DECLARATION
of 6 November 2025
amending Decree No. 246 / 2001 Coll., laying down conditions for fire safety and performance of state fire control (Fire Prevention Order), as amended
The Ministry of the Interior provides pursuant to § 101 (a) of Act No. 133 / 1985 Coll., on Fire Protection, as amended by Act No. 203 / 1994 Coll., Act No. 237 / 2000 Coll., Act No. 320 / 2015 Coll., Act No. 229 / 2016 Coll., Act No. 284 / 2021 Coll. and Act No. 415 / 2021 Coll., for implementation of § 6c, § 15 (2), § 16 (4), § 24 (2) and § 31a of the Act:
Decree No. 246 / 2001 Coll., on the establishment of conditions for fire safety and performance of state fire control (Fire Prevention Order), as amended by Decree No. 221 / 2014 Coll., Decree No. 19 / 2021 Coll. and Decree No. 377 / 2021 Coll., is amended as follows:
1. In Article 2 (1), the words "or documentation which does not need to be processed by the designer (" unauthorised documentation ") and which is verified by the construction office or documentation for the implementation of the construction (" implementing documentation ") shall be inserted after the words" certified by the construction office. "
2. footnote 5 shall read:
"5) Act No. 283 / 2021 Coll., Construction Act, as amended. '
3. In Article 2 (4), at the end of the text in point (g), the words "the central stop and total stop switch-off element 'are added.
4. In Article 5 (6), the words "Where the conditions of a territorial decision are laid down 'are replaced by the words" When' and the words "documentation for the implementation of a building under a special legislation (12) (hereinafter referred to as" implementing documentation '), "shall be replaced by the words" implementing documents12)'.
5. footnote 12 shall read:
"12) § 7 of Decree No. 131 / 2024 Coll., on documentation of buildings. '.
6. In Article 6 (1), the words "or certified unauthorised documentation 'shall be inserted after the words" project documentation'.
7. In Article 7 (2), the words "certified unauthorised documentation" shall be inserted after the words "project documentation."
8. In Article 7 (4), the words "certified unauthorised documentation 'shall be inserted after the words" project documentation'.
9. In Article 8 (1), the words "certified unauthorised documentation 'shall be inserted after the words" project documentation'.
10. in Article 9 (2), the words "or certified unauthorised documentation, or implementing documentation, shall be inserted after the words" project documentation. "
11. in Article 16 (3) (a), the words "certified unauthorised documentation and, where appropriate, implementing documentation," shall be inserted after the words "project documentation."
12. In Article 17 (2), the word "construction 'is replaced by the words" certified unauthorised documentation or, where appropriate, implementing documentation' and the words "If certified project documentation 'are inserted", in validated unauthorised documentation or, where appropriate, implementing documentation'.
13. In Article 17 (4), the word "construction 'is replaced by the words" certified unauthorised documentation or implementing documentation, as the case may be' and the words "certified unauthorised documentation or implementing documentation 'are inserted after the words" project documentation'.
14. In Paragraph 36, the following paragraph 3 is added:
"(3) The signature of the person who has carried out the training, the trained person referred to in paragraph 1 and the person who has taken part in the training referred to in paragraph 2 shall not be required if the record of the training carried out and, where appropriate, the training is made in an electronic system which ensures that the records are carried out in a systematic and sequential manner and are protected against changes, including evidence of the participation of both the trainer and the trained person. ';
15. Paragraph 41, including the title and footnotes No 32 and 42, reads as follows:
Fire safety solutions
(1) Fire safety solutions include:
(a) the text part,
(b) drawing part.
(2) Fire safety solution is part of the fire safety solution in case of compliance with the requirements of the fire protection technical conditions
(a) calculation of the calculation part;
(b) applying a procedure different from that laid down in the Czech Technical Standard or other technical document governing the conditions of fire protection (hereinafter referred to as the "different procedure"), a special part containing:
1. determining the extent to which a different procedure is applied;
2. an indication of the methods and marginal conditions, software used or other specialised tools, input data and conditions used to demonstrate compliance with the technical conditions of fire safety of the construction.
