DECLARATION
Federal Ministry of Transport
of 24 March 1980
on flying with suspension gliders
The Federal Ministry of Transport, in agreement with the participating central authorities, provides, in accordance with § 67 (2) of Act No. 47 / 1956 Coll., on Civil Aviation (Aviation Act), as published under No. 127 / 1976 Coll.:
(1) In the airspace of the Czechoslovak Socialist Republic, only Czechoslovak nationals, with the exception referred to in § 6, who are members of the Association for Cooperation with the Army (hereinafter referred to as "Swazarm ') can fly suspension gliders and obtain a licence to pilot a suspension glider, or are preparing to obtain this licence.
(2) Flying with a suspension glider is permitted only in areas designated by Swaziland in agreement with the Federal Ministry of Transport, the Federal Ministry of National Defence and the Federal Ministry of Interior.
(3) The auxiliary engine shall not be used to fly with a suspension glider; the exemption may be authorised by the Federal Ministry of Transport in agreement with the Federal Ministry of Interior.
(1) A pilot of a suspension glider may only be capable of this activity, both physically and mentally, which has reached the age of 18 and has obtained a pilot's licence based on a successful test. Exceptionally, with the consent of the legal representative, a person who has reached the age of at least 15 may become a pilot of a suspension glider.
(2) Without a pilot licence for a suspension sailplane, only those who learn to drive or who pass the test to obtain the licence can fly under the supervision of an authorised Svanzarm instructor.
(3) The suspension glider shall be capable of flying if it has an airworthiness licence and is marked with a registration mark.
The pilot licence of the suspension sailplane and the airworthiness licence of the suspension sailplane shall be issued by Svanzarm, which shall also assign registration marks to hang gliders.
(1) The pilot of the suspension glider shall in particular:
(a) do not disturb or jeopardise the safety of air operations;
(b) do not disturb or jeopardise public policy, the safety of life and health of persons and property;
(c) to fly a hang glider only if its technical condition corresponds to the conditions under which its airworthiness certificate was issued;
(d) present, on request to the authorities referred to in Section 5, their identity card, the pilot licence of the suspension sailplane and the airworthiness certificate of the suspension sailplane;
(e) comply with the regulations and instructions of the authorities of Swaziland.
(2) When flying with a sailplane, it is not permitted to carry items that are dangerous to safety, in particular weapons, explosives, ammunition, corrosive substances and easily ignited objects.
(1) The national safety authority shall withdraw the pilot licence of the hang glider and the hang glider airworthiness licence if the pilot of the hang glider does not fulfil the obligations set out in paragraphs 4 (1) (b) and 4 (2). The same shall be done by the authorities of the State Air Inspection and Swaziland, if the pilot of the suspension sailplane does not fulfil the obligations laid down in this Decree.
(2) The authorities referred to in paragraph 1 shall transmit the card to the Committee which issued it.
In the airspace of the Czechoslovak Socialist Republic, they can fly a suspension glider under the conditions laid down in § 4 (1) (a) and (b) and § 2 also foreign nationals, but only at the invitation of Swaziland, as participants in competitions organised by this organisation.
This Decree shall take effect on 1 April 1981.
