Constitutional Decree of the President of the Republic
of 25 August 1945
about the Provisional National Assembly.
On the proposal of the Government and in agreement with the Slovak National Council, I establish:
(1) Until such time as the constituent National Assembly is convened, elected under the general, equal, direct and secret voting law and the principle of proportional representation, power shall be exercised by the legislature under this Decree for the entire territory of the Czechoslovak Republic of the Provisional National Assembly.
(2) The Provisional National Assembly consists of one House of 300 Members. Its headquarters is Prague.
(3) The election rights to the Interim National Assembly are for persons who have reached 18 years of age and electors are for those who have reached 21 years of age. The Government shall lay down further provisions on the right to vote, to vote and to elect the Provisional National Assembly by a regulation signed by the President of the Republic.
The provisional National Assembly shall:
1. Confirm that the current President of the Republic remains in office in accordance with Paragraph 58 (5) of the Constitutional Charter until the new election of the President of the Republic (Article 3 (3)),
2. exercise the appropriate powers of the National Assembly under the constitutional charter and other laws. However, the Constitution may only be amended if necessary. In matters relating to the constitutional status of Slovakia, the consent of the majority of the members of the Provisional National Assembly from Slovakia must also be sought.
(1) Members of the Interim National Assembly are subject, within the limits of this constitutional decree, to the provisions of the constitutional charter and other laws on members of the House of Deputies of the National Assembly.
(2) The provisions of the Constitutional Charter and other laws on the National Assembly (Chamber of Deputies) and its proceedings (Rules of Procedure of the Chamber of Deputies) apply mutatis mutandis to the Interim National Assembly.
(3) To confirm the President of the Republic (Article 2, No 1), the presence of an absolute majority of all members of the Interim National Assembly and a majority of three-fifths of the votes present is required.
This constitutional decree shall take effect on the day of its publication; it shall be carried out by all members of the Government.