(3) The text part of the fire safety solution contains:
(a) a list of the documents used for processing, including their identification;
(b) an indication of the construction category from the point of view of fire safety, including the criteria and characteristics for classification of the construction in accordance with Decree No. 460 / 2021 Coll., on the categorisation of buildings from the point of view of fire safety and protection of the population;
(c) a description of the construction in terms of construction structures, the number of above and underground floors, the total height of the construction, the built-up area, the purpose of use and the location of the construction in relation to the surrounding installation;
d) taking into account the construction solution design of the concept of fire safety, assessed according to the set of fire safety standards in the determination
1. fire height of construction,
2. number of persons in construction,
3. construction system,
4. use of the construction,
5. the regulations and standards used.
(4) The text part of the fire safety solution for documentation for the permit of construction, equipment or maintenance work or documentation for framework authorisation32), in addition to the requirements of paragraph 3, contains:
(a) description and determination of the requirement for technology and operation, including the indication of the limit quantity of hazardous substances;
(b) design of the division of the construction into fire sections, including their designation according to Czech technical standard ČSN 01 3495 Drawing in construction - Drawing of fire safety of buildings, determination of fire risk and, where appropriate, economic risk and determination of degree of fire safety;
(c) laying down requirements for construction structures and fire closures with regard to fire resistance, reaction-to-fire class, dripping and disposal under fire conditions or other fire safety requirements;
(d) a proposal for the concept of an escape or evacuation route, its type requirements, implementation and capacity determination of the number of persons or animals for which it is intended;
(e) the possibility of carrying out fire intervention within the scope of the description and evaluation
1. access communication and entry areas for fire-fighting equipment;
2. the requirement to establish an intervention route;
3. the method of securing the construction of fire water, including the location of an external sampling point, or, where appropriate, the requirement to secure another fire extinguisher for structures where water cannot be used as a fire extinguisher;
4. the location of the connection point of the fire technique on the self-contained fixed fire extinguishers and non-water fire pipes;
5. the location of the construction and entry surface outside the protection zone of the high-voltage overhead line with no insulation for possible safe operation;
6. sources of electricity supply, means of safe switching off of electricity in the event of fire, including the power production system and the storage of electricity,
(f) the determination of outgoing and, where appropriate, safety distances, the definition of a fire-hazard area and, in relation to the surrounding installation, neighbouring land and free warehouses, the mutual evaluation of outgoing and, where appropriate, safety distances;
(g) a description and specification of the requirement to secure the construction by fire safety equipment and dedicated fire safety equipment, the setting of conditions and the design of the way in which it is placed and installed in the construction and the way in which it is supplied;
(h) the design of the fire-safety equipment referred to in (g) shall include the method and reason for fitting the construction of the fire-safety equipment, the identification of its type and, where appropriate, the interconnections with other technical equipment;
(i) the design of the dedicated fire safety equipment referred to in (g) above the requirements referred to in (h) shall include:
1. the definition of the protected area, the identification of the technical and functional requirement for the execution of the dedicated fire safety equipment;
2. establishing the requirement for the location of the main control, control and information element;
3. establishing the requirement for the content of the implementing documentation.
The fire safety solution in the event of a collision of two or more dedicated fire safety devices shall contain a fire scenario that shall take into account their mutual links.
