DETAILED COMMUNICATION LAW
INTRODUCTORY PROVISIONS
Subject matter
The Act regulates the rights and obligations of road users under the special legislation (1) (hereinafter "road infrastructure '), the rules on road traffic, the regulation and management of road traffic, driving licences and driving licences and defines the competence and competence of the public authorities and the police of the Czech Republic (hereinafter" police') in road traffic.
Definition of basic terms
For the purposes of this Act:
(a) the road operator is anyone who directly participates in road traffic;
(b) the vehicle operator is the owner of the vehicle or any other natural or legal person authorised by the vehicle owner to operate on his own behalf;
(c) the guide to the animals led or driven is a road operator who accompanies animals individually or in herds on the road; the guide to the animals led or driven is not a walker leading the dog,
(d) the driver is a road operator driving a motor vehicle or a tram; the driver is also an animal rider,
(e) the vehicle is the driver driving the vehicle;
(f) the vehicle is a motor vehicle, a non-motor vehicle or a tram;
(g) the motor vehicle is a non-rolling stock powered by its own propulsion unit and a trolleybus;
(h) a non-motor vehicle is a vehicle moving by means of human or animal power, such as a bicycle, a handcart or a coating vehicle;
(i) the combination is a set consisting of one or more motor vehicles and one or more trailers (2);
(j) a pedestrian is also a person who pushes or pulls sledges, a baby stroller, a wheelchair or a handcart of a total width of not more than 600 mm, moves on skis or roller skates or by means of a hand or motor wheelchair, carries a bicycle, a motorcycle with a cylinder capacity of up to 50 cm3, a dog and the like;
k) public passenger transport vehicle is a bus, trolleybus or tram,
(l) not to endanger means the driver's obligation to act in such a way that no danger arises to another road user;
(m) not to restrict means the driver's obligation to act in such a way as not to interfere with another road user;
(n) State means putting the vehicle at rest beyond the time of the stop leave;
(o) stop the vehicle for the period strictly necessary for the immediate boarding or disembarkation of the passengers or for the immediate loading or composition of the load;
(p) stopping the vehicle means interrupting the journey for reasons independent of the driver's will;
(q) to give priority in driving means the obligation of the driver not to start or continue driving if the driver who takes priority in driving would suddenly have to change direction or speed;
(r) the motorway is a road marked "Motorway,"
(s) the road for motor vehicles is the road marked "Road for motor vehicles,"
(t) the lane is the part of the road which allows vehicles other than two-wheel (motorcycle) to travel in one stream in succession;
(u) the connecting lane is an additional lane intended for the inclusion of vehicles in the continuous lane;
(v) the roadside is the part of the road surface situated between the edge of the adjacent lane and the edge of the crown of the road (1), usually consisting of a reinforced and unreinforced part,
(w) the intersection is the place where the infrastructure intersects or connects; the result of a field or forest road or other dedicated infrastructure on another road is not considered to be an intersection,
(x) the border of the intersection is the place marked by the horizontal road sign "Cross line continuous," "Cross line continuous with the symbol Give priority in driving!" or "Cross line continuous with the sign STOP"; where there is no such road sign, the border of the intersection forms the perpendicular to the axis of the road at the point where the curvature of the road edge begins for the intersection;
(y) the traffic-controlled intersection is the intersection at which traffic is controlled by light signals or, where appropriate, by accompanying acoustic signals or by a police officer in uniform ("police officer"), a member of the Military Police in uniform ("military police officer"),
(z) the continuous lane is a lane running in the original direction (without turning) by a intersection or at a point where the number of lanes changes;
(aa) the tram belt is part of the infrastructure intended primarily for the operation of trams;
(bb) the railway crossing is the place where the infrastructure with the rail, or with another runway situated on a separate body, crosses at a level and marked by the appropriate road sign;
(cc) the municipality is a built-up area whose beginning and end are marked by the appropriate road signs on the road; no marks shall be affixed on special purpose roads;
