DECLARATION
of 26 September 2006
on the safety flight standard
The Ministry of Transport provides pursuant to § 22a (1) of Act No. 49 / 1997 Coll., on Civil Aviation and on the amendment and amendment of Act No. 455 / 1991 Coll., on Business Business (Trade Act), as amended by Act No. 225 / 2006 Coll.:

SUBJECT MATTER OF THE ADJUSTMENT
§ 1
This decree lays down rules for determining the maximum duty time, flight duty periods, flight times, minimum rest requirements including rest when crossing more than one time zone, the principles of split service, the principles for the use of an enhanced and double crew and the rules for determining the standby of crew members (hereinafter referred to as "flight safety standard '):
(a) following the directly applicable legislation of the European Community1) an air carrier operating aeroplanes;
(b) an air carrier operating helicopters and airlines;
(c) an air rescue service operator.

SAFETY AIRCRAFT STANDARDS OF THE AIRCRAFT CARRIER OPERATING HIS ACTIVITIES
§ 2
Basic concepts
For the purposes of Part Two of this Order:
(a) the time difference between two time zones according to winter time;
(b) a flight crew member, a pilot, a flight engineer and an air navigator, intended for duty on an aircraft during the flight period;
(c) a flight crew member and cabin crew member;
(d) a split flight service consisting of 2 parts separated by partial rest;
(e) on the day of the period of 24 hours consecutive starting at 0.00 hours of single world time,
(f) on the day of leave, the calendar day indicated in the schedule of services where the flight crew member is not required by the air carrier's duties;
(g) a suitable room for partial rest and a flight advance of a reasonably equipped space, located in a quiet environment and not accessible to the public; and
(h) by appropriate accommodation a separate room for each member of the aircraft crew, located in a non-noisy environment, equipped with a bed, with sufficient ventilation and, where appropriate, a device to control the temperature and intensity of light.
§ 3
Duration of service
(1) The service period shall include at least:
(a) flight duty period;
(b) partial rest period,
(c) the time of transfer or local transfer to and from the place of suitable accommodation;
(d) standby time;
(e) the period of flight activity;
(f) duration of training, compulsory checking and training;
(g) the period of compulsory medical assessment;
(h) the duration of other activities required by the air carrier, in particular those related to the exercise of the management and control functions of authorised persons, such as administrative work in the office, participation in management meetings or international conferences, representation of the air carrier towards the inspection staff;
which shall be included in the service period in full unless otherwise specified in § 7 (4) and § 13 (4).
(2) The air carrier shall determine the flight time after the last flight of the service concerned, by type of aircraft and type of operation. Post-flight activity means an activity established by the approved Air Operator's Manual. The duration of the flight activity shall be at least 30 minutes.
(3) If a member of the crew of an aircraft so agrees and the conditions laid down in this Decree are met, the further service may commence before the end of a specified rest period after the completion of the previous service.
§ 4
Total flight time
Notwithstanding the maximum extent of the total flight time under the directly applicable legislation of the European Community1), the air carrier shall ensure that the total flight time does not exceed 280 hours during 90 calendar days consecutive.
§ 5
FDP
(1) The FDP shall comprise at least:
(a) flight time, including pre-flight preparation;
(b) the time to wait for the departure of the aircraft when the flight is delayed;
(c) the time at which the aircraft is stationary at a stopover;
(d) the duration of the activities referred to in Article 3 (1), if they are followed by a flight without prior rest.
(2) The air carrier shall determine the time of commencement of flight duty in order to allow sufficient pre-flight training to be carried out according to the type of aircraft and type of operation. Pre-flight preparation means pre-flight check and navigation and other pre-flight preparation carried out in accordance with the approved Air Operator's Manual. The duration of pre-flight preparation shall be at least 60 minutes at the mother airport and 45 minutes at other airports.
