the basis of data issued to it from the road vehicle register.
(4) The CO2 emission class of the vehicle in the electronic toll system shall be determined and recorded in the Toll Data Register
(a) on the basis of data from the register of road vehicles,
(b) on the basis of the information contained in the vehicle registration certificate or similar document issued by a Member State other than a Member State of the European Union,
(c) on the basis of the data contained in the declaration of conformity of a vehicle to a type of vehicle (6) or a set of information for customers under the directly applicable European Union regulation governing the determination of CO2 emissions and fuel consumption of heavy goods vehicles (7), if one of these documents has been submitted by the vehicle operator and contains the data necessary to determine the CO2 emission class of the vehicle; or
(d) in accordance with the procedure laid down in Article 17a (3), second sentence.
§ 6
Data to be reported
The vehicle operator shall inform the electronic toll system operator, within five days at most, of changes in the registered data including the payment mode and shall submit the electronic device to it.
§ 7
Means of recording toll data when changing the vehicle operator
When the vehicle is transferred to another operator, the original operator shall remove the vehicle from the electronic toll system.
§ 8
Check-out from the electronic toll system
(1) The vehicle operator shall uncheck the vehicle with the electronic toll system operator and return the electronic device to it at the contact or distribution point or via the postal service operator. When the vehicle is unchecked, the vehicle operator shall submit a vehicle registration certificate or any other document proving the removal of the vehicle from the vehicle register. Those documents may be replaced by proof of the identity of the vehicle operator or of the representative of the vehicle operator if the representative of the vehicle operator is registered in the toll system.
(2) Where an electronic device cannot be returned (for example in the event of loss or destruction), the vehicle shall be checked out by means of a written notification to the operator of the electronic toll system to the contact or distribution point.
(3) If the toll is outstanding on check-out, this amount shall be refunded to the vehicle operator.
§ 9
Means of payment of tolls
(1) Tolls are paid either in advance or in subsequent payment.
(2) Under the advance payment scheme, tolls can be pre-paid:
(a) cash at points of contact and distribution; or
(b) means of payment provided for in the contractual terms and conditions of the electronic toll system operator.
§ 10
Electronic equipment
(1) Electronic equipment may be used only in the manner regulated by the law and by this decree.
(2) If an electronic device fails, the vehicle operator or driver shall ensure that it is replaced for a fully functional prior to the use of the toll communication. In the event of a failure of the electronic device during use of the toll infrastructure, the operator or the driver of the vehicle shall ensure exchange for the fully functioning electronic device at the nearest contact or distribution point.
(3) The electronic toll system operator shall be entitled to block the electronic equipment due to a serious breach of the terms and conditions of the electronic toll system operator; the locking of the electronic device shall be given prior warning by the vehicle operator. If the electronic device is blocked during use of the toll infrastructure, the operator or the driver of the vehicle shall ensure that it is exchanged for a fully functioning electronic device at the nearest contact or distribution point.
(4) Electronic equipment can only be used in the payment mode for which the vehicle has been registered in the electronic toll system.
§ 11
Loss of electronic equipment
The loss, theft and other cases where an electronic device is removed from the possession of the vehicle operator or driver (hereinafter referred to as "loss'), the vehicle operator or driver shall immediately report to the electronic toll system operator including vehicle identification data.
§ 12
Transport of electronic equipment without tolling obligation
Where an electronic device is to be transported on a toll road without charging tolls (for example when transporting to another vehicle), it shall be deactivated or placed under a mode intended for such carriage.
§ 13
Data setting in electronic equipment
The driver shall enter data on the number of all axles, as specified in the instructions, for each change of data before using the toll infrastructure to the electronic equipment. A double or triple axle (1) on a trailer shall be considered as two or three axles.
§ 14
Electronic equipment functionality check
The driver shall check that the electronic equipment is fully operational before, during and after the use of the toll infrastructure, and shall report promptly to the electronic toll system operator or European toll provider any detected defects or deficiencies in the functioning of the electronic equipment. During driving, the driver follows the signals of the electronic device according to the instructions. For the purposes of this provision, the termination of the use of the toll infrastructure and its re-start also means any interruption of the road traffic.
§ 15
Description of the costs of the toll infrastructure, the return on which is to be achieved by imposing tolls
(1) The costs of building toll roads include all costs directly related to their construction, which are:
(a) the price of buildings and land;
(b) the cost of financing the construction of toll roads;
(c) the cost of processing project documentation;
(d) costs of archaeological, geological and other similar surveys;
(e) depreciation under other legislation3).