(dd) the crossing point for pedestrians is a place for road communication intended for pedestrian crossing, marked by the appropriate road sign;
(ee) obstacle to road traffic is all that could jeopardise the safety or continuity of road traffic, such as cargo, material or other objects, a vehicle left on the road or defects in the mobility of the road,
(ff) reduced visibility is a situation where road users do not clearly identify other vehicles, persons, animals or objects on the road, for example from dusk to dawn, fog, snow, heavy rain or tunnel;
gg) the identity document is a document by which a citizen of the Czech Republic or a foreigner proves his identity in accordance with the special legislature3),
(hh) the competent regional authority or municipal authority of the municipality with extended scope is the regional authority or municipal authority of the municipality with extended scope, which is competent according to the place of residence of the applicant for a driving licence, the applicant for the return of a driving licence, the holder of a driving licence or the holder of a driving licence, or the person who does not have a permanent residence in the Czech Republic or a temporary residence in the Czech Republic, which lasts for at least 185 days unless the person proves that he has been preparing for the pursuit of the profession in the Czech Republic for at least 6 months (hereinafter referred to as "temporary residence ') for which the applicant for a driving authorisation, the applicant for the return of a driving licence, the holder of the driving licence has passed a professional competence test under the special legislation4);
(ii) the restraint system is a device approved under a special legislation (2) and intended to ensure the safety of the persons carried; the restraint is a safety belt or a child restraint ("child seat '),
(jj) a child seat is a device approved under a special legislature2) intended to ensure the safety of children carried whose body weight does not exceed 36 kg and the height does not exceed 150 cm;
(kk) the national transport information system is a system containing up-to-date information on the road traffic situation affecting road safety and traffic continuity;
ll) the crossing for cyclists is a place for road communication intended for crossing cyclists through road communication marked by the appropriate road sign.

Road users
Basic conditions for participation in road traffic
(1) A person may not participate in road traffic which, due to his age or reduced physical or mental capacity, could jeopardise the safety of such traffic. This shall not apply where a person himself or another person has taken such measures as to avoid a risk to road safety.
(2) Only a person who is physically and mentally fit to drive a vehicle or ride an animal and, to the extent necessary, controls the driving or riding of the vehicle and the road traffic rules may drive a vehicle or drive an animal.
(3) Only a motor vehicle may drive:
(a) a person who holds the relevant driving licence under Paragraph 81; or
(b) an applicant for a driving licence who, under the supervision of a driving schoolteacher (4), is undergoing training in the driving of a motor vehicle or consists of a driving test; or
(c) a person who, under the supervision of a teacher, is preparing for a proficiency check for driving or is taking an examination under this examination (4a).
(4) No one shall use technical means and equipment which render the technical means used by the police or by the Military Police impossible or affecting the function of technical means used in the surveillance of road safety ("anti-radar ').
Obligations of road users
When participating in road traffic, everyone shall:
(a) to behave with due regard and discipline so as not to endanger the life, health or property of other persons, nor to harm the environment, nor to threaten the life of animals, but to adapt its behaviour in particular to the construction and transport conditions of the road (1), the weather conditions, the situation on the road, its capabilities and its health status;
(b) comply with the road traffic rules provided for in this Act, the instructions of the policeman, the instructions of persons authorised to drive on the road pursuant to § 75 (5), (8) and (9) and the stopping of vehicles pursuant to § 79 (1) and the instructions of persons covered by special legislation (5), issued to ensure the safety and continuity of road traffic;
(c) comply with light and, where appropriate, with accompanying acoustic signals, signs, transport equipment and operational information devices.
Driver's obligations
(1) In addition to the obligations set out in Section 4, the driver is also obliged to:
(a) use a vehicle which meets the technical conditions laid down by the specific legislation of m2);
(b) pay attention to fully driving a vehicle or riding an animal and monitor the situation in road traffic;
(c) adapt the ride to the technical characteristics of the vehicle or to the physical characteristics of the animal;
(d) take care, in particular, against children, persons with reduced mobility and orientations6), persons with a severe disability and animals, taking into account a vehicle transporting children, a driver of a beginner or a person with a severe disability marked under the implementing legislation and a training vehicle marked under the special legislation4),
(e) remove the fault at the point of travel if it finds that the vehicle or load does not meet the conditions laid down in § 52; if it cannot do so, it may continue to drive at a reasonable speed only to the nearest place where the fault can be removed; In doing so, they must take measures to ensure that road safety is not compromised during the journey and that neither infrastructure nor the environment is damaged;
(f) submit to an examination under special legislation on the call of a police officer or a municipal police officer (7) to determine whether he is affected by alcohol;
(g) to undergo, at the request of a police officer or an officer of the municipal police, an examination under special legislation (7) to determine whether it is affected by another substance;
(h) with the exception of the driver of a tram, to allow a pedestrian who is at or likely to use the pedestrian crossing, undisturbed and safe crossing of the road; Therefore, the driver of such a vehicle must approach the pedestrian crossing at such a speed as to be able to stop the vehicle before the pedestrian crossing and, if necessary, be obliged to stop the vehicle before the pedestrian crossing,
(i) reduce the speed of travel or stop the vehicle before crossing for pedestrians, if it reduces the speed of travel or stops the vehicle before crossing for pedestrians and drivers of other vehicles in the same direction;
(j) to ensure the safety of the person or animal8) and the safe transport of the cargo;
(k) ensure that the animal transported does not endanger the driver and the person transported;
(l) ensure that the necessary number of eligible and properly trained persons is added to the journey when road safety is required.
(2) The driver may not:
(a) take an alcoholic drink or use an addictive substance while driving;
(b) drive a vehicle or ride an animal immediately after ingestion of an alcoholic drink or the use of an addictive substance or at such time after ingestion of an alcoholic drink or the use of an addictive substance where it may still be under their influence;
(c) drive a vehicle or ride an animal if its ability to drive a vehicle or ride an animal is reduced as a result of its health status;
(d) hand over the driving of the vehicle or entrust the animal to a person who does not meet the conditions laid down in Article 3 (2) and (3) or who is under the influence of alcohol or other addictive substances or whose ability to drive or ride an animal is reduced as a result of his health status;
(e) discarding objects from the vehicle;
(f) endanger pedestrians crossing the road to which the driver turns, turning to a place situated outside the road, entering the road and turning or reversing.
Obligations of the driver of the motor vehicle
(1) In addition to the obligations set out in Sections 4 and 5, a driver of a motor vehicle shall:
(a) be handcuffed to the seat of the safety-belt when the seat is mandatory in accordance with the special legislation (2);
(b) not to be carried in a vehicle of category M1, N1, N2 or N32, which is not equipped with a restraint safety system;
1. a child under three years old,
2. a child less than 150 cm on the seat next to the driver,
(c) carry in a vehicle of category M1, N1, N2 or N32) which is equipped with a restraint safety system, a child whose bodyweight does not exceed 36 kg and a height not exceeding 150 cm, only using a child seat; during this transport
1. the child must be placed in a child seat corresponding to his weight and body dimensions;
2. on a seat which is equipped with an airbag which has not been switched off, or, if it has been switched off automatically, the child in the child's car seat must not be transported face-to-face,
(d) place and attach the child seat on the seat and the child in the child's seat under the conditions laid down by the manufacturer in the instructions for use of this child's seat;
(e) carry in a vehicle of category M1, N1, N2 or N32) fitted with a restraint system, a child whose body weight exceeds 36 kg or a height exceeds 150 cm only if the child is restrained by a safety belt while driving;
(f) carry in a vehicle of categories M1 and N12) which is equipped with a restraint system and in which two child seats are already fitted in the rear seat and the lack of space does not permit the placing of a third child seat, a third child older than 3 years of age and less than 150 cm in the rear seat only if the child is restrained by a seat belt while driving;
(g) to instruct persons over 3 years of age or persons accompanying them in a vehicle of categories M2 and M32) which is equipped with a restraint safety system on the obligation to use the restraint safety system, unless this information is otherwise ensured;
(h) while driving on a motorcycle or on a moped on a head fitted and properly secured to a protective helmet of an approved type pursuant to a special legislation (2), and to protect your sight when driving by appropriate means, such as glasses or shields, unless this reduces the safety of the journey, such as rain or snow.
