amending Government Regulation No 341 / 2017 Coll., on the pay ratios of employees in public services and administration, as amended, and Government Regulation No 304 / 2014 Coll., on the pay ratios of civil servants, as amended
The Government orders pursuant to § 112 (7), § 123 (6) (d), (e) and (f) and § 129 (2) of Act No. 262 / 2006 Coll., as amended by Act No. 362 / 2007 Coll., Act No. 364 / 2011 Coll., Act No. 365 / 2011 Coll., Act No. 250 / 2014 Coll., Act No. 230 / 2024 Coll. and Act No. 263 / 2024 Coll., and under § 145 (1) of Act No. 234 / 2014 Coll., on the Civil Service, as amended by Act No. 35 / 2019 Coll.

Amendment of government regulations on pay ratios of public service employees and administration
Čl. I
Government Regulation No 341 / 2017 Coll., on the remuneration of employees in public services and administration, as amended by Government Regulation No. 263 / 2018 Coll., Government Regulation No. 332 / 2018 Coll., Government Regulation No. 158 / 2019 Coll., Government Regulation No. 300 / 2019 Coll., Government Regulation No. 603 / 2020 Coll., Government Regulation No. 322 / 2021 Coll., Government Regulation No. 420 / 2021 Coll., Government Regulation No. 531 / 2021 Coll., Government Regulation No. 264 / 2022 Coll., and Government Regulation No. 464 / 2022 Coll., are amended as follows:
1. in Paragraph 1 (f):
"(f) the division of work into groups graded according to the qualification complexity of the work carried out to determine the lowest level of guaranteed salary,"
2. In Section 4 (5) of the introductory part of the provision, the words "but not more than a total of 6 years' are deleted.
3. In Article 4 (8) and (10), "5 'is replaced by" 4'.

„§ 5
Salary fare
(1) Staff members shall be responsible for the salary tariff determined in accordance with the scale of the rates set out in Annex 1 to this Regulation for the grade and grade to which they are classified, unless otherwise specified.
(2) The staff members are responsible for the salary tariff determined in accordance with the scale of the rates set out in Annex 2 to this Regulation,
(a) if he is a health service worker referred to in § 2 (2) and (3) of the Health Services Act and not mentioned in paragraph 3; or
(b) if he is not an employee referred to in Article 303 (1) of the Labour Code or an official of a local authority pursuant to Article 2 (4) of the Law on officials of local authorities, and
1. a social services worker or a social worker in a social services establishment, a social services provider who carries out activities in social services or under other legislation in order to assist in a material emergency, in the social legal protection of children, in school and school facilities, in prison, in a detention centre, in an institution for the exercise of security detention, in an asylum facility for foreigners,
2. a social worker with a health service provider; or
3rd marriage or family counselor.
(3) Staff members shall be responsible for the salary tariff determined in accordance with the scale of the rates set out in Annex 3 to this Regulation, provided that:
(a) a physician, dental practitioner or pharmacist providing health services referred to in § 2 (2) and (3) of the Health Services Act with a health service provider; or
(b) by a doctor of a social security body pursuant to Article 3 (3) of the Act on the organisation and implementation of social security.
(4) Staff members shall be responsible for the salary tariff determined in accordance with the scale of the rates set out in Annex 4 to this Regulation, provided that:
(a) a pedagogical worker under Article 2 of the Education Workers Act; or
(b) an academic member of the State College under the Law on Higher Education. "
5. In Article 6 (2), the words ", a contribution organisation providing public cultural services or public cultural institutions under the Act on public cultural institutions' shall be inserted after the word" services'.
6. Paragraph 7, including the title and footnote 6, reads:
„§ 7
Breakdown of works into groups to determine the lowest level of guaranteed salary
The groups of works referred to in Section 112 (2) of the Labour Code include works classified in different classes of legislation (6):
(a) the first group of works shall comprise work in the 1st and 2nd grades;
(b) the second group of works includes work in the 3rd to 5th grade,
(c) the 3rd group of works includes work in the 6th to 9th grade; and
(d) The fourth group of works includes work in the 10th to 16th grade.
6) Government Decree No 222 / 2010 Coll., on the catalogue of works in public services and administration, as amended. '
7. In Article 8 (1) and (4), "6 'is replaced by" 5';
8. Annex No 2 is deleted.
Annexes 3 to 6 to date shall be renumbered Annexes 2 to 5.
(9) Annexes 1 to 4, including the headings, read:

10. In Annex No 5, Part A, in Group I, point 3, the following point 3.3 is added:
'3.3. persons whose fundamental rights and freedoms may be jeopardised in connection with the conduct of administrative offices or other institutions which are in a similar position vis-à-vis such persons, in the performance of the duties of the Ombudsman and the Ombudsman. ';
11. in Annex 5, Part A, point 3 in Group II:
'3. Work in which an employee comes into contact with detainees, accused persons, accused persons or convicted persons in criminal proceedings and civil proceedings. '
12. In Annex No 5, Part A, in Group II, the following points 8 and 9 are added:
'8. Work in which, in the exercise of the duties of the Ombudsman and of the Ombudsman of children, the staff member consistently comes into direct personal contact with persons limited to the freedom of public authority or as a result of dependency on the care provided.
9. Work consisting of the exercise of social and legal protection of children associated with strained situations which significantly interfere with the life of the child and his family, particularly in excluded locations or in an otherwise risky environment. '
13. in Annex No 5, Part A, in Group III, point 2:
'2. The execution of the work to carry out the enforcement of judgments by the court. ';
14. In Annex No 5, Part A, in Group III, point 7 is deleted.
Points 8, 8.1, 8.2 and 9 shall be renumbered 7, 7.1, 7.2 and 8.
15. in Annex No 5, Part A, point 2 of Group IV:
'2. Works performed by employees of the State in the armed forces and security forces or by employees of a state contribution organisation established under the Act on the Prison Service and the Judicial Guard of the Czech Republic
2.1. Air traffic control,
2.2. activities of diver, paratrooper, special physical training instructor or military rescue officer,
2.3. Securing the exercise of custody, the execution of the prison sentence and the performance of security detention, the security of detention prisons, prisons and institutes for the exercise of security detention and in the care of accused and convicted persons and persons in the exercise of security detention and in direct pedagogical activities in detention prisons, prisons and institutions for the performance of security detention. ';
16. In Annex No 5, Part A, in Group IV, the following points 7 and 8 are added:
'7. Continuous provision of direct service to disabled persons, mental or behavioural disorders in their home or other natural environment in the context of social services.
8. Work in which the staff member carries out physical checks on convicted persons in the course of the execution of alternative penalties and measures, including the sentence of house arrest or court-imposed restrictions and obligations or supervision. ';

Amendment of the Government Regulation on the remuneration of civil servants

Government Regulation No. 304 / 2014 Coll., Government Regulation No. 342 / 2017 Coll., Government Regulation No. 263 / 2018 Coll., Government Regulation No. 36 / 2019 Coll., Government Regulation No. 158 / 2019 Coll., Government Regulation No. 300 / 2019 Coll., Government Regulation No. 603 / 2020 Coll., Government Regulation No. 347 / 2021 Coll., Government Regulation No. 531 / 2021 Coll., Government Regulation No. 264 / 2022 Coll., Government Regulation No. 464 / 2022 Coll. and Government Regulation No. 447 / 2023 Coll., is amended as follows:
1. In Paragraph 3 (2) (d) of the introductory part of the provision, the words "but not more than 6 years in total 'are deleted.
2. In Paragraph 3 (4), "9 'is replaced by" 8'.
3. Paragraph 3 (5) is deleted.
Paragraphs 6 to 9 shall be renumbered paragraphs 5 to 8.
4. In Section 3 (5) of the Introductory Part of the provision, the words "occupying a post under Section 25a (1) of the Civil Service Act or a public servant shall be inserted after the words" a civil servant, "'.

„§ 5
Breakdown of administrative activities into groups to determine the lowest level of guaranteed salary
The categories of work referred to in Section 112 (2) of the Labour Code include administrative activities classified in different classes by other legislation1), namely:
(a) the third group of works shall cover administrative activities in the sixth to ninth grade; and
(b) the fourth group of works shall cover administrative activities in the 10th to 16th grade.
1) Government Regulation No. 302 / 2014 Coll., on the Catalogue of Administrative Activities, as amended. '
6. Paragraph 6a (1) reads as follows:
"(1) From the time of deductible practice pursuant to § 3 (2), the staff member in employment shall be deducted in accordance with § 25a (1) or § 178 (1) of the Civil Service Act classified in
(a) 6 to 9 grades
1st period of 1 year, if he achieved only secondary education with a certificate,
2. a period of 2 years, if he has achieved only secondary education; or
3rd period of 4 years, if only basic education or basic education,
(b) 10th grade
1st period of 2 years, if he achieved only secondary education with a graduate exam,
2nd period of 3 years, if he achieved only secondary education with a certificate,
3rd period of 4 years, if only secondary education, or
4. a period of six years, if only basic education or basic education,
(c) Grade 11 or 12
1st period of 3 years, if he reached only secondary education with a graduate exam,
2nd period of 4 years, if he achieved only secondary education with a certificate,
3rd period of 5 years, if only secondary education, or
4. a period of 7 years, if he has achieved only basic education or basic education; or
(d) Grade 13 to 16
1. a period of 2 years, if he has achieved only university education in a bachelor's study programme or only higher vocational education,
2nd period of 5 years, if he only achieved secondary education with a graduate exam,
3rd period of 6 years, if he reached only secondary education with a certificate,
4th period of 7 years, if he only achieved secondary education, or
5th period of 9 years, if only basic education or basic education. '
7. Annex 1 shall read as follows:
