DECLARATION
of 30 November 2021
amending Decree No 290 / 2007 Coll., on the reimbursement of costs of the data database for emergency calls
Pursuant to Article 150 (5) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (Act on Electronic Communications), as amended by Act No. 310 / 2006 Coll., Act No. 110 / 2007 Coll., Act No. 261 / 2007 Coll., Act No. 304 / 2007 Coll., Act No. 247 / 2008 Coll., Act No. 153 / 2010 Coll., Act No. 468 / 2011 Coll., Act No. 214 / 2013 Coll., Act No. 258 / 2014 Coll., Act No. 252 / 2017 Coll., Act No. 311 / 2019 Coll., Act No. 150 / 2021 Coll., and Act No. 374 / 2021 Coll., implementing Section 33 (4) of the Act on Electronic Communications:
Decree No 290 / 2007 Coll., on the reimbursement of costs of the data database for emergency calls, is amended as follows:
1. In the title of the Decree, the words "emergency calls' are replaced by the words" emergency communications'.
2. Paragraph 1 (1) to (3) reads as follows:
"(1) For the purposes of calculating the cost effectively incurred pursuant to Section 33 (4) of the Electronic Communications Act, depreciation of the technology equipment used for the management of the database, including servers, intangible assets, in particular the licences and software necessary for the management of the database, and the operating costs of such operating costs incurred for the establishment, maintenance and operation of those facilities shall be considered as operating costs.
(2) The calculation of the cost effectively incurred referred to in paragraph 1 shall include only those costs which are kept by the entrepreneur ensuring the connection of the emergency communications centre to the public fixed communications network by accounting records under the Accounting Act.
(3) The amount of monthly payment invoiced to the emergency communication centre is determined according to the formula

where:
Ui is the monthly reimbursement of the costs effectively incurred pursuant to paragraph 1 invoiced to the individual emergency communication centre,
P is the number of days in the relevant calendar month when the database is able to provide personal and identification data throughout the day in accordance with the localisation and identification of the emergency communication participant,
Pc is the number of days in the relevant calendar month total,
Oi is the population assigned to the relevant emergency number which is attributed to each emergency number as follows:
for emergency number 112, population of the Czech Republic,
for emergency number 150, population of the Czech Republic,
for emergency number 155, the number of inhabitants of the relevant county which is the founder of the health-rescue service provider of that region,
for emergency number 156, the population of the municipality which is the founder of the competent municipal police,
for emergency number 158, population of the Czech Republic,
O is the sum of all Oi,
N is the total monthly costs referred to in paragraph 1. ';
footnotes 1 to 3 are deleted.
3. In Article 2 (1), the words "pursuant to § 1 (2) 'and the words" on the transmission of data for emergency calls3)' are replaced by the words "on the location and identification of a participant in emergency communications';
4. Paragraph 2 is deleted.
Paragraphs 3 to 8 shall be renumbered paragraphs 2 to 7.
5. In Article 2 (2), the words "pursuant to Paragraph 1 (2) 'and the words" an emergency call centre' are replaced by the words "emergency communication centre '.
6. in Article 2 (4) (c), the words "in connection with the establishment and management of the database 'are replaced by the words" in accordance with Article 1 (1)';
7. In Article 2 (4) (f), the word "calendar 'shall be inserted after the word" relevant' and the words "emergency call number 'shall be replaced by" emergency number'.
8. In Article 2 (5), the words "emergency call centre 'are replaced by the words" emergency communication centre'; the words "pursuant to Article 1 (2) 'shall be inserted after the words" business operator'; the words "paragraph 5 'shall be replaced by the words" paragraph 4';
9. In Article 2 (6), the words "Article 1 (2) ', the words" 5 or 6' shall be replaced by "4 or 5 'and the words" emergency call centre' shall be replaced by the words "emergency communication centre ';
10. in Paragraph 2 (7), the words "emergency call centre" are replaced by the words "emergency communication centre," the words "Article 1 (2)" and "5 or 6" are replaced by "4 or 5" and the words "paragraph 7" are replaced by "paragraph 6."
Efficacy
This Decree shall take effect on 1 January 2022.
