DECLARATION
of 20 December 2013
laying down a model for the draft registration in the list of obliged persons in the field of tyre recycling and the content of the annual report on the fulfilment of the tyre recycling obligation
According to Articles 38 (11) and 38b (9) of Act No. 185 / 2001 Coll., on waste and on the amendment of certain other laws, as amended by Act No. 188 / 2004 Coll. and Act No. 169 / 2013 Coll., ("the Act '):
The mandatory person referred to in Article 38 (3) of the Act who places on the market tyres or vehicles incorporating tyres shall submit a proposal for registration in the list of obliged persons in the field of retreading of tyres on a form the model of which is set out in Annex 1 to this Decree.
(1) The annual report on the fulfilment of the retreading obligation for the previous calendar year contains:
(a) if the natural person, the name and, where applicable, the names, and the surname or business name, the address of the registered office and the identification number of the person, if any;
(b) if it is a legal person, a business name or a name, legal form, address of the registered office and identification number of the person, if assigned;
(c) the period (calendar year) for which the report is drawn up;
(d) the tables to the extent and with the particulars set out in Annex 2 to this Decree;
(e) the name and, where appropriate, the names, surnames and contact details of the person who drew up the report.
(2) Compulsory persons who join together in order to fulfil the retreading obligation may send an annual report to the Ministry of the Environment jointly. In this case, the annual report shall contain, in Tables 1 and 2 of Annex 2 to this Decree, summarized data as well as a list of associated obliged entities.
Transitional provision
Paragraph 2 of this Decree shall apply for the first time to the processing of the annual report on the fulfilment of the retreading obligation for 2014.
Efficacy
This Decree shall take effect on 1 January 2014.