§ 7
Separate flight service
(1) The air carrier may provide for a flight service as a split flight service subject to the following conditions:
(a) partial rest shall not be less than 3 hours;
(b) the air carrier shall provide the crew of the aircraft with an appropriate room, but if the length of the partial rest is at least 4 hours, or if the partial rest is at least three hours between 22.00 and 6.00 hours, the air carrier shall provide appropriate accommodation for the crew of the aircraft,
(c) if the total time of local movement to and from the appropriate accommodation exceeds one hour, the period exceeding one hour shall be deducted from the partial rest period, counting into the FDP;
(d) the time difference between the opening point of split duty and the partial rest point does not exceed 3 hours; and
(e) until a partial rest period, the air carrier shall not be included for one hour to carry out the flight activity after the last flight before the partial rest and pre-flight preparation before the flight followed.
(2) A split flight service cannot be planned in the schedule of services for an enhanced flight crew as provided for in Sections 8 and 9.
(3) Where an air carrier provides for flight duty as a split flight service, the sum of the flight duty period before and after partial rest shall not exceed 12 hours.
(4) Until the service period, the air carrier shall account for half of a partial rest period of at least 8 hours.
§ 8
Reinforced aircraft crew
(1) An air carrier may designate an enhanced flight crew for flight duty, comprising a maximum of four sectors.
(2) The daily flight duty period limit for an enhanced flight crew shall be 16 hours.
(3) In the exercise of flight duty, the air carrier shall ensure that the following conditions are met by an enhanced flight crew:
(a) each member of the reinforced flight crew shall be provided with a seat with adjustable seat-back inclination in the passenger cabin preferably of a higher class than economic if present on the aircraft;
(b) in one group of associated seats, a member of the reinforced crew of an aircraft resting in flight alone, and, where appropriate, with other resting members of the reinforced crew of an aircraft; and
(c) the seats in the economic class designated by the resting members of the reinforced crew of the aircraft shall be separated from the other rows of passenger seats and the cockpit by a bulkhead or by any other appropriate means.
§ 9
Double crew
(1) An air carrier may designate an enhanced flight crew for which all the functions of the essential flight crew as determined by the air carrier for the type of aircraft concerned ("the double crew ') are duplicated. Paragraph 8 (1) and (2) shall not apply to the double crew.
(2) The composition of the double crew shall allow each member of the flight duty period to be replaced by another member of the crew.
(3) The daily flight duty period limit for a dual flight crew is 18 hours.
(4) In the performance of flight duty by a double crew member of an air carrier, in addition to the fulfilment of the conditions set out in Paragraph 8 (3), each member of a dual crew of an aircraft resting in flight shall ensure that each member of the flight crew has an area equipped with a berth located outside the cabin of passengers and the cockpit.
§ 10
Changes in crew planning
In the event that the maximum daily FDP for more than 33% of the same scheduled individual flights is exceeded in actual operation during the planned seasonal season, the air carrier shall accept appropriate changes in crew planning.
§ 11
Rest requirements
(1) If the minimum rest period laid down in the directly applicable European Communities legislation (1) is determined by the length of the previous service, this period shall be increased by a partial rest period, if the previous service has been divided.
(2) Where a service is started for at least 5 days consecutive days outside a parent aerodrome, a member of the crew of an aircraft shall be provided in accordance with the directly applicable legislation of the European Communities1) rest of the same duration as if the service is started at a parent airport.
(3) Where appropriate accommodation has been provided to a crew member during a partial rest period of at least 8 hours, the partial rest period shall not be counted for the purpose of determining rest.
(4) The air carrier shall extend the rest period by a period by which the local transfer time to and from the appropriate accommodation has exceeded 2 hours.
(5) The air carrier may shorten the rest period by a period of time by which the local transfer time to and from the appropriate accommodation is less than 2 hours, provided that the local transfer time to and from the appropriate accommodation does not exceed 1 hour 30 minutes for the journey back and forth, but the rest time spent by the flight crew member at the appropriate accommodation site must not be less than 10 hours.
(6) The air carrier will extend the rest period
(a) for 36 hours comprising two local nights in a period of 7 calendar days consecutive starting at 0.00 hours of single world time on the day following the day on which the crew member took up duty after the completion of the previous extended rest period referred to in this provision or in point (b);
(b) 60 hours covering three local nights in a period of 10 calendar days consecutive starting at 0.00 hours of single world time on the day following the day on which the crew member took up duty after the completion of the previous extended rest period referred to in (a) or under this provision.
