On 4 October 2005, the Constitutional Court, in plenary, composed of the President of the Court of Paul Rychett and the Judges Stanislav Balík, František Duchona, Military Güttler, Ivana Janů, Dagmar Lastovecký, Jiří Much, Jan Musil, Jiří Nykodým, Miloslav Excellent and Michaela Židlická, on the proposal of the Minister of the Interior to repeal Article 3 (1), (4), (5) (8) (b) and Article 6 (1), (2) and (3) of the Ordinary Decree of the City of Louna 1 / 2003 on the establishment of a system of collection, collection, collection, transport, sorting, recovery and disposal of municipal waste and construction waste
as follows:
I. Article 3 (1), third and fourth sentences, part of the provision of Article 5 (8) (b), which reads "and conclude a written contract with an authorised person authorised by the City of Louna to ensure the management of municipal waste in return for payment" and Article 6 (1) (2) (3) of the Ordinary Decree of Louna No 1 / 2003 on the establishment of a system for the collection, collection, transport, sorting, recovery and disposal of municipal waste and construction waste shall be deleted from the date of publication of this finding in the Collection of Laws.
II. The remainder is rejected.
