DECLARATION
of 20 December 2023
amending Decree No. 10 / 2019 Coll., on the method of notification and transmission of information and data by the operator of gambling, the range of data transmitted and other technical parameters of data transmission, and Decree No. 433 / 2021 Coll., on exit documents in the field of gambling
The Ministry of Finance provides pursuant to § 133 (1) (a) and (c) of Act No. 186 / 2016 Coll., on gambling, as amended by Act No. 527 / 2020 Coll. and Act No. 349 / 2023 Coll.:
Amendment of the Decree on the method of notification and transmission of information and data by the operator of gambling, the extent of data transmitted and other technical parameters of data transmission
Decree No. 10 / 2019 Coll., on the method of notification and transmission of information and data by the gambling operator, the range of data transmitted and other technical parameters of data transmission, is amended as follows:
1. The title of the decree is "on reporting in gambling."
2.
Subject matter
This decree regulates the manner, content and deadline for the transmission of data by the operator to the supervisory authorities under the Gaming Act, the scope of data transferred and other technical parameters of reporting, in the form of:
(a) daily game reporting in the case of live games other than as an internet game;
(b) a daily game entry in the case of bingo operated differently than as an internet game;
(c) remote access in the case of gambling other than those referred to in (a) and (b). ';
Amendment of the Decree on exit documents in the field of gambling
Decree No. 433 / 2021 Coll., on exit documents in the field of gambling, is amended as follows:
1. In Article 6 (1) (c), the word "or 'is deleted.
2. In Article 6, at the end of paragraph 1, the dot is replaced by a comma and the following points (e) and (f) are added:
"(e) a technical device transmitted by live games which, together with the server, form a functionally indivisible whole, including a device located in the studio, with the exception of a random number generator;
(f) part of the technical equipment referred to in (e). ';
3. In Annex No 2, Section 1, item 16, item 16.2, Notes 10 and 11, the following entries are added:
"10. Where a technical game is operated through an installation, the detailed technical characteristics referred to in point (c) shall be preceded by the actual technical characteristics for each combination of a set of games and game currency by the name of the set of games and game currency with a list of all technical games with a heading and a column as follows:

For the title of the technical game, which allows for the acquisition of the accumulated prize (jackpot), the footnote shall contain a description of the accumulated prize.
11. When a live game operated as an internet game is operated through the device, except for the live game transmitted, the detailed technical characteristics referred to in point (c) shall be preceded by a table with a list of all such live games with head and column in accordance with the following model:

4. In Annex 2, in Section 1, entry 16, point 16.2, the following entries 15 and 16 are inserted:
"15. In the case of an assessment of a technical device transmitted by live games, which together with the server form a functionally indivisible whole, including a device located in a studio, with the exception of a random number generator, a description of the different functions and characteristics shall be provided in the description of the assessment process referred to in point (d), at least an assessment of the following transmission conditions:
(a) real-time audiovisual transmission;
(b) a clear way of displaying numbers, inscriptions and other symbols on the roulette wheel and on the live game table, the value of cards, cubes and other equipment used in the game and the dealer;
(c) the possibility of choosing any camera by a gambling participant if the technical equipment allows multiple camera transmission;
(d) the possibility of communicating a dealer with gambling participants.
16. In the case of an assessment of a part of the technical equipment carried by live games under Note 15, the procedure laid down in Note 15 shall be followed mutatis mutandis. This shall in particular assess the conditions of transmission relating to the part of the technical equipment carried by live games. ';
Notes 15 and 16 to date are renumbered notes 17 and 18.
5. In Annex No 2, Section 1, item 16 (16.3) of note 6 and 7, the following entries are added:
'6. Where a part of the assessment is a gambling game, in the case of a technical game, the detailed technical characteristics referred to in point (c) shall be given before the technical characteristics for each combination of a set of games and game currency, a table marked by the name of the set of games and game currency with a list of all technical games with a heading and a column as follows:

Where a part of the assessment is a gambling game, in the case of a live game operated as an internet game with the exception of a transmitted live game in the detailed technical characteristics referred to in point (c), a table with a list of all such live games with a heading and a column according to the following model shall be provided before its own technical characteristics:

(a) real-time audiovisual transmission;
(b) a clear way of displaying numbers, inscriptions and other symbols on the roulette wheel and on the live game table, the value of cards, cubes and other equipment used in the game and the dealer;
(c) the possibility of choosing any camera by a gambling participant if the technical equipment allows multiple camera transmission;
(d) the possibility of communicating a dealer with gambling participants.
15. In the case of an assessment of a part of a technical device carried by live games under Note 14, the procedure laid down in Note 14 shall be followed mutatis mutandis. This shall in particular assess the conditions of transmission relating to the part of the technical equipment carried by live games. ';
Notes 14 and 15 are renumbered notes 16 and 17.
7. In Annex 2, Section 1, under item 19, the words "including their date of issue and expiry 'shall be inserted after the words" used'.
8. In Annex 3, item 9, item 9.1, Note 8:
'8. Where a technical game not operating as an internet game is operated through an installation, a table with a list of all types of terminal equipment in accordance with Section 42 (3) of the heading of the Gaming Act and a column in accordance with the following model shall be provided in the basic characteristics referred to in point (b) before its own essential characteristics:

Where a technical game is operated through an installation, the basic characteristics referred to in point (b) shall be preceded by their own essential characteristics for each combination of a set of games and game currency, a table entitled by the name of the set of games and game currency with a list of all technical games with a heading and a column as follows:

Transitional provisions
1. For a professional assessment issued before the date of entry into force of this Order and an operability certificate issued on the basis of this professional assessment, Decree No. 433 / 2021 Coll., as effective before the date of entry into force of this Order, shall apply. Within 1 month of the date of entry into force of this Order, the authorised person may, when issuing the professional assessment and the certificate of operability issued on the basis of this professional assessment, proceed in accordance with Decree No. 433 / 2021 Coll., as effective before the date of entry into force of this Order, provided that the assessment was initiated before the date of entry into force of the Decree.
2. A corrigendum issued on the exit document referred to in point 1 shall be applied to Decree No. 433 / 2021 Coll., as effective before the date of entry into force of the decree.
EFFECTIVE
This Decree shall take effect on 1 January 2024.