(2) The costs of maintaining and repairing toll roads include, under the Decree implementing the Road Law (8), all costs of:
(a) routine maintenance;
(b) continuous maintenance;
(c) corrections; and
(d) winter maintenance.
(3) The management costs related to the operation of toll roads include other costs not mentioned in paragraphs 1 and 2 which are directly related to the operation of toll roads and which are not related to the construction and operation of the electronic toll system. These costs include payments resulting from concession contracts.
(4) The costs of building and operating an electronic toll system include:
(a) costs for the construction, establishment and maintenance of toll collection sites;
(b) costs related to the operation, administration, collection and recovery of tolls;
(c) depreciation under other legislation3).
(5) The costs of building the toll roads referred to in paragraph 1 shall include:
(a) the costs of construction of infrastructure completed after 10 June 1978 until the date of updating the cost calculation, which shall be determined by a ratio corresponding to the share of the planned lifetime of the road charges remaining after the date of updating the cost calculation of the total estimated life of the road charges;
(b) the costs incurred and foreseen for the construction of the infrastructure, which are at the date of updating the calculation of the costs under construction;
(c) the estimated costs of construction of the planned infrastructure, which are recorded in the planning documentation; These costs shall be distributed according to the planned service life of the infrastructure, but for at least 20 years.
§ 15a
Description of the costs of air pollution in the operation of toll road vehicles whose return is to be achieved by imposing tolls
The costs of air pollution caused by the operation of vehicles in the electronic toll system on toll roads, the return of which is to be achieved by the imposition of tolls, constitute:
(a) the cost of planting and treating road vegetation of toll roads;
(b) the cost of measures to reduce air pollution in toll infrastructure tunnels;
(c) the costs of protecting against pollution of soil from toll roads incurred in:
1. drainage equipment,
2. water cleaning and sludge disposal,
(d) the cost of implementing measures related to increasing the flow of traffic on toll roads involving the cost of intelligent transport systems;
(e) other costs not covered by points (a) to (d) directly caused by air pollution in the operation of vehicles in the electronic toll system on toll roads.
§ 15b
Description of noise-induced costs in the operation of toll road vehicles whose return is to be achieved by imposing tolls
The noise generated by the operation of vehicles in the electronic toll system on toll roads, the return of which is to be achieved by the imposition of tolls, consists of:
(a) costs of implementing noise prevention measures to reduce traffic noise on toll roads
1. mixtures for abrasive layers with reduced noise,
2. Earth bouls,
3. noise prevention walls,
4. noise-resistant paramilitary walls,
5. ground walls combined with noise wall,
6. mobile noise prevention walls,
(b) the cost of noise treatment on land-based noise-sensitive objects on toll roads
1. replacement of windows with declared airtight sound,
2. sealing of holes and fillings (e.g. another layer of glass or a type of filler with a higher degree of sound insulation),
3. transparent forefront,
4. acoustic absorption tiles,
(c) other costs other than those referred to in (a) or (b) directly generated by noise in the operation of vehicles in the electronic toll system on toll roads.
§ 15c
Description of CO2 costs incurred in the operation of toll road vehicles whose return is to be achieved by imposing tolls
The costs incurred by CO2 emissions in the operation of vehicles in the electronic toll system on toll roads, the return of which is to be achieved by imposing tolls, are the costs of:
(a) achieving energy savings in transport and transport infrastructure;
(b) promoting renewable energy sources in the field of transport and transport infrastructure;
(c) the construction of charging and filling stations and other structures and equipment for the sale or supply of alternative fuels for the propulsion of means of transport;
(d) a change in the procedures for the construction and management of transport infrastructure resulting in a reduction of CO2 emissions;
(e) adaptation to climate change; and
(f) compensation for damage caused by climate change.
§ 16
Method of calculating the costs to be recovered by imposing tolls
The costs to be recovered by imposing tolls shall be determined by the ratio of the sum of the costs referred to in Sections 15, 15a, 15b and 15c to the actual or anticipated performance of vehicles in the electronic toll system. For the calculation of costs only for a certain part of the road, only the corresponding part of the costs related to the actual or anticipated performance of vehicles in the electronic toll system shall be used. The cost of the calendar year shall be used for the calculation.