(7) If the time difference between the opening point and the end of FDP is 4 hours or more, the air carrier shall extend the rest period to 14 hours and for each time zone exceeded, starting with the fifth time zone, by an additional 30 minutes.
(8) The air carrier shall determine to a member of the crew of an aircraft which has performed 1 or more flight services during which the time difference between the points of departure and the end of service was at least 4 hours and which has ended the flight duty in a place with a time difference of less than 1 hour from the place of its parent aerodrome, the rest period subject to the following conditions:
(a) if the time spent by a member of an aircraft crew outside a parent airport is 60 hours or less, the rest period shall be at least 24 hours or four times the time difference between the time at the place of the parent aerodrome and the time at the place situated in the outermost time zone where the member of the aircraft crew has retired, whichever is the higher;
(b) if the time spent by a member of an aircraft crew outside a parent airport is more than 60 hours, the rest period shall be at least 48 hours or eight times the time difference between the time at the place of the parent aerodrome and the time at the place situated in the outermost time zone where the member of the aircraft crew has retired, whichever is the higher;
(c) if the rest period of the flight crew member outside the parent airport was at least 48 hours and the rest was completed at a place with a difference of less than 4 hours from the place of the parent aerodrome, the air carrier may shorten the rest period determined in accordance with point (b) four times.
(9) If the flight service during which the difference at the time zones were exceeded was at least 4 hours and whose performance was terminated at a point with a time difference of less than 1 hour from the parent aerodrome, has not been terminated at the parent aerodrome, the air carrier shall, at the request of the commander, allow an additional 1 flight service to be performed at the place where the flight crew member must be relieved in accordance with paragraph 8.
(10) The air carrier shall establish days of leave in the schedule of services for the crew member within the scope of:
(a) 7 days in the calendar month into which the rest period may be included; and
(b) 24 days in the calendar quarter to which rest periods may be included.
(11) The day off must include 2 local nights. The day of leave set out in the schedule of services which has not been provided for operational reasons shall be replaced by another day of leave for the crew member within the earliest possible time.
(12) In addition to the days of leave referred to in paragraph 10, the air carrier may provide the crew member with additional days of leave to which rest periods may be included.
§ 12
Accommodation requirements
The air carrier shall provide the crew member with appropriate accommodation if:
(a) temporarily establish another base for the parent aerodrome of an aircraft crew member;
(b) a member of the crew of an aircraft spends a rest period outside a parent airport under an air carrier's orders; or
(c) apply the rules laid down for the use of the split service at the mother airport.
§ 13
Flight advance
(1) An air carrier may provide for a flight advance to a crew member
(a) at the workplace;
(b) at the place of appropriate accommodation; or
(c) at the place of residence.
(2) An air carrier may provide for a flight advance of no more than the length of an aircraft crew member:
(a) 12 hours per service;
(b) 72 hours in a period of twenty-eight calendar days consecutive;
(c) 400 hours in a calendar year.
(3) Until the FDP, the air carrier shall account for the time of the standby.
(a) by half, if it is a flight advance at the workplace;
(b) a flight advance at the appropriate accommodation or place of residence shall not be counted.
(4) Until the duty period, the air carrier shall include the time of the standby.
(a) full flight advance at the workplace;
(b) half its length, if it is a flight advance at the appropriate accommodation site; or
(c) at the end of the first four hours, half its length, if it is a flight advance at the place of residence.
(5) If an aircraft crew member so agrees and the conditions laid down in this Decree are met, the performance of an additional standby may commence before the end of the specified rest period after the completion of the previous standby.
§ 14
Unplanned extension of FDP
(1) If, for reasons of unforeseen circumstances in flight operations after the commencement of FDP, the maximum daily FDP is likely to be exceeded, the commander shall decide:
(a) after expressing the crew members of an aircraft with an additional landing above the specified limits and an extension of the flight duty period, the maximum daily flight duty limit for the essential crew of the aircraft may be increased by a maximum of 2 hours and a maximum of 3 hours for the reinforced and double crew of the aircraft;
(b) after observations made by the crew of the aircraft with a reduction of a rest period of not more than 2 hours, the rest period shall be at least 10 hours.