(2) Paragraph 1 (a) shall not apply to:
(a) the driver when reversing the vehicle;
(b) a driver who cannot use the safety belt for health reasons;
(c) drivers of a vehicle of safety corps, armed forces and military intelligence in the performance of service duties, drivers of a fire protection unit in the handling of emergency situations (8a) and drivers of a vehicle of the emergency medical emergency service in cases where the use of a safety-belt prevents the rapid departure of the vehicle in order to perform further duties.
(3) The provisions of paragraph 1 (c), (e) and (f) shall not apply:
(a) for a driver who carries a person whose medical condition does not allow the use of a restraint safety system;
(b) for the carriage of a child in a vehicle of safety corps in the performance of official duties, in a vehicle of the municipal police in the performance of its duties, in a vehicle of the fire protection unit in the handling of emergencies (8a) and in a vehicle of the emergency medical emergency services in the handling of emergencies (8a) or in the provision of medical care to a child;
(c) until 1 May 2008, for the transport of children in vehicles providing for the collection and delivery of children to parent and primary schools or the transport of children to sporting, cultural or social events, provided that the speed of the vehicle is limited to a maximum of 70 km / h-1
(4) Paragraph 1 (c) does not apply to the carriage of children in a municipality in a taxi service vehicle when operating a taxi service; the child referred to in point (c) shall not be transported on the seat next to the driver and shall be restrained by a safety belt. However, if a child's car seat is used in the transport of the child, the condition referred to in paragraph 1 (b) shall be fulfilled. (c) point 2.
(5) Paragraph 1 (h) does not apply to drivers of a mountain service vehicle in cases where the use of a protective helmet could make it difficult or impossible to communicate with the person rescued.
(6) Health reasons shall be supported by a medical certificate, except where the current state of health appears to be indicative of sudden medical difficulties manifesting in the fulfilment of the medical grounds referred to in paragraph 2 (b) and paragraph 3 (a). This certificate shall be kept by the driver or the child transported or by the person accompanying the child transported while driving and, at the request of the police officer, shall be presented for inspection; in cases where there is no permanent condition, the validity of the medical certificate shall be limited in time to a maximum of 1 year. The implementing legislation shall lay down the particulars and model of the medical certificate.
(7) If the number of children transported older than three years of age exceeds the number of seats fitted with safety belts or child seats, the driver of a vehicle of category M1 and N12 may, on a temporary basis, not later than 1 May 2008, carry more children on the road than the number of seats fitted with safety belts or child seats without the use of a restraint system on the rear seat, on roads with the exception of motorways and express roads.
(8) The driver of the motor vehicle shall carry:
(a) a driving licence;
(b) a vehicle registration certificate pursuant to a special legislation (2);
(c) a document proving the liability insurance for damage caused by the operation of the vehicle under the special legislature9),
(d) a certificate of professional competence of the driver as regards the driver who is obliged to participate in the improvement of professional competence in accordance with the special Regulation (2a);
(e) a medical certificate as regards the driver as referred to in Article 87 (3).
(9) At the request of a police officer, the driver of a motor vehicle shall submit the documents referred to in paragraph 8 to the police officer for inspection. At the request of an officer of the municipal police in a uniform or customs officer (9b) in a uniform manner, the driver of a motor vehicle shall submit to the officer in a uniform or a customs officer (9b) in a uniform manner the documents referred to in paragraph 8 (a) and (b).
(10) The driver of the motor vehicle shall, at the request of the police or customs officer (9b), subject the vehicle to the check of the maximum permissible axle load, the maximum permissible mass of the vehicle or combination or technical condition of the vehicle or combination.
