DECLARATION
of 31 October 2025
on methods of efficient further use of the electricity consumed
The Ministry of Industry and Trade provides pursuant to § 14 (4) of Act No. 406 / 2000 Coll., on Energy Management, as amended by Act No. 165 / 2012 Coll., Act No. 318 / 2012 Coll., Act No. 310 / 2013 Coll. and Act No. 103 / 2015 Coll., to implement § 6 (5) of this Act:
§ 1
Subject matter
This Decree regulates the methods of efficient further use of electricity consumed in an electrical installation used by the provider of the support services or the provider of flexibility under the Energy Act to provide support services or flexibility.
§ 2
Method of efficient further use of electricity consumed
(1) The mode of efficient further utilization of electricity consumed in an electrical installation used by the provider of the support services or the provider of flexibility under the Energy Act for the provision of support services or flexibility is, if in the electricity consumption process,
(a) heat energy is produced or generated in a quantity of not more than 2,88 GJ with a consumption of 1 MWh of electricity; or
(b) the heat energy produced or generated is used to meet economically justifiable heat energy demand.
(2) Economically justifiable demand for heat energy is demand that does not exceed the needs of heat energy and that would otherwise be satisfied under market conditions by other processes of production or generation of heat energy.
§ 3
Efficacy
This Decree shall take effect on the 15th day following that of its publication.