(5) The text part of the fire safety solution within the framework of the implementing documentation, the fire safety solution for the change in the use of the construction and the fire safety solution for the change of the completed construction beyond the requirements of paragraph 3 contains:
(a) a description of the technology and operation, including an indication of the proposed quantity of hazardous substances;
(b) the division of the construction into fire sections, including their marking according to Czech technical standard CSN 01 3495 Drawings in construction - Drawings of fire safety of buildings, determination of fire risk or economic risk, determination of degree of fire safety and assessment of size of fire sections,
(c) a description and evaluation of the proposed construction structures and fire closures in terms of their fire resistance, including an assessment of any measures to increase the fire resistance of the construction structure, a description and an evaluation of the proposed construction products and construction structures from the point of view of the reaction-to-fire class, dripping and disposal under fire conditions, or others from the point of view of fire safety of the necessary requirements;
(d) a description and assessment of the way in which persons, animals and, where appropriate, property are evacuated, the type and number of escape routes, their capacity, execution and equipment;
(e) the possibility of carrying out fire intervention within the scope of the description and evaluation
1. access communication and entry areas for fire-fighting equipment;
2. internal and external intervention routes and their technical equipment, measures to ensure the safety of fire-fighting personnel and other rescue operations;
3. the method of securing the construction of fire water, including the way in which the internal and external sampling point is located, and, where appropriate, the assessment of the method of securing another extinguishing device for the construction where the water cannot be used as a extinguishing agent;
4. the location of the connection point of the fire technique on the self-contained fixed fire extinguishers and non-water fire pipes;
5. the location of the construction and entry surface outside the protection zone of the high-voltage overhead line with no insulation for possible safe operation;
6. sources of electricity supply, means of safe switching off of electricity in the event of fire, including the power production system and the storage of electricity,
(f) determination of outgoing and, where appropriate, safety distances, definition of fire-hazard areas and, in relation to individual fire sections of the same building, surrounding installation, adjacent land and free warehouses, mutual evaluation of outgoing and, where appropriate, safety distances;
(g) a description and assessment of the requirement to secure the construction by fire safety equipment and dedicated fire safety equipment, the setting of conditions and the design of the way in which it is placed and installed in the construction and the way in which it is supplied;
(h) the design of the fire-safety equipment referred to in (g) shall include the method and reason for fitting the construction of the fire-safety equipment, the identification of its type and, where appropriate, the interconnections with other technical equipment;
(i) the design of the dedicated fire-fighting equipment referred to in (g) above the requirements referred to in (h) contains the additional requirements set out in Annex 7 to this Decree. Fire safety solutions in the event of a collision of two or more dedicated fire safety devices shall include a fire scenario that takes into account their interconnections and influence;
(j) a description and assessment of the proposed technical equipment of the construction or, where appropriate, of the technological equipment with regard to the fire safety requirement;
(k) evaluation of the proposed electrical equipment, including evaluation of all sources of power supply, cable lines and evaluation of the way in which electricity is switched off in the event of a fire;
(l) determination of the number and types of fire extinguishers and, where appropriate, other means of fire protection in kind and the requirement for its location;
(m) the scope and manner of deployment of the warning and safety mark and table42), including an assessment of the need to identify the location of the fire protection device and the fire safety device.
(6) Drawing part of the fire safety solution is processed in the scope and details according to Czech technical standard ČSN 01 3495 Drawings in construction - Drawings of fire safety of buildings and includes
(a) the graphic marking of the fire zones, including the indication of the degree of fire safety;
(b) the required fire resistance of the construction structure and the fire closure, including functional equipment;
(c) indication of the direction of escape, the exit to the open area and the total number of persons using that exit;
(d) the location of the fire and evacuation lift;
(e) the marking of the space protected by the electrical fire alarm, the equipment for detecting flammable gases and vapours, the automatic anti-explosion device, the smoke and heat discharge device, the fixed, semi-stable and supplementary fire extinguisher, and the local fire extinguisher;
(f) location of the internal and external fire water sampling point;
(g) an indication of the fire-hazard area of the construction and adjacent building, access communication, entry areas for fire-fighting equipment and intervention routes, including the connection point of the fire-fighting equipment to a self-contained fixed fire-extinguishing device, or to non-irradiated fire pipes.
(7) The drawing part of the fire safety solution in the context of the documentation referred to in paragraph 5 in addition to the requirements of paragraph 6 shall include:
(a) the location of the main power switch, the central stop and total stop switch,
(b) the direction of the escape of persons from the fire compartment and the number of persons involved in the escape route;
(c) the location of the fire safety equipment and means of fire protection.
(8) The extent of the processing and the content of the fire safety solution may be according to Czech technical standard ČSN 73 0834 in case of a change of construction of group I or II Fire safety of buildings - Changes in buildings limited to the extent of the changes made. However, they must always be sufficient to assess the fire safety of the proposed construction.

16. in Article 48 (c), the words "documentation, validated unauthorised documentation and, where appropriate, implementing documentation" shall be inserted after the words "validated project";
17. in Article 50 (1), the words "certified unauthorised documentation and, where appropriate, implementing documentation" shall be added at the end of the text of point (d).
18. The following Annex 7 is added:

Transitional provision
The fire safety solution submitted in the framework of the construction procedure or at the time of the request for a binding opinion by the authority concerned on the fire protection section, including the follow-up procedure or procedures under the construction law, shall be assessed in accordance with the existing legislation before the date of entry into force of this decree.
Efficacy
This Decree shall take effect on 1 January 2026.