(11) A driver of a vehicle of the armed forces shall, at the request of a police officer or a military police officer, subject the vehicle or combination to a technical condition check.
(1) The driver may not:
(a) hand over the steering of a motor vehicle to a person who does not comply with the conditions of Paragraph 3 (3);
(b) bother other road users or other persons in particular with excessive noise, air pollution, sludges, mud or unnecessary keeping the engine of the stationary vehicle running;
(c) when driving by the vehicle, hold the telephone or other means of communication or recording equipment;
(d) smoking while riding a motorcycle, moped and bicycle;
(e) carry a person under 12 years of age in the second motorcycle seat.
(2) The driver of a public passenger vehicle shall not smoke and eat and drink in the vehicle while driving, talk to the persons carried and allow them to enter the area reserved for the driver, start before closing the door and open the door before stopping.
(3) A driver of a taxi and occasional passenger road transport10) must not smoke while carrying passengers in a vehicle.
(4) The driver of a motor vehicle with a maximum permissible mass exceeding 3 500 kg, a special vehicle or a combination of vehicles shall drive from a slope with a gear assigned. A driver of a motor vehicle with a maximum permissible mass not exceeding 3,500 kg shall do so if driving safety so requires.
(5) Paragraph 1 (c) shall not apply to drivers of a vehicle of safety corps, armed forces and military intelligence in the performance of service duties, drivers of a vehicle of the municipal police in the performance of its duties and drivers of vehicles of fire protection units and emergency medical services (8).
Obligations of the tram driver
(1) Sections 4, 5 and 7 (1) (a) and (c) apply to tram drivers.
(2) The driver of the tram shall carry with him the identity card and licence to drive the railway vehicle according to the special legislation (11). At the request of a police officer, the tram driver shall submit these documents to the police officer for inspection.
Obligations of the driving school teacher
(1) A driving school teacher may not, when carrying out training under special legislation (4)
(a) use an alcoholic beverage or use another addictive substance while driving in a training vehicle;
(b) to sit in a training vehicle immediately after drinking an alcoholic drink or using another substance which may still be under their influence;
(c) to sit in a training vehicle while driving if its ability to perform the driving teaching function is reduced as a result of its health status.
(2) The driving school teacher is obliged to carry out training according to the specific legislation4)
(a) submit to a police officer or a municipal police officer at the request of a police officer under special legislation (7) in order to determine whether he is affected by alcohol;
(b) to undergo, at the request of a police officer or a municipal police officer, an examination under special legislation (7) to determine whether it is affected by another substance.
Obligations of the person transported
(1) The person transported shall:
(a) be handcuffed to the seat of the safety-belt when the seat is mandatory in accordance with the special legislation (2);
(b) to use, while travelling on a motorcycle or moped, a protective helmet of an approved type in accordance with a special legislation (2) which is fitted and properly attached to the head;
(c) not to jeopardise road safety by acting, in particular not to restrict the driver in the safe operation of the vehicle;
(d) follow the instructions of the driver, in particular when boarding and leaving the vehicle.
(2) The obligations referred to in paragraph 1 (a) shall not apply to persons over 18 years of age and less than 150 cm and persons who cannot do so on medical grounds on the basis of a medical certificate. The medical certificate shall be kept with them while driving; in cases where the condition is not permanent, the validity of the medical certificate shall be limited to a maximum period of one year. The particulars of the medical certificate shall be laid down in the implementing legislation. If a person is moved on a wheelchair in a vehicle, the wheelchair and the person affected shall be handcuffed by a special restraint system approved by the design (2).
(3) Furthermore, the obligations referred to in paragraph 1 (a) do not apply to safety forces, armed forces and military intelligence in the performance of their duties and fire brigade in the vehicle of the fire protection unit in the event of an emergency (8a) when the use of the safety belt prevents the rapid departure of the vehicle, the training instructor and the medical professional from providing health care to the patient at the time of transport.