§ 17
Method for setting toll rates
(1) The calculation of tolls shall be made on the actual or anticipated proportion of vehicles in the electronic toll system at kilometres travelled on toll roads. Only the proportion of costs calculated in accordance with Sections 15, 15a, 15b and 15c and relating separately to motorways and to selected first-class roads listed in Annexes 1 and 2 to this Decree may be used for the calculation. That proportion of costs shall be allocated only to the actual or anticipated share of vehicles in the electronic toll system. The proportion of costs thus determined shall be distributed according to the conditions laid down in another legislation4 and shall always relate to the actual or anticipated performance of vehicles in the electronic toll system.
(2) The individual toll rates are differentiated in such a way that the total revenue from the toll imposed over the calendar year does not exceed a proportion of the costs to be recovered by imposing the toll.
§ 17a
Method for determining the CO2 emission class of the vehicle in the electronic toll system
(1) The CO2 emission class 5 shall be determined for the vehicle in an electronic toll system which uses electricity or hydrogen exclusively as fuel.
(2) A vehicle in an electronic toll system which does not use electricity or hydrogen exclusively as a fuel, belonging to a subgroup of vehicles pursuant to a directly applicable European Union regulation on CO2 emission performance standards for new heavy-duty vehicles (9) and which was first registered after 30 June 2019, the CO2 emission class 1, 2, 3 or 4 shall be determined in accordance with the European Union Regulation on the collection of charges for the use of infrastructure vehicles (10). The electronic toll system operator shall determine the CO2 emission class of the vehicle in accordance with Annex 3 to this Regulation according to the sub-group to which the vehicle belongs, its specific CO2 emissions and the date of its first registration.
(3) A vehicle in an electronic toll system other than those referred to in paragraphs 1 and 2 shall be identified as CO2 emission class 1. This CO2 emission class shall also be determined to a vehicle for which the CO2 emission class No 2, 3, 4 or 5 cannot be determined on the basis of data from the road vehicle register or data contained in the vehicle registration certificate or similar document issued by a Member State other than the European Union, unless the vehicle operator has submitted the electronic toll declaration system operator to the vehicle type (6) or a set of information for customers in accordance with the directly applicable European Union regulation on the determination of CO2 emissions and fuel consumption of heavy goods vehicles (7) containing the data necessary for the determination of the vehicle CO2 emission class.
§ 18
Details of the risk management plan
The risk management plan shall include the identification and evaluation of risks related to the provision of the European electronic toll service, as well as appropriate procedures for mitigating, eliminating and continuing monitoring such risks. The risk management plan shall include measures focusing primarily on risk management related to:
(a) the liquidity of the undertaking of the provider of the European toll and cash flows from the operation;
(b) macroeconomic developments;
(c) changes in competitiveness in the provision of a European electronic toll service;
(d) damage to the reputation of the undertaking of the European toll provider;
(e) difficulties in ensuring the continuous provision of the European electronic toll service in all electronic toll systems and possible failures to cover an electronic toll system;
(f) business interruption;
(g) difficulties in achieving the required level of service provided;
(h) legal liability towards third parties;
(i) a change in legislation.
§ 18a
Exemptions from this decree
(1) Paragraphs 5 to 8, 10 (3) and 11 shall not apply where a vehicle operator does not have a contract with an electronic myth system operator and has a contract exclusively with a European electronic toll service provider.
(2) In the case of vehicle operators with a contract for the provision of a European electronic toll service, entry in the toll data register shall be made on the basis of data provided by the European toll provider to the electronic toll system operator.
§ 19
Repeal
The following shall be deleted:
1. Decree No. 527 / 2006 Coll., on the use of toll roads and amending Decree No. 104 / 1997 Coll., implementing the Road Act, as amended.
2. Decree No. 323 / 2007 Coll., amending Decree No. 527 / 2006 Coll., on the use of toll infrastructure and amending Decree No. 104 / 1997 Coll., implementing the Road Act, as amended.
3. Decree No. 14 / 2009 Coll., amending Decree No. 527 / 2006 Coll., on the use of toll infrastructure and amending Decree No. 104 / 1997 Coll., implementing the Road Act, as amended.
4. Decree No. 483 / 2009 Coll., amending Decree No. 527 / 2006 Coll., on the use of toll infrastructure and amending Decree No. 104 / 1997 Coll., implementing the Road Act, as amended.

§ 20
Efficacy
This Decree shall take effect on 1 January 2013.