(2) If the rest period has been reduced in accordance with paragraph 1 (b), the air carrier shall extend the next rest period by the shortening of the rest period, and the next rest period may no longer be reduced. When reducing the rest period, the air carrier shall ensure that a member of the aircraft crew can rest in bed for at least 8 hours.
(3) If circumstances arise during the flight duty period in which the flight duty cannot be continued, the commander may interrupt the flight duty and order a crew member to rest partially. The remaining part of FDP shall be considered as split FDP.
(4) In the course of the procedure referred to in paragraphs 1 to 3, the air carrier shall adjust the flight services schedule taking into account changes in the flight duty period.

SAFETY AIRCRAFT NORMAL OF AIR CARRIER OF OPERATING TRADE AIR CARRIER AND OPERATOR OF AIR WORKING
§ 15
Basic concepts
For the purposes of Part Three of this Order:
(a) at the time of commencing the service, the hour specified by the air carrier or the airline operator for taking up the crew of the helicopter or aircraft;
(b) a flight crew member of a helicopter or aircraft pilot, cabin technician and air navigator, designated for duty in a helicopter or aircraft during the flight period;
(c) a flight crew member with an appropriate licence participating in a flight on board an aircraft;
(d) a helicopter crew member and a cabin crew member with an appropriate licence to take part in a flight on a helicopter;
(e) on the day of a time period of 24 hours consecutive starting at 0.00 hours of single world time,
(f) the day of leave on the calendar day indicated in the schedule of services of the home airport where a crew member of the helicopter or aircraft is not assigned by the air carrier or the airline operator of the duty;
(g) a flight duty period commencing in an hour to be determined by the air carrier or by the airline operator or by the actual start of the service by applying to a crew member of a helicopter or aircraft for a service involving a flight or series of flights and ending with the expiry of the flight time after the last flight of that flight;
(h) the time period of flight from the moment when the helicopter rotors start to rotate until the last time the helicopter stops at the end of that flight and the rotors stop, or the time period from the time when the first flight starts to take off until the moment when the aircraft is stopped at the designated stop point or the last engine is switched off, whichever is the later;
(i) the period of service of a time period commencing with the entry into service of a helicopter or aircraft crew member in the hour and place ordered by the air carrier or aircraft operator and ending at the time when the helicopter or aircraft crew member has no duties;
(j) by the home aerodrome for aircraft of an aerodrome at the site designated by the crew member of an aircraft operator;
(k) by the home aerodrome for helicopters, the area or area defined for construction, intended for take-off and landing of helicopters, located at the site designated by the crew member of the helicopter by the air carrier or by the air traffic operator;
(l) the calendar day of a period of 24 hours consecutive starting at 0.00 local time;
(m) local nights a continuous period of eight hours between 22.00 and 8.00 local time;
(n) by transferring a crew member of a helicopter or aircraft from one place of service to another, with the exception of transport;
(o) transfer of a crew member of a helicopter or aircraft from the place of duty to and from the place of appropriate accommodation;
(p) a service of performance of duties mandated by a crew member of a helicopter or aircraft by an air carrier or an airline operator associated with their business as holder of an air carrier or air traffic operator certificate;
(q) by appropriate accommodation, a separate room for each crew member of the helicopter or aircraft, located in a non-noisy environment, equipped with a bed, with sufficient ventilation and, where appropriate, a device to control the temperature and intensity of light; and
(r) a basic rest period of continuous time during which no duties are imposed on a crew member of a helicopter or aircraft.
§ 16
Duration of service
(1) Service period includes:
(a) flight duty period;
(b) partial rest period,
(c) the time of transfer or transport;
(d) the duration of training, compulsory checking and training;
(e) the period of compulsory medical assessment;
(f) the duration of any other activity required by the air carrier or by the airline operator, in particular administrative work at the office, participation in regular assessment interviews conducted by a person authorised by the air carrier or by the airline operator, the regular submission of flight notes for inspection by a person authorised by the air carrier or by the air carrier operator, the maintenance and updating of his own, the aviation regulations laid down, the operational documentation, for persons approved by the civil aviation authority, the exercise of control authorisations and the conduct of regular training or cutting of grass, and further maintenance of the take-off and landing routes or places.