(4) The obligation referred to in paragraph 1 (b) shall not apply to a Mountain Service member in cases where the use of a protective helmet could make it difficult or impossible to communicate with the rescued person or where the use of a protective helmet excludes the medical condition of the rescued person.
(5) The person to be transported shall not throw items out of the vehicle.
(6) The person being transported on a motorcycle shall touch the foot of the foot and shall not smoke.
(7) Side sitting on a motorcycle is prohibited.
Vehicle operator
Obligations of the vehicle operator
(1) The vehicle operator shall not:
(a) order or allow a vehicle which does not comply with the conditions laid down in specific legislation (m2) to be used on the road;
(b) to entrust the driving of a vehicle to a person who does not meet the conditions of Paragraph 3 (2);
(c) entrust the steering of a motor vehicle to a person who does not meet the conditions laid down in Article 3 (3);
(d) order or entrust separate driving of a vehicle to a person who does not know the information necessary to determine its identity.
(2) The vehicle operator shall ensure that the colour design and marking of the vehicle are not confused with the special colour performance of the military police vehicles under the special legislature12), the police under the special legislature13), the customs administration under the special legislature14), the municipal police under the special legislature14a), the prison services of the Czech Republic (the "Prison Service ') under the special legislature14b) and the vehicles of the fire protection units under the special legislature14c).
(3) The vehicle operator and the person entrusted by the vehicle by the vehicle operator, except where the vehicle operator is the intelligence service, are required at the request of the police, regional authority or municipal authority of the municipality with extended competence to communicate the facts necessary to determine the identity of the driver of the vehicle suspected of violating the provisions of this law; This provision is without prejudice to the provisions of special legislation14d.
(4) The operator of a category M2 and M32 vehicle equipped with a restraint shall ensure that persons older than 3 years of age or accompanying persons are instructed to use this restraint. Information arrangements shall be laid down in implementing legislation.
Road rules
Driving by vehicles
Direction and method of driving
(1) The road shall be driven to the right and, unless special circumstances prevent it, at the right edge of the road, unless otherwise specified.
(2) The driver of a motor vehicle may only drive on the side of the road when stopping and standing, or, if necessary, when circling, avoiding, turning or turning; caution must be exercised.
Driving in lanes
(1) Outside the municipality, two or more lanes marked on the road in one direction are used in the right lane. In other lanes, if necessary for driving, passing, turning or turning.

(3) If there is such traffic density on a road communication of two or more lanes in one direction that continuous currents of vehicles are generated in which the driver of a motor vehicle can only drive at a speed that depends on the speed of the vehicles driving ahead of it, motor vehicles may drive simultaneously (hereinafter referred to as the "concurrent driving '); it is not considered to be overtaking when vehicles are driving faster in one lane than in another lane.
(4) On road communication of three or more lanes marked on the road in one direction, the driver of a truck of a total mass exceeding 3,500 kg, a combination of which exceeds 7 m in length, a special motor vehicle and a motorcycle with a maximum authorised speed of not more than 45 km.h-1 may use only two lanes closest to the right edge of the road; in other lanes, it shall only be allowed to drive if it is necessary to circle, turn or turn.
(5) The driver may only pass from one lane to another if he does not endanger and limit the driver driving in the lane to which he passes; in so doing they must give signs of changing direction of travel. When driving simultaneously, the driver of vehicles driving in a continuous lane shall allow the drivers of the vehicles to drive into that lane passing from a lane which has ceased to be continuous, so that the vehicles driving in a continuous lane and the vehicles passing into it can shift alternately into the running lane running current. Where two lanes converge into one without being obvious which one is continuous, the driver driving in the left lane shall not endanger the driver driving in the right lane.
(6) On a road communication with three lanes marked on the road in one direction, the driver may only cross from the left lane to the middle lane if he does not endanger the driver crossing the middle lane from the right lane; A similar approach shall be made when crossing from left lane to medium lane on the road with four or more lanes marked on the road.