(2) The air carrier or the airline operator shall ensure that the total duration of service of the helicopter or aircraft crew does not exceed:
(a) 60 hours during seven calendar days consecutive;
(b) 190 hours during twenty-eight calendar days consecutive;
(c) 1800 hours during 12 calendar months consecutive.
§ 17
Flight time
(1) The air carrier or the airline operator shall ensure that the total flight time of all flights or the total number of all starts for the single-pilot helicopter or aircraft crew does not exceed:
(a) 7 hours or 70 starts within 24 hours consecutive;
(b) 90 hours during twenty-eight calendar days consecutive;
(c) 900 hours in the 12 calendar months consecutive.
(2) The air carrier or the airline operator may increase the limit referred to in paragraph 1 (a) by a maximum of one hour or 10 starts, up to a maximum of three times in seven calendar days consecutive.
(3) The air carrier or the airline operator shall ensure that the total flight time of all flights or the total number of all launches for a multi-pilot helicopter or aircraft crew does not exceed 8 hours or 80 launches within 24 hours consecutive.
(4) The air carrier or the airline operator may increase the limit referred to in paragraph 1 (a). (b) with the agreement of a helicopter or aircraft crew member by a maximum of 10 hours, not more than four times in a period of 12 calendar months consecutive. This limit cannot be increased in two consecutive calendar months.
§ 18
FDP
(1) The FDP includes:
(a) flight time, including pre-flight preparation;
(b) time of downtime after commencing the service;
(c) the period of standing of the helicopter or aircraft at a stopover;
(d) the duration of the security breaks;
(e) the period of flight activity;
(f) the duration of the activities referred to in Article 16 (1) if they are followed by a flight without prior basic rest.
(2) The air carrier or the airline operator shall determine the time of commencement of flight duty to allow sufficient pre-flight training to be carried out according to the type of helicopter or aircraft and type of operation. Pre-flight preparation means checking the status of a helicopter or aircraft prior to the conduct of a flight and navigation and other preparation for a flight carried out in accordance with an approved Operations Manual of the air carrier or aircraft operator. The duration of the pre-flight preparation period shall be at least 15 minutes.
(3) The air carrier or the airline operator shall determine the duration of the flight after the last flight of the service concerned, by helicopter or aircraft type and type of operation. A post-flight operation means the introduction of a helicopter or aircraft into a condition capable of transmitting to the ground-based technical services after all the activities carried on board, the analysis of the flight with crew and the reporting of the progress and incidents that occurred during it. The duration of the flight activity shall be at least 15 minutes.
(4) The maximum daily FDP is 12 hours.
(5) The air carrier or aircraft operator shall provide a crew member with a security break of at least 30 minutes after four hours of 30 minutes of flight time.
(6) If the number of landings during the flight duty period exceeds 4 landings per hour, the air carrier or aircraft operator shall provide a security break to the crew member of the helicopter or aircraft after every three hours of the flight time. The security break is for rest only.
(7) If circumstances arise during the flight duty period referred to in paragraph 3 in which a security break cannot be provided after three hours of flight time, a security break may be initiated for the purpose of completing the flight at a later time, but no later than three hours of 15 minutes.
(8) The air carrier or the airline operator may establish a flight service as a split flight service. Where an air carrier or an air labour operator determines a flight service as a split flight service, it may increase the maximum daily FDP to 15 hours.
§ 19
Rest requirements
(1) The air carrier or aircraft operator shall ensure that a crew member of a helicopter or aircraft is provided with a basic rest period of at least 11 hours before commencing flight duty with a possibility of bed rest of at least eight hours.
(2) The air carrier or the airline operator may reduce the basic rest period to 9 hours if the subsequent basic rest period is extended by the shortening period.
(3) The air carrier or the airline operator shall extend the period of basic rest
